South Dakota state lawmaker faces warrant for alleged highway damage

Recently reelected District 28B Rep. Travis Ismay of Newell is facing an arrest warrant for alleged intentional damage to a highway — which is a felony.
According to a Butte County Grand Jury indictment, Ismay violated South Dakota Law 31-32-1, which makes it illegal to “intentionally dig up, remove, displace, break, or otherwise injure or destroy any public highway or bridge, or any private way laid out by authority of law.”
The Class 6 felony includes up to a two-year prison term and/or a fine of up to $4,000.
Court documents indicate the arrest warrant was issued Tuesday, but it was not immediately clear whether Ismay had been arrested.
So far, Ismay has declined comment.
Ismay won the District 28B house seat June 2 with 55 percent of the vote. He beat Larry Schmoltz in the race.
