Secretary of State's Office backs Auditor Leah Anderson on foreign-only ballots
Voters who use post office boxes on absentee ballot applications can't vote in state and local elections
Minnehaha County Auditor Leah Anderson said that her office is following state law by sending federal-only ballots to out-of-state residents who are registered to vote through mail forwarding services, a contention backed by the state’s elections director Wednesday.
Anderson cited state law that established a federal-only ballot for out-of-state voters and people who can’t provide documentation that they are U.S. citizens. That law was passed in 2025 and went into effect on Jan. 1. The June 2 primary is the first election in which some voters will only get to weigh in on federal races, of which there are two.
The law requires county auditors to designate new registrations as a federal-only voter when they register to vote, or when they apply to vote by absentee ballot. The federal-only status applies to voters who use the address of a commercial receiving agency, a mail forwarding service or a post office box that doesn’t include the location of the voter’s residence.
