NOTICE OF PUBLIC HEARING
WITH RESPECT TO A SENIOR LIVING AND HEALTH FACILITY PROJECT AND
THE ISSUANCE OF BONDS UNDER SOUTH DAKOTA CODIFIED LAWS CHAPTER 9-54, AS AMENDED
NOTICE IS HEREBY GIVEN that the City Council of the City of Sioux Falls, South Dakota (the “City”) will meet on June 16, 2026, at 7 p.m. at Carnegie Town Hall, 235 W Tenth Street, Sioux Falls, South Dakota, for the purpose of conducting a public hearing on the proposal to issue revenue bonds in a principal amount not to exceed $55,000,000 (the “2026 Bonds”), pursuant to South Dakota Codified Laws, Chapter 9-54, as amended (the “Act”), in order to (a) refund on a current basis the City’s outstanding Health Facilities Revenue Refunding Bonds (Dow Rummel Village Project), Series 2016 issued in the original principal amount of $22,760,000 (“Series 2016 Bonds”) and outstanding Health Facilities Revenue Bonds (Dow Rummel Village Project), Series 2017 issued in the original principal amount of $29,140,000 (“Series 2017 Bonds”), (b) finance certain capital improvements (the “2026 Project”) to be undertaken by Dow Rummel Village, a South Dakota nonprofit corporation formerly known as Rummel Memorial Home, Inc. (the “Corporation”), which operates nursing home, healthcare, and housing facilities for the elderly in Sioux Falls, South Dakota and (c) pay certain costs of issuance of the 2026 Bonds and the refunding of certain indebtedness described below. Proceeds derived from the sale of the 2026 Bonds will be lent to the Corporation and will be used together with other available funds of the Corporation for the purposes described herein.
Prior Bonds to be Refunded and Projects Financed. The Series 2017 Bonds were issued (i) to fund an expansion and renovation of the Corporation’s existing campus (the “Series 2017 Project”), (ii) to fund capitalized interest with respect to the Series 2017 Bonds, (iii) to fund a deposit to the Debt Service Reserve Fund and (iv) to pay certain costs of issuance of the Series 2017 Bonds. The Series 2017 Project consisted generally of the following: Four cottage buildings containing 9 independent living units in the vicinity of the southwest corner of the intersection of Bailey Street and Covell Avenue were removed or demolished and a new two-story building with 30 assisted living units and 30 memory care units was built at that location. The new building was connected to the rest of the Corporation’s campus and memory care residents in the previously existing memory care units were moved to the new building and the existing memory care area and areas along the Main Street area of the campus were renovated and expanded. The renovation and expansion of the common areas included a gathering area outside the existing chapel, a theatre, spa, workshop, art and craft studio, coffee shop, a golf pro shop and other general upgrades.
The Series 2016 Bonds were issued (i) to refund on a current basis $23,100,000 in aggregate principal amount of the City’s Health Facilities Revenue Refunding Bonds (Dow Rummel Village Project), Series 2006 (the “Series 2006 Bonds”) representing the portion of the Series 2006 Bonds maturing after November 15, 2016 (such portion being referred to herein as the “Refunded 2006 Bonds”) and (ii) to pay certain costs of issuance of the Series 2016 Bonds and of refunding the Refunded 2006 Bonds. The Refunded 2006 Bonds were redeemed on November 26, 2016.
The Series 2006 Bonds were issued on December 28, 2006, for the purposes (a) of advance refunding certain Series 2002 revenue bonds of the City (collectively, the “Series 2002 Bonds”) which were issued by the City on November 26, 2002, and (b) of paying certain costs of issuance. Proceeds derived from the sale of the Series 2002 Bonds were lent to the Corporation and were used by the Corporation to finance a portion of the costs of (i) the construction of approximately 60 new independent senior living rental units, 35 new assisted living rental units, and 14 assisted living rental units for Alzheimer’s patients, (ii) the renovation of approximately 75 existing residential units owned and operated by the Corporation, and (iii) the construction of a Village Center, consisting of a wellness center with aquatic and fitness facilities, a new dining room, administrative offices, computer laboratories, examination rooms for use by visiting physicians, a main street museum, and various retail shops for the provision of services to residents (such as banking, gift shop, general store, beauty shop, and other services), as well as (iv) refinancing certain outstanding debt of the Corporation incurred in connection with the facilities described above (including the then-outstanding balance of City’s $600,000 Revenue Bonds, Series 1994 (Rummel Memorial Home, Inc. Issue) (the “Series 1994 Bonds”)), paying costs of issuing the Series 2002 Bonds, and establishing reserve funds.
The Series 1994 Bonds were issued by the City on September 20, 1994, for the purpose of financing certain capital improvements to the Corporation’s property, including an approximately 6,600 square-foot addition to the Corporation’s then-existing facilities.
The facilities financed or refinanced with proceeds of the Series 2016 Bonds and Series 2017 Bonds and the prior series of Bonds described herein are referred to collectively as the “Refinanced Projects.”
2026 Project to be Financed by 2026 Bonds. The 2026 Project being financed with proceeds of the Bonds is located on land owned by the Corporation (collectively, the “Campus”), the street address of which is 1321 W Dow Rummel Street, Sioux Falls, South Dakota, and on certain adjacent land, all of which is generally described as bounded on the North by Bailey Street, on the East by Covell Avenue, on the South by Madison Street, and on the West by West Avenue, all within the City of Sioux Falls, South Dakota. The 2026 Project is currently expected to consist generally of the following:
1. Replacement of roofs on numerous sections of the Campus;
2. Completion of various deferred maintenance projects on the Campus.
Ownership, Management and Operation. All of the 2026 Project facilities and the Refinanced Projects have been and will be owned, managed, and operated by the Corporation.
Other Details. Following the public hearing, the City Council of the City will consider the adoption of an ordinance approving the issuing of the Bonds in an aggregate principal amount not expected to exceed $55,000,000. The Bonds will be limited obligations of the City, payable solely from revenues and other properties of the Corporation pledged to the payment thereof. The Bonds will not be general or moral obligations of the City, and will not be secured by, or payable from, any assets, revenues, or other property of the City, and will not be secured by or payable from any revenues derived from any application of the taxing powers of the City.
This Notice is required by the Internal Revenue Code of 1986, as amended. At the time and place set for the public hearing, residents, taxpayers, and other interested persons will be given the opportunity to express their views, both orally and in writing, on the proposed Bonds and on the location and nature of the 2026 Project and Refinanced Projects. ORDINANCE NO. 46-26
AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, APPROVING OFFER TO PURCHASE REAL ESTATE FROM CITY.
WHEREAS, the City owns the following real property:
Lot 5, excluding the South 208.71’ of the East 208.71’ thereof, and the East 144’ of Lot 4, together with the S1/2 of vacated 84th Street abutting the North line thereof, of Supreme Acres in the S1/2 of Government Lots 1 & 2 of the SW1/4 of Section 18 T100N-R50W of the 5th P.M., Lincoln County, South Dakota, except Lot H1 contained therein,
hereinafter referred to as the “Property”;
WHEREAS, the City desires to sell the above-mentioned Property, as described in the attached Offer to Purchase Real Estate from City;
BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
Section 1. Notwithstanding the provisions of SDCL Chapter 6-13, and pursuant to Section 2.12(7) of the City Charter, the City hereby declares the following property to be surplus property that is no longer necessary, useful, or suitable for the purpose for which it was acquired:
Lot 5, excluding the South 208.71’ of the East 208.71’ thereof, and the East 144’ of Lot 4, together with the S1/2 of vacated 84th Street abutting the North line thereof, of Supreme Acres in the S1/2 of Government Lots 1 & 2 of the SW1/4 of Section 18 T100N-R50W of the 5th P.M., Lincoln County, South Dakota, except Lot H1 contained therein,
hereinafter referred to as the “Property.”
Section 2. That it authorizes the sale of the Property and approves the document titled, “Offer to Purchase Real Estate from City.” That said agreement is attached hereto and made part of this ordinance as if set out in full.
Section 3. That the Mayor is authorized to sign on behalf of the City the Offer to Purchase Real Estate from City, and any and all documents necessary to make the transfer and conveyance of the Property, to RMB85, LLC, a South Dakota limited liability company, pursuant to and subject to all other conditions and terms and as set forth in the Offer to Purchase Real Estate from City.
Section 4. That RMB85, LLC, shall pay to the City of Sioux Falls, one hundred thirty-three thousand, five hundred fifty-seven and 28/100 dollars ($133,557.28) (the “Purchase Price”) for the Property.
Section 5. An appraisal of the Property was prepared by Elwood and Martin Appraisals, LLC, by Scott Elwood, MAI, a person licensed by the state to do fee appraisals, with an as of date of December 5, 2025, which is recognized as the appraisal for the Property, hereby made a part of this ordinance by reference and on file with the City’s Finance Department.
Section 6. The above-referenced appraisal concluded the rounded “as-is” market value of the fee simple estate of the Property, is one hundred twenty-five thousand dollars ($125,000.00).
Section 7. All revenue from the sale of the property shall be credited to the Right-of-Way Acquisition and Restoration Project (CIP # 11009) of the City.
Section 8. That the City shall publish this ordinance, without attachments, after its passage. The attachments are on file and available for inspection in the office of the City Clerk.

On Tuesday, the 2nd day of June 2026, a City of Sioux Falls Municipal Election was held. The purpose of the election was to elect one Mayor and four Council Members for the City of Sioux Falls, SD, and to vote on five amendments to the City Charter.
The City Council of the City of Sioux Falls met as the Canvassing Board pursuant to law on Tuesday, June 9, 2026, at the Carnegie Town Hall, 235 West 10th Street, Sioux Falls, SD, at 6 p.m., to canvass the votes cast for City offices and questions at said Municipal Election.

DeeAnn Konrad, Community Relations Coordinator, introduced Steve Hilldebrandt who donated a check of $1,015,000.00 from Promising Futures to expand the College and Career Access Program to all four high schools. Steve discussed how the pilot program at Jefferson High School was able to assist seniors with completing the Free Application for Federal Student Aid (FASFA), college applications, job shadows, scholarships, military interest, and technical career activities. Whittier Middle School student, Nayeli Frias, performed her original 8th Grade Poetry Slam piece.

Daniel Conrad, Assistant Superintendent, presented the College and Career Access Update report as follows (MRF #19983):
The future is more certain for 220 recent high school graduates thanks to a collaboration between the Sioux Falls School District and the Promising Futures Fund. A pilot program during the 2025–26 school year called “College and Career Access” set out to increase post-secondary opportunities for students at Jefferson High School, particularly those from low-income households. Through a $400,000 investment, the program provided dedicated advisors to help students and families navigate college applications, financial aid, scholarships, career exploration, military pathways, and workforce preparation.
During the pilot year, advisors met with seniors and supported students through Free Application for Federal Student Aid (FAFSA) completion, college applications, job shadows, scholarships, and career readiness activities. The program’s success demonstrated the value of personalized student support and resulted in the development of a guidebook to expand the program districtwide.
The program’s early success and an incredible investment of $1,015,000 by Promising Futures Donors means the program can expand to all four Sioux Falls public high schools in 2026-27. Twelve college and career access advisors will continue focusing on reducing equity gaps and ensuring all students have access to college, technical education, military, and workforce opportunities after graduation.

Daniel Conrad, Assistant Superintendent, presented the Sioux Falls School District Facilities Task Force Update report as follows (MRF #19984):
A 30-person task force, composed of a diverse cross-section of parents and community advocates and led by a facilitator of the Donovan Group, met four times to prioritize current and future facility needs as the Sioux Falls School District considers a possible bond referendum in the spring of 2027.
The School Board’s “charge” to the task force was to review city growth, school enrollment projections, and capital improvement needs, and to prioritize/rank 38 identified projects in order of need. Members toured Whittier, Ben Reifel, and Edison Middle Schools to better understand the scope and urgency of proposed projects. Through presentations, photos of school spaces, discussions, the tours, and collaborative evaluation exercises, members developed a deeper understanding of both the opportunities and challenges facing District facilities.
At the conclusion, members determined replacing Whittier Middle School and constructing a future elementary school on the west side of Sioux Falls should be the highest priorities for a future bond initiative. Additional priority projects include improvements in the areas of fine and performing arts at Edison and Patrick
Henry Middle Schools, drop-off lanes at several elementary schools, and District-wide security upgrades.
Throughout the process, Task Force members emphasized the importance of maintaining safe, functional, and future-ready learning environments while remaining fiscally responsible to taxpayers.
The next step includes the launch of a public survey and community listening sessions when additional feedback will be collected and considered. The task force will reconvene later in 2026 to make final recommendations to the School Board, at which time the Board will consider the possibility of asking taxpayers to approve a bond in April 2027.

Plan of Intent: Any district employing teachers who are non-certified or are serving outside of their current certification shall have on file with the Department of Education a plan of intent stating how the district intends to ensure that all teachers are serving on a valid certificate in their certified areas. The Minnehaha County Commission convened at 9:00 AM on June 8, 2026, as the Primary Election Canvassing Board. Board Members present were: Commissioner Beninga, Alex Jensen (representing Commissioner Karsky), Jeff Barth (representing Commissioner Bleyenberg), Jim Stalzer (representing Commissioner Heisey), and Curt Soehl (representing Commissioner Kippley). Call to Order
The Minnehaha County Commission convened at 9:00 AM on June 9, 2026, pursuant to adjournment on June 8, 2026. Commissioners present were: Beninga, Bleyenberg, Heisey, Karsky, and Kippley. Also present were Kym Christiansen, Commission Recorder, and Eric Bogue, Chief Civil Deputy State’s Attorney.

Resolution for Correction of DPNO 27432

A RESOLUTION FOR LIEN DPNO 27432 CORRECTION
WHEREAS, a County Lien exists in favor of Minnehaha County against two individuals identified in DPNO 27432 in the amount of $2,425.88 and an additional County Lien against DPNO 24216 which involves one of the two individuals identified in DPNO 27432; and,
WHEREAS, upon review, the Minnehaha County Auditor has determined that one lien entry in DPNO 27432 identified as R-File 416569 in the amount of $1,432.12 is incorrect and should be released as to both lienees; and,
WHEREAS, upon review, the Minnehaha County Auditor has determined that the remaining two lien entries in DPNO 27432 identified as R-File 120571 in the amount of $964.36 and R-File 310815 in the amount of $29.40 are the responsibility of only one named lienee in DPNO 27432 and not the responsibility of the lienee in DPNO 24216, and, therefore the lien should be corrected to reflect the lien in DPNO 27432 as the sole responsibility of such remaining lienee in DPNO 27432 and removing from DPNO 27432 the name of the lienee identified in DPNO 24216;
NOW THEREFORE, BE IT RESOLVED that after due consideration of the above circumstances, the Board of County Commissioners finds it advisable and proper to authorize the Chair of the Board of Commissioners to execute and the County Auditor to attest the following:
Pursuant to SDCL § 23A-40-16, the Minnehaha County Board of Commissioners directs that corrections be made to the lien in DPNO 27432 by releasing the lien entry identified as R-File 416569 as to both lienees, and correcting R-File 120571 and R-File 310815 to reflect that such entries are the sole responsibility of the remaining lienee in DPNO 27432 and removing from DPNO 27432 the name of the lienee identified in 24216, resulting in a revised total County Lien in favor of Minnehaha County and against DPNO 27432 in the amount of $993.76.

Special Liquor License Public Hearing
Kym Christiansen, Commission Recorder, was present for the public hearing to consider a Special Event On-Sale Liquor License for DH Ventures doing business as Tailgators at Huset’s Speedway, located at 2012 S Splitrock Blvd, Brandon, SD. Huset’s Speedway will be hosting various racing event between June and September. The special event license would allow Tailgators to sell liquor to be consumed onsite during the events. The applications were provided to Sheriff’s Office, State’s Attorney’s Office, and Planning Department for review and there were no objections or concerns reported.
Chair Karsky asked for the proponents and opponents to speak on the topic. There were no proponents or opponents to speak on the topic.

Briefing on the Development of a Comprehensive Strategic Plan to Address Homelessness
Kari Benz, Director of Human Services, and Sharon Chrontos, Co-owner Northstar Solutions, LLC, provided a briefing on the development of a Comprehensive Strategic Plan to Address Homelessness. Discussion followed on the goals and deliverables of the plan, sequential intercept map, goals and action plan template, benefits, backbone organization and structure, and timeline. Public comment was received from George Hahn.
Sioux Empire Fair Association Presentation
Scott Wick, Sioux Empire Fair Association President & CEO, provided the Sioux Empire Fair Association Presentation. Discussion followed on the appreciation of the Commissioners, commitment to having a safe and enjoyable experience, looking ahead with goals moving forward, and improvement priorities as the strengthening of the community asset.
Renewal Contract with the Second Circuit Unified Judicial System for Treatment/Specialty Court Indigent Defense Services
Upon the request of Traci Smith, Public Defender, MOTION by Kippley, seconded by Heisey, to Authorize the Public Defender to Sign the FY 2026-27 Agreement for Consultant Services Renewal Contract with the Second Circuit Unified Judicial System for Treatment/Specialty Court Indigent Defense Services in the Amount of $58,604.00. By roll call vote: 5 ayes.
Jail Food Service Agreement Amendment
Upon the request of Mike Mattson, Warden, MOTION by Beninga, seconded by Bleyenberg, to Authorize the Chair to Sign Amendment #5 to the Food Service and Commissary Agreement with Summit Food Service, LLC for a Term of July 1, 2026, to June 30, 2027. 5 ayes.

RESOLUTION MC 26-20
A RESOLUTION AUTHORIZING THE COMMENCEMENT OF A CIVIL ACTION SEEKING DETERMINATION FROM THE SECRETARY OF THE DEPARTMENT OF TRANSPORTATION PURSUANT TO 31-17-17.
WHEREAS, Minnehaha County Highway 140 includes a roadway segment located on the municipal boundary between Minnehaha County and the City of Brandon, described as follows: Minnehaha County Highway Minnehaha County Highway 140 from the boundary line between Section 32 and 33, through said Section 33, to the boundary line between Section 33 and Section 34, Township 102 North, Range 48 West of the 5th P.M., Minnehaha County, South Dakota, including Structure No. 50-266-175; and,
WHEREAS, portions of the land adjacent to and served by this roadway segment are located within the incorporated limits of the City of Brandon, and the roadway functions as a municipal street serving local and intra-city traffic for residents, businesses, and properties within the City of Brandon; and,
WHEREAS, the assignment of the jurisdictional responsibility over such roadway to the appropriate municipal authority promotes efficient public administration, reduces jurisdictional ambiguity, and serves the interests of public safety and welfare; and,
WHEREAS, Minnehaha County and the City of Brandon have engaged in discussions regarding the jurisdictional assignment and maintenance responsibility for this roadway segment but have been unable to reach agreement; and,
WHEREAS, SDCL 31-17-17 provides that in the event affected governing bodies are unable to reach agreement regarding the assignment of responsibility for a boundary highway, the Secretary of Transportation shall determine such assignment; and,
WHEREAS, Minnehaha County desires that jurisdictional responsibility for this roadway segment be formally assigned to the City of Brandon in accordance with state law to ensure clarity of authority, maintenance responsibility, and public administration.
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Minnehaha County, South Dakota that the assignment of this roadway segment to the City of Brandon would be consistent with sound public policy, orderly governmental administration, and the functional municipal character of the roadway.
NOW THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Minnehaha County, South Dakota that the Minnehaha County Highway Superintendent is hereby authorized and directed to submit this Resolution and any supporting documentation to the South Dakota Department of Transportation and to take such further action as may be necessary to facilitate the Secretary’s determination.

Disadvantaged Business Enterprise. The requirements of 49 CFR Part 26 including any amendments thereto apply to this contract. In accordance with the amendment dated October 3, 2025, no DBE goals have been established for this contract. However, the contract clauses in 49 CFR §§ 23.9, 26.13(a-b), and 26.29 still apply to this contract. It is the policy of the Sioux Falls Regional Airport to practice nondiscrimination based on race, color, sex, or national origin in the award or performance of this contract. The Owner encourages participation by all firms qualifying under this solicitation regardless of business size or ownership
Federal Fair Labor Standards Act. All contracts and subcontracts that result from this solicitation incorporate by reference the provisions of 29 CFR part 201, et seq, the Federal Fair Labor Standards Act (FLSA), with the same force and effect as if given in full text. The FLSA sets minimum wage, overtime pay, recordkeeping, and child labor standards for full and part-time workers.
The Contractor has full responsibility to monitor compliance to the referenced statute or regulation. The Contractor must address any claims or disputes that arise from this requirement directly with the U.S. Department of Labor – Wage and Hour Division.
Trade Restriction Certification. By submission of an offer, the Offeror certifies that with respect to this solicitation and any resultant contract, the Offeror -
is not owned or controlled by one or more citizens of a foreign country included in the list of countries that discriminate against U.S. firms as published by the Office of the United States Trade Representative (U.S.T.R.);
has not knowingly entered into any contract or subcontract for this project with a person that is a citizen or national of a foreign country included on the list of countries that discriminate against U.S. firms as published by the USTR; and
has not entered into any subcontract for any product to be used on the Federal project that is produced in a foreign country included on the list of countries that discriminate against U.S. firms published by the USTR.
This certification concerns a matter within the jurisdiction of an agency of the United States of America and the making of a false, fictitious, or fraudulent certification may render the maker subject to prosecution under Title 18 USC § 1001.
The Offeror/Contractor must provide immediate written notice to the Owner if the Offeror/Contractor learns that its certification or that of a subcontractor was erroneous when submitted or has become erroneous by reason of changed circumstances. The Contractor must require subcontractors provide immediate written notice to the Contractor if at any time it learns that its certification was erroneous by reason of changed circumstances.
Unless the restrictions of this clause are waived by the Secretary of Transportation in accordance with 49 CFR § 30.17, no contract shall be awarded to an Offeror or subcontractor:
who is owned or controlled by one or more citizens or nationals of a foreign country included on the list of countries that discriminate against U.S. firms published by the U.S.T.R. or
whose subcontractors are owned or controlled by one or more citizens or nationals of a foreign country on such U.S.T.R. list; or
who incorporates in the public works project any product of a foreign country on such U.S.T.R. list.
Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by this provision. The knowledge and information of a contractor is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
The Offeror agrees that, if awarded a contract resulting from this solicitation, it will incorporate this provision for certification without modification in all lower tier subcontracts. The Contractor may rely on the certification of a prospective subcontractor that it is not a firm from a foreign country included on the list of countries that discriminate against U.S. firms as published by USTR, unless the Offeror has knowledge that the certification is erroneous.
This certification is a material representation of fact upon which reliance was placed when making an award. If it is later determined that the Contractor or subcontractor knowingly rendered an erroneous certification, the Federal Aviation Administration (FAA) may direct through the Owner cancellation of the contract or subcontract for default at no cost to the Owner or the FAA.
Civil Rights - Title VI Assurances. It appearing that Plaintiff maintains the Complaint against Defendants, BKW Transportation LLC being an Oklahoma limited liability company while Kenneth Dwain Knapp is the member thereof, and
It further appearing that in February 2023, Defendants entered into a certain contract with Plaintiff, while present in Minnehaha County, South Dakota and further expressly agreeing that this Court shall be the proper venue and have personal jurisdiction over said defendants in the event of any legal action arising out of the contract between Plaintiff and Defendants, and
It appearing further that after the contract was cancelled by Plaintiff in November 2023, based on damages to cargo and unresolved claims and credits as outlined in the Complaint, Defendant Knapp is no longer residing in Moore, Oklahoma, and his current location is unknown to Plaintiff, and for good cause, it is now
