As South Dakotans weigh their choice for Congress, a fundamental question is whether Attorney General Marty Jackley has applied the law fairly and consistently or whether he has used the authority of his office to silence those who challenge the powerful in our state.

When Juliane Burgod, an Edmunds County farmer and vocal critic of the proposed Belle Dairy, was accused of having discrepancies involving her nominating petition and owner-occupied tax status, the Edmunds County State’s Attorney called Jackley’s office. DCI agents were then sent to investigate Burgod and even interviewed all nine people who signed her petition. Jackley later publicly confirmed the DCI review.
