S.D. High Court: McCook County violated law with variance for home already built
Neighbor dispute on Lake Vermillion found that home built in county setback
The McCook County Board of Adjustment didn’t follow state law when it granted a variance to a homeowner on Lake Vermillion after the home was already built, the South Dakota Supreme Court ruled Thursday.
The unanimous ruling reverses a circuit court judge, and the Court vacated the issuance of the variance by the county.
The issue involved a dispute between property owners Rob Dorale and Greg and Patricia DeCramer.
