Voter registration for the Sioux Falls Municipal Runoff Election (if needed) to be held on Tuesday, June 23, 2026, will close on Monday, June 8, at 5:00 p.m. Failure to register by this date will cause forfeiture of voting rights for this election. If you are in doubt about whether you are registered, check the Voter Information Portal at www.sdsos.gov or call the Minnehaha County Auditor’s Office at (605) 367-4220 or the Lincoln County Auditor’s Office at (605) 764-2581.
Registration may be completed during regular business hours at the county auditor’s office, municipal finance office, secretary of state’s office, and those locations which provide driver’s licenses, SNAP, TANF, WIC, military recruitment, and assistance to the disabled as provided by the Department of Human Services. NOTICE OF PUBLIC HEARING
WITH RESPECT TO A SENIOR LIVING AND HEALTH FACILITY PROJECT AND
THE ISSUANCE OF BONDS UNDER SOUTH DAKOTA CODIFIED LAWS CHAPTER 9-54, AS AMENDED
NOTICE IS HEREBY GIVEN that the City Council of the City of Sioux Falls, South Dakota (the “City”) will meet on June 16, 2026, at 7 p.m. at Carnegie Town Hall, 235 W Tenth Street, Sioux Falls, South Dakota, for the purpose of conducting a public hearing on the proposal to issue revenue bonds in a principal amount not to exceed $55,000,000 (the “2026 Bonds”), pursuant to South Dakota Codified Laws, Chapter 9-54, as amended (the “Act”), in order to (a) refund on a current basis the City’s outstanding Health Facilities Revenue Refunding Bonds (Dow Rummel Village Project), Series 2016 issued in the original principal amount of $22,760,000 (“Series 2016 Bonds”) and outstanding Health Facilities Revenue Bonds (Dow Rummel Village Project), Series 2017 issued in the original principal amount of $29,140,000 (“Series 2017 Bonds”), (b) finance certain capital improvements (the “2026 Project”) to be undertaken by Dow Rummel Village, a South Dakota nonprofit corporation formerly known as Rummel Memorial Home, Inc. (the “Corporation”), which operates nursing home, healthcare, and housing facilities for the elderly in Sioux Falls, South Dakota and (c) pay certain costs of issuance of the 2026 Bonds and the refunding of certain indebtedness described below. Proceeds derived from the sale of the 2026 Bonds will be lent to the Corporation and will be used together with other available funds of the Corporation for the purposes described herein.
Prior Bonds to be Refunded and Projects Financed. The Series 2017 Bonds were issued (i) to fund an expansion and renovation of the Corporation’s existing campus (the “Series 2017 Project”), (ii) to fund capitalized interest with respect to the Series 2017 Bonds, (iii) to fund a deposit to the Debt Service Reserve Fund and (iv) to pay certain costs of issuance of the Series 2017 Bonds. The Series 2017 Project consisted generally of the following: Four cottage buildings containing 9 independent living units in the vicinity of the southwest corner of the intersection of Bailey Street and Covell Avenue were removed or demolished and a new two-story building with 30 assisted living units and 30 memory care units was built at that location. The new building was connected to the rest of the Corporation’s campus and memory care residents in the previously existing memory care units were moved to the new building and the existing memory care area and areas along the Main Street area of the campus were renovated and expanded. The renovation and expansion of the common areas included a gathering area outside the existing chapel, a theatre, spa, workshop, art and craft studio, coffee shop, a golf pro shop and other general upgrades.
The Series 2016 Bonds were issued (i) to refund on a current basis $23,100,000 in aggregate principal amount of the City’s Health Facilities Revenue Refunding Bonds (Dow Rummel Village Project), Series 2006 (the “Series 2006 Bonds”) representing the portion of the Series 2006 Bonds maturing after November 15, 2016 (such portion being referred to herein as the “Refunded 2006 Bonds”) and (ii) to pay certain costs of issuance of the Series 2016 Bonds and of refunding the Refunded 2006 Bonds. The Refunded 2006 Bonds were redeemed on November 26, 2016.
The Series 2006 Bonds were issued on December 28, 2006, for the purposes (a) of advance refunding certain Series 2002 revenue bonds of the City (collectively, the “Series 2002 Bonds”) which were issued by the City on November 26, 2002, and (b) of paying certain costs of issuance. Proceeds derived from the sale of the Series 2002 Bonds were lent to the Corporation and were used by the Corporation to finance a portion of the costs of (i) the construction of approximately 60 new independent senior living rental units, 35 new assisted living rental units, and 14 assisted living rental units for Alzheimer’s patients, (ii) the renovation of approximately 75 existing residential units owned and operated by the Corporation, and (iii) the construction of a Village Center, consisting of a wellness center with aquatic and fitness facilities, a new dining room, administrative offices, computer laboratories, examination rooms for use by visiting physicians, a main street museum, and various retail shops for the provision of services to residents (such as banking, gift shop, general store, beauty shop, and other services), as well as (iv) refinancing certain outstanding debt of the Corporation incurred in connection with the facilities described above (including the then-outstanding balance of City’s $600,000 Revenue Bonds, Series 1994 (Rummel Memorial Home, Inc. Issue) (the “Series 1994 Bonds”)), paying costs of issuing the Series 2002 Bonds, and establishing reserve funds.
The Series 1994 Bonds were issued by the City on September 20, 1994, for the purpose of financing certain capital improvements to the Corporation’s property, including an approximately 6,600 square-foot addition to the Corporation’s then-existing facilities.
The facilities financed or refinanced with proceeds of the Series 2016 Bonds and Series 2017 Bonds and the prior series of Bonds described herein are referred to collectively as the “Refinanced Projects.”
2026 Project to be Financed by 2026 Bonds. The 2026 Project being financed with proceeds of the Bonds is located on land owned by the Corporation (collectively, the “Campus”), the street address of which is 1321 W Dow Rummel Street, Sioux Falls, South Dakota, and on certain adjacent land, all of which is generally described as bounded on the North by Bailey Street, on the East by Covell Avenue, on the South by Madison Street, and on the West by West Avenue, all within the City of Sioux Falls, South Dakota. The 2026 Project is currently expected to consist generally of the following:
1. Replacement of roofs on numerous sections of the Campus;
2. Completion of various deferred maintenance projects on the Campus.
Ownership, Management and Operation. All of the 2026 Project facilities and the Refinanced Projects have been and will be owned, managed, and operated by the Corporation.
Other Details. Following the public hearing, the City Council of the City will consider the adoption of an ordinance approving the issuing of the Bonds in an aggregate principal amount not expected to exceed $55,000,000. The Bonds will be limited obligations of the City, payable solely from revenues and other properties of the Corporation pledged to the payment thereof. The Bonds will not be general or moral obligations of the City, and will not be secured by, or payable from, any assets, revenues, or other property of the City, and will not be secured by or payable from any revenues derived from any application of the taxing powers of the City.
This Notice is required by the Internal Revenue Code of 1986, as amended. At the time and place set for the public hearing, residents, taxpayers, and other interested persons will be given the opportunity to express their views, both orally and in writing, on the proposed Bonds and on the location and nature of the 2026 Project and Refinanced Projects. The City of Sioux Falls has adopted a Disadvantaged Business Enterprise Plan. This plan expresses the commitment of the City of Sioux Falls that disadvantaged business enterprises have the maximum opportunity to compete for and perform federally assisted contracts and subcontracts.

Bidders for this work will be required to comply with the President’s Executive Order No(s). 11518 and 11625 as amended. The requirements for bidders and contractors under these orders are explained in the specifications.
Bidders on this work will be required to comply with Title 40 CFR 33 and Executive Order 12138. The requirements for bidders and contractors under this regulation, which concerns utilization of Disadvantaged Business Enterprises (DBE), are explained in the specifications. The DBE goals for participation in this contract in terms of percentage of contract value are as follows: MBE 1.5 percent; WBE 2.4 percent.
Only firms certified at the time of the letting and included on the DBE Directory, will count toward DBE participation.
Davis-Bacon and Related Acts wages DO NOT apply to this project.
All bidders must be registered in the System for Award Management (SAM.gov), provide their Unique Entity Identifier (UEI), and have an active status.
Bidders must also certify that they are in compliance with all federal requirements applicable to the assistance received (including those imposed by the Infrastructure Investment and Jobs Act (“IIJA”), Public Law No. 117-58, which the bidder understands includes, but is not limited to, the following requirements: that all of the iron and steel, manufactured products, and construction materials used in the project are to be produced in the United States (“Build America, Buy America Requirements”). The low responsive bidder must assure compliance with the requirements of Public Law 115-232, Section 889, Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment. ORDINANCE NO. 36-26
AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AMENDING THE REVISED JOINT ZONING ORDINANCE FOR MINNEHAHA COUNTY AND THE CITY OF SIOUX FALLS BY AMENDING CHAPTER 159: COMPREHENSIVE EXTRATERRITORIAL ZONING REGULATIONS, SUBCHAPTER: GENERAL PROVISIONS.
BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That Section 159.466 of the Revised Joint Zoning Ordinance for Minnehaha County and the City of Sioux Falls is hereby amended to read:
§ 159.466 PERMITS REQUIRED.
(a) Building permit. A building permit shall be required for any and all work regulated by the International Building Code as adopted by the county. It shall be unlawful for any person, firm or corporation to perform such work without first obtaining a separate building permit for each building or structure change from the County Office of Planning and Zoning.
(b) Zoning permit. A zoning permit shall be required for any person, firm or corporation to change the use or occupancy of any building, structure, or property regulated by this ordinance or cause the same to be done without first obtaining a separate zoning permit for each use or occupancy change from the County Office of Planning and Zoning.
Section 2. That Subsection (c) of Section 159.467 of the Revised Joint Zoning Ordinance for Minnehaha County and the City of Sioux Falls is hereby amended to read:
§ 159.467 ENFORCEMENT AND ADMINISTRATION.
(c) An application for a permit shall be submitted in a form as the director may prescribe. The application shall be made by the owner or lessee, or agent of either, or the architect, engineer or builder employed in connection with the proposed work. If the application is made by a person other than the owner in fee, when required by the director, it shall be accompanied by a duly verified affidavit of the owner in fee, or the person making the application that the proposed work is authorized by the owner in fee and that the person making the application is authorized to make the application. Such shall contain the full names and addresses of the applicant and of the owner, and if the owner is a corporate body, of its responsible officers. The application shall describe briefly the proposed work and shall give additional information as may be required by the director for an intelligent understanding of the proposed work.
Section 3. That Section 159.468 of the Revised Joint Zoning Ordinance for Minnehaha County and the City of Sioux Falls is hereby amended to read:
§ 159.468 SITE PLAN.
Each application for a permit shall be accompanied by a site plan showing the actual dimensions of the lot to be built upon, the size, shape and location of any buildings to be erected, and other information as may be necessary to provide for the enforcement of these regulations. A record of applications and site plans shall be kept in the County Office of Planning and Zoning.
Section 4. That the Revised Joint Zoning Ordinance for Minnehaha County and the City of Sioux Falls is hereby amended by adding a section to be numbered 159.469 to read:
§ 159.469 ISSUANCE.
(a) Nothing in these regulations shall prohibit the filing of amendments to an application or to a plan or other record accompanying same, at any time before the completion of the work for which the permit was sought. The amendments, after approval, shall be filed with and be deemed a part of the original application.
(b) The director or authorized representative shall examine applications for permits within a reasonable time after filing. If, after examination, it appears that the proposed work will be in compliance with all applicable laws, the application shall be approved and a permit issued as soon as practicable. If the examination reveals otherwise, the application shall be rejected, with the findings attached to the application, and a copy delivered to the applicant.
(c) Nothing in these regulations shall be construed to prevent the director or authorized representative from issuing a building permit for the construction of footings before the entire plans and detailed statements of the building or structure have been submitted or approved, if adequate plans and detailed statements have been presented for the same and have been found to comply with the requirements.
(d) All work performed under a permit issued by the director or authorized representative shall conform to the approved application and plans, and approved amendments thereof. The location of all new construction as shown on the approved site plan, or an approved amendment thereof, shall be strictly adhered to. It shall be unlawful to reduce or diminish the area of a lot or tract of which a site plan has been filed and has been used as the basis for a permit, unless a revised site plan showing the proposed change in conditions shall have been filed and approved, provided that this shall not apply when the lot is reduced by reason of a street opening or widening or other public improvement.
(e) Every permit issued by the director under the provisions of these regulations shall have his or her signature affixed thereto; but this shall not prevent him or her from authorizing a subordinate to affix their signature.
(f) The director may, by written notice to the permittee, suspend or revoke a permit issued under the provisions of this ordinance whenever the permit is issued in error, issued on the basis of incorrect information supplied, or where a determination is made that the building, structure or portion thereof is in violation of this ordinance or other law. Any person aggrieved by an action of the director in suspending or revoking a permit under this subchapter may appeal such action to the Zoning Board of Adjustment. Such appeal shall be in writing and filed with the planning department within five working days of the decision.
Section 5. That Section 159.469 of the Revised Joint Zoning Ordinance for Minnehaha County and the City of Sioux Falls is hereby amended to read:
§ 159.470 VIOLATION AND PENALTY.
Violations shall be treated in the manner specified below.
(a) The owner or agent of a building or premises in or upon which a violation of any provision of these regulations has been committed or shall exist; or the lessee or tenant of an entire building or entire premises in or upon which violation has been committed or shall exist, or the agent, architect, building contractor or any other person who commits, takes part or assists in any violation or who maintains any building or premises in or upon which the violation shall exist, shall be guilty of a misdemeanor and shall be pursuant to SDCL 7-18A-2. Each and every day that such violation continues may constitute a separate offense.
(b) In case any building or structure is erected, constructed, reconstructed, altered, repaired, converted or maintained, or any building, structure or land is used in violation of these regulations, the appropriate authorities of Minnehaha County, in addition to other remedies, may institute injunction, mandamus or other appropriate action or proceeding to prevent the unlawful erection, construction, reconstruction, alteration, conversion, maintenance or use, or to correct or abate the violation, or to prevent the occupancy of the building, structure or land.

A zoning permit that has been approved shall expire by limitation and become null and void if the building, work or use authorized by such zoning permit is not commenced within two years from the date of approval.

§ 159.002 PURPOSE.
These regulations have been based upon the Sioux Falls, Comprehensive Plan adopted by the board of county commissioners and city council on May 26, 2026, and are in conformance with SDCL chapters 11-2, 11-4 and 11-6. These regulations shall establish a common working relationship between the city and Minnehaha County to carry out the goals and objectives of the plan as adopted by the city and county, but especially to lessen congestion in the streets; to secure safety from fire, panic and other dangers; to promote health and the general welfare; to provide adequate light and air; to prevent the overcrowding of land; to avoid undue concentration or scattering of population; and to encourage a distribution of population or mode of land utilization that will facilitate the economical and adequate provisions of transportation, roads, water supply, drainage, sanitation, education, recreation or other public requirements. The regulations are intended to preserve and protect existing property uses and values against adverse or unharmonious adjacent uses by zoning land outside the corporate boundaries of the city but not to exceed three miles from the city limits.

WEED ORDINANCE ENFORCEMENT
The City of Baltic would like to remind all residents and property owners of the City’s Weed Ordinances.
Pursuant to § 93.56 Public Nuisance, any and all noxious or unhealthy weeds or vegetation, and any unsightly weeds, grasses, or vegetation not accepted by the City, are declared to be a public nuisance.
Property owners and occupants are responsible for maintaining their properties and keeping weeds and overgrown vegetation under control.
Failure to comply with the ordinance may result in enforcement action under § 93.99 Penalty, including fines ranging from $40 to $500 per violation. Each separate violation shall constitute a separate offense.
Residents are encouraged to inspect and maintain their properties to help keep the community clean, safe, and attractive.

A RESOLUTION TO ABATE ANY PUBLIC NUISANCE
REMAINING ON TRACT 3 RAILWAY ADDN TO CITY OF BALTIC
WHEREAS, the City provided written notice to abate via certified mail January 20, 2026, to Randy and Debbie Murphy, property owners of PARCEL # 20341, TRACT 3 RAILWAY ADDN TO CITY OF BALTIC, Baltic, SD, certain property conditions constituting public nuisances and violating Sections 92.04(A)(1-3) and 92.41 of the Code; and
WHEREAS, said notice specified a deadline of ten days to appeal said notice and thirty (30) days to remedy said property conditions; and
WHEREAS, more than thirty (30) days have passed, and the public nuisance remains unabated.
NOW THEREFORE be it resolved by the City Council of the City of Baltic, South Dakota, as follows:
1. City Abatement. That the City Council directs the Maintenance Superintendent to abate, or cause to be abated, the property conditions constituting public nuisance as specified in the written notice to property owners.
2. Cost of Abatement. That any costs of abatement incurred by the city to abate said nuisances, the Municipal Finance Officer shall bill the property owners the same, and the property owners shall have 30 days to pay the same, but if the bill is not paid within 30 days, the City may charge interest thereon at the maximum legal rate.

The guidelines are subject to any provision established by a South Dakota state court in the following: a temporary or permanent protection order, an order arising out of an abuse or neglect proceeding, a bond condition arising out of a criminal case, and an order in any other proceeding affecting child custody or support.
The attached guidelines apply and shall continue in effect unless the parties agree or the court otheiwise orders. Imposition of these standard guidelines creates no presumption as to who may be awarded custody at any hearing. An agreement by the parties for visitation other than the standard guidelines must be in writing, signed by both parties, and filed with the court. The agreed plan shall be approved by court order and replace the standard guidelines, or any plan previously filed.
If either party object to the implementation of the South Dakota Parenting Guidelines (Form UJS-302) as the initial custody arrangement, the objecting party shall file an objection with the Clerk of Court. The court shall order a hearing which shall be held not later than 30 days after the date of objection. The court shall then issue its temporary custody and visitation order after considering the best interest of the child(ren) consistent with the provisions of SDCL § 25-4-45.
