Amend Capital Improvements Program Project No. 14001, Falls Park Development, by increasing the amount of funding for design and construction of amenities and remediation in the quarry area by $15,000,000 in 2026. The additional funding will require an increase in appropriations that will be funded by a grant from the Bezos Earth Fund.

RESOLUTION NO. 79-26
A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO A CONDITIONAL GIFTING AGREEMENT FOR THE REDEVELOPMENT OF A PORTION OF FALLS PARK.
WHEREAS, the Bezos Earth Fund (the “Fund”) was established to award grants to projects which restore and protect the natural world; and
WHEREAS, the Fund has entered into a grant agreement with the Sioux Falls Community Foundation (the “Foundation”) whereby the Fund will release funds to be administered by the Foundation for the purpose of redeveloping a portion of Falls Park; and
WHEREAS, the Foundation, on behalf of the Fund, desires to gift the City a future cash gift for the redevelopment of a portion of Falls Park; and
WHEREAS, on July 15, 2026, Sioux Falls Parks and Recreation Board considered the proposed Conditional Gifting Agreement for the Redevelopment of a Portion of Falls Park and recommended city council approval;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That the document attached to and made part of this resolution entitled “A Conditional Gifting Agreement for the Redevelopment of a Portion of Falls Park” is hereby approved.
Section 2. That the Mayor is authorized to sign the Conditional Gifting Agreement for the Redevelopment of a Portion of Falls Park after it is ratified and executed by the Foundation.
Section 3. That the City shall publish this resolution, without attachments, after its passage. The attachments are on file and available for inspection in the office of the City Clerk.

WAIVER REQUESTS FOR EXEMPTION FROM ADMINISTRATIVE RULES
Notice is hereby given that the School Board of the Sioux Falls School District 49-5 will conduct a public hearing on the exemption requests for following Administrative Rules:

This waiver will allow a teacher an additional year to complete the requirements of Alternative Certification and the Plan of Intent.
Administrative Rules 24:28:14:02 (1) & (2) Special Education Alternative Certificate and General Requirements
This waiver will allow the District to hire individuals pursuing their Education degree and Special Education endorsement under plans approved by the South Dakota Department of Education.
Administrative Rule 24:28:23:02 Kindergarten through Grade Four Endorsements
The waiver will allow teachers within the elementary Spanish Immersion Program to add the Self-contained Kindergarten through Fourth Grade Endorsement to their South Dakota teaching permit after they have successfully completed both the pedagogy and content area state-designated Praxis exams.

SET WEIGHT LOAD LIMITS ON CERTAIN BRIDGES WITHIN MINNEHAHA COUNTY
WHEREAS, the Minnehaha County Highway Department performs regular bridge inspections to assess the condition of individual bridges and considers recommendations for improvements, and
WHEREAS, the Minnehaha County Highway Department performs bridge maintenance and bridge replacement projects in an effort to improve the overall condition of the bridge network, and
WHEREAS, the Minnehaha County Highway Superintendent has identified fourteen (14) bridges in Minnehaha County that are recommended for weight load limits, and
WHEREAS, SDCL 32-22-47 gives the county commission the authority to establish and identify through the proper signage the maximum weight of any vehicle, laden or unladen, which may enter upon or cross over the bridge, now
THEREFORE, BE IT RESOLVED by the Minnehaha County Board of Commissioners that all of the existing bridge weight load limits described in previous resolutions are hereby removed and superseded with the following gross vehicle weight load limits:
