CLARIFICATION: An earlier version of this article did not clearly state that Senate Bill 61 would allow psycho-active CBD to be sold only at medical marijuana dispensaries licensed by the South Dakota Department of Health.

Attempts to regulate most CBD products out of vape shops and gas stations in South Dakota and outright ban another commonly sold drug have state lawmakers at odds and retailers complaining of government overreach.

The Senate Health and Human Services Committee could not reach consensus on a pair of bills Wednesday that would prohibit the commercial sales of hemp-derived THC products and kratom — the latter being banned outright under Senate Bill 77, while Senate Bill 61 would allow psycho-active CBD to continue to be sold only at medical marijuana dispensaries licensed by the South Dakota Department of Health.
