State Supreme Court finds officer unreasonable in stopping driver for failing to signal 100 feet before turn
An Aberdeen police officer who arrested a man for driving under the influence did not have a reasonable cause under state law to make the traffic stop that led to the arrest, the South Dakota Supreme Court ruled in an opinion released Thursday.
The unanimous decision reversed both a circuit court and magistrate court’s decisions not to suppress the evidence that led to the arrest of Nathan Hawley. The arrest, the High Court concluded, violated Hawley’s Fourth Amendment rights against unreasonable searches and seizures.
