A carbon sequestration pipeline company looking to build a transmission line through South Dakota is taking one of the three regulators set to decide its project’s fate to court.

Summit Carbon Solutions has filed a lawsuit in Hughes County against Public Utilities Commissioner Kristie Fiegen in hopes of keeping her from participating in permit application hearings related to its planned pipeline — slated to run through more than a dozen South Dakota counties.
