A federal judge Friday denied a request from the League of Women Voters and a Sioux Falls voter to issue a preliminary injunction against the Secretary of State’s Office after the office agreed to fix an erroneous form letter to voters.
Despite assurances from Secretary of State Monae Johnson that she would not revert to using the old erroneous form letter, the League and voter Jaysen Hill pressed for the preliminary injunction. But Judge Eric Schulte concluded that he was satisfied the issue had been resolved.
“With only thirty-one days from the voter registration deadline for the upcoming election and forty-six days from the election, the secretary of state cannot, in this court’s judgment, reasonably be expected to backtrack and return to prior allegedly illegal conduct,” Schulte wrote.
