MINNEHAHA COUNTY 5-YEAR TRANSPORTATION AND BRIDGE IMPROVEMENT PLAN

Notice is hereby given that a public meeting will be held at Minnehaha County Highway Department located at 2124 E 60th North, Sioux Falls, SD, between 5:00 and 6:00 pm on Monday, September 14, 2026. The purpose of the meeting is to review and solicit comments on the Minnehaha County 5-Year Transportation and Bridge Improvement Plan.

Meeting Assistance: Accommodations for the meeting will be provided for the meeting will be provided for persons with disabilities upon request. Please contact the Minnehaha County Highway Department at (605) 367-4316 (voice or TDD) 48 hours in advance of the meeting.

FACT OF ADOPTION

An ordinance amending Ordinance MC16-90, the 1990 Revised Zoning Ordinance for Minnehaha County.

The Minnehaha County Board of Commissioners adopted Ordinance 16-190-26 on August 25, 2026. This ordinance amended Ordinance MC16-90, the 1990 Revised Zoning Ordinance for Minnehaha County by rezoning the property legally described as: the East 1581.78 Feet of the South 567.87 Feet (Except H-1 and Except the South 873.44 Feet of the West 1058.22 Feet of the NE¼) of the NE¼ of Section 29 T102NR47W, Minnehaha County, SD from the A-1 Agricultural District to the C Commercial District and the official zoning map referred to in Article 2.03 is amended to include the properties in the C Commercial District.

The entire ordinance is on file in the office of the County Auditor and available for inspection during regular business hours.

Call to Order

The Minnehaha County Commission convened at 9:00 AM on September 1, 2026, pursuant to adjournment on August 25, 2025. Commissioners present were: Beninga, Bleyenberg, Heisey, Karsky, and Kippley. FY2027 Budget Hearing

Susan Beaman, Finance and Budget Officer, presented the Budget Hearing for the FY 2027 Minnehaha County Budget and adjustments to the Provisional Budget approved by the Commission on July 21, 2026. Since the provisional budget was approved, the Auditor’s Office has received adjustments to the General Fund. The property tax revenue changes related to centrally accessed utility values for the General Fund, Building Fund, Fire Protection Fund, and Library Fund will be incorporated into the presentation for the September 22 Commission meeting. Key budget numbers with these are that the budget stands with total appropriations of $147,040,375 with total cash applied of $13,054,196. General Fund cash applied is $10,344,994, which is a rate of 10.03%. The budget includes taxes levied at $84,342,819. Discussion followed on the FY 2027 Budget Adjustments from Provisional Budget and updated means of finance.

Federal Highway Administration Bridge Investment Program Grant Agreement for Fund Obligation 1 of 3

Upon the request of Jacob Maras, Highway Superintendent, MOTION by Beninga, seconded by Bleyenberg, to Authorize the Highway Department to Accept and Sign the Phase 1 Agreement of a 3 Phase Federal Bridge Investment Program Grant for a Phase 1 amount of $281,560.00 out of a Total Award of $3,133,863.00. THE LINCOLN COUNTY BOARD OF COMMISSIONERS convened at 7:00 p.m. on August 25, 2026, with Commissioners Joel Arends, Jim Schmidt, Tiffani Landeen, Doug Putnam, Herman Otten present. Alicia Cafaro, Deputy Auditor, served as Clerk of the Board. Chief Civil Deputy State’s Attorney, Drew DeGroot, was also present.

ROUTINE BUSINESS:

REGULAR BUSINESS:

PUBLIC HEARING was held as advertised for a resolution adopting the joint jurisdictional Lincoln County/City of Sioux Falls 2050 Comprehensive Plan. The purpose of this resolution is to adopt the Shape Sioux Falls 2050 Comprehensive Plan for the Lincoln County and City of Sioux Falls joint planning area. This would replace the Shape Sioux Falls 2040 plan. Fletcher Lacock, Senior Planner with the City of Sioux Falls, presented the plan and answered questions from the Commission and Council. No testimony was heard in favor or opposition.

MOTION by Joel Arends and seconded by Doug Putnam to adopt the resolution of the joint jurisdictional Lincoln County/City of Sioux Falls 2050 Comprehensive Plan with the following amendments; Amendment 1: Upon passage of the Resolution adopting the Shape Sioux Falls 2050 Comprehensive plan for the joint zoning and platting jurisdictional area, a hearing on a moratorium to be imposed on hyper scale data centers shall be scheduled to take place on the last Tuesday of September at 7:00 p.m., and Amendment 2: The parties to this joint jurisdictional agreement may not enter into an agreement with a non-governmental entity, private person, or public-private business concerning any application made under the joint zoning and platting jurisdiction area which requires confidentiality or nondisclosure. An agreement under this section is a public record as defined in § 1-27-1.1. Ayes; Joel Arends, Doug Putnam, Nays; Jim Schmidt, Tiffani Landeen, Herman Otten. Motion Failed.

MOTION by Jim Schmidt and seconded by Herman Otten to adopt the resolution of the joint jurisdictional Lincoln County/City of Sioux Falls 2050 Comprehensive Plan.

MOTION by Joel Arends and seconded by Doug Putnam to add the following amendment to the resolution; the City of Sioux Falls City Council and the Lincoln County Commission will hold a joint meeting and public hearing at 7 p.m. on Tuesday, October 27, 2026 to discuss a moratorium on data centers. Ayes; Joel Arends, Doug Putnam, Jim Schmidt, Herman Otten. Nays; Tiffani Landeen. Motion Passed.

MOTION by Jim Schmidt and seconded by Herman Otten to adopt the following resolution (2026-11) for the joint jurisdictional Lincoln County/City of Sioux Falls 2050 Comprehensive Plan with the approved amendment; A RESOLUTION ADOPTING THE JOINT JURISDICTIONAL LINCOLN COUNTY/CITY OF SIOUX FALLS 2050 COMPREHENSIVE PLAN. WHEREAS, the Joint Lincoln County and City of Sioux Falls Planning Commissions have proposed a plan for the physical development of the joint jurisdictional area; and WHEREAS, the Joint Lincoln County and City of Sioux Falls Planning Commissions held a public hearing on March 17, 2026, to gain input from the public; and WHEREAS, the Joint Lincoln County Board of Commissioners and Sioux Falls City Council held a public hearing on August 25, 2026, to gain input from the public; and WHEREAS, the comprehensive plan shows the Joint Lincoln County and City of Sioux Falls Planning Commission’s recommendations to guide and accomplish a coordinated, adjusted, and harmonious development of the joint planning jurisdictional area, which will, in accordance with existing and future needs, best promote health, safety, morals, order, convenience, prosperity and the general welfare, as well as efficiency and economy in the process of development. NOW, THEREFORE, BE IT RESOLVED BY THE JOINT CITY OF SIOUX FALLS AND LINCOLN COUNTY GOVERNING BODIES, SD: That the amended Shape Sioux Falls 2040 Plan known as the Shape Sioux Falls 2050 Comprehensive Plan attached is hereby adopted along with the accompanying maps and descriptive matter, for the Joint City of Sioux Falls and Lincoln County planning area, with said plan to supersede the Shape Sioux Falls 2040 Comprehensive Plan. The plan shall be on file and is available for public inspection by any interested person in the office of the City Clerk, the office of the County Auditor, the City Planning Office, the Lincoln County Planning Office, and the City’s website. SECOND READING & PUBLIC HEARING was held as advertised for an ordinance imposing a county gross receipts tax and use tax for Lincoln County, South Dakota. Michael Houdyshell, Secretary of the South Dakota Department of Revenue, was present via Zoom to present info and answer questions from the Commission. No testimony was heard in favor or opposition.

MOTION by Jim Schmidt and seconded by Herman Otten to approve an ordinance (2026-12) imposing a county gross receipts tax and use tax for Lincoln County, South Dakota as follows; BE IT ORDAINED BY LINCOLN COUNTY, SOUTH DAKOTA. Section 1. PURPOSE. The purpose of this ordinance is to provide additional necessary revenue for Lincoln County, South Dakota, by imposing county gross receipts tax pursuant to the powers granted to the County by the State of South Dakota, by SDCL § 10-25B-1 et seq. entitled Uniform County Non-Ad Valorem Tax Law, and acts amendatory thereto. The purpose of the county gross receipts tax is to provide property tax relief on the Lincoln County property tax levy for all property classified as owner-occupied. All monies collected by the County from the gross receipts tax must be deposited into a property tax reduction fund, which is hereby created. Section 2. EFFECTIVE DATE AND ENACTMENT OF TAX. From and after the first day of January, 2027, there is hereby imposed as a county gross receipts tax upon the privilege of engaging in business a tax measured by one-half percent (0.5%) on the gross receipts of all persons engaged in business within the jurisdiction of Lincoln County, South Dakota, who are subject to the South Dakota Retail Occupational Sales and Service Tax, SDCL Ch. 10-45 and acts amendatory thereto. Section 3. USE TAX. In addition there is hereby imposed an gross receipts tax on the privilege of use, storage, and consumption within the jurisdiction of Lincoln County, South Dakota, of items purchased from and after the first day of January, 2027, at the same rate as the county gross receipt tax upon all transactions or use, storage, and consumption which are subject to the South Dakota Use Tax, SDCL Ch. 10-46, and acts amendatory thereto. Section 4. COLLECTION. Such tax is levied pursuant to authorization granted by SDCL Ch. 10-52B, and acts amendatory thereto, and shall be collected by the South Dakota Department of Revenue in accordance with the same rules and regulations applicable to the State Sales Tax and under such additional rules and regulations as the Secretary of Revenue of the State of South Dakota shall lawfully prescribe. Section 5. INTERPRETATION. It is declared to be the intention of this ordinance and the taxes levied hereunder that the same shall be interpreted and construed in the same manner as all sections of the South Dakota Retail Occupational Sales and Service Tax, SDCL Ch. 10 45 and acts amendatory thereto and the South Dakota Use Tax, SDCL Ch. 10-46 and acts amendatory hereto, and that this shall be considered a similar tax except for the rate thereof to that tax. Section 6. PENALTY. Any person failing or refusing to make reports or payments prescribed by this ordinance and the rules and regulations relating to the ascertainment and collection of the tax herein levied shall be subject to all such collection remedies authorized by SDCL Ch. 10-45, and acts amendatory thereto, and SDCL Ch. 10-46, and acts amendatory thereto, are hereby authorized for the collection of these taxes by the Department of Revenue. Section 7. SEPARABILITY. If any provision of this ordinance is declared unconstitutional or the application thereof to any person or circumstances held invalid the constitutionality of the remainder of the ordinance and applicability thereof to other persons or circumstances shall not be affected thereby. PUBLIC HEARING was held as advertised, pursuant to SDCL 7-21-22, for the purpose of adopting the following supplements to the 2026 Budget: A supplement to General Fund for the Poor Relief department account 101-4411-429440 in the amount of $136,319.00 for two settlements approved by the Board for indigent medical claims pursuant to SDCL 28-13 passed on 06.22.2026, 2606-18, full board approved; a supplement increasing Rural Fire Fund account 211-4221-499110 by $57,555.00, this is a pass through account fund that should have been expended in Dec of 2025 but were paid from 2026; a supplement increasing the Domestic Violence Fund account 229-4434-499200 in the amount of 4,950.00, this is a pass through account with excess funds that should be sent out, for a total budget supplement of $198,824.00. Auditor Sheri Lund was present via Zoom to present the materials and answer questions from the Board. No testimony was heard in favor or opposition.

Toby Brown, Director of Planning and Zoning, was present to give information and answer questions. Testimony was heard in favor and opposition.

(2) The receiving parcel shall consist of a suitable buildable area capable of accommodating all requirements of the Lincoln County Code of Ordinances for the construction of a single-family dwelling. (3) The minimum lot size shall be one acre. (4) The parcel from which the eligibility is transferred shall continue as agricultural land or remain in its present use. (5) Approval has been granted by the appropriate governing entity for access onto a public road. (6) A right-to-farm notice covenant shall be placed on the deed prior to issuance of a building permit for a single-family dwelling. Section 2. That subsection (P) of Section 154.178 of the Code of Ordinances of Lincoln County, SD, is hereby amended to read: (P) The transfer of a building eligibility from one parcel to another parcel when all the following conditions are met. (1) The transfer of building eligibility shall occur only within the same township. Present to speak on this item and answer questions from the Board were Brad Preheim, Manager of the Vermillion Basin Water Development District, Daniel Ostrem, Ag Engineer with the NRCS and Larry Olson, retired employee of the USDA assisting with the navigation of USDA programs. 5. Two (2) children have been born as an issue from the marriage but have reached the age of majority.

6. The parties have acquired certain property and debts during the course of their marriage.

Laura asks the Court to make an equitable division of the property and debts of the

marriage.

7. Neither party to this action is a member of any branch of the Armed Services of the United

States.

WHEREFORE, Laura prays for Judgment as follows:

A. That Laura be granted a Decree of Divorce on the grounds of adultery, extreme cruelty,

and that the parties be restored to status of single parties;

B. That the Court make an equitable division and allocation of the property and debts of the

parties;

Pursuant to SDCL 25-4A-14, the guidelines are subject to any provisions established by a South Dakota Court in the following: a temporary or permanent domestic protection order, an order arising out of an abuse or neglect proceeding, a bond condition arising out of a criminal case, and an order in any other proceeding affecting child custody or support.

The attached guidelines shall apply and continue in effect unless the parties agree or the Court otherwise orders. The imposition of these standard guidelines creates no presumption as to who shall be awarded custody at any hearing. Pursuant to SDCL 25-4A 12, any agreement by the parties for visitation other than the standard guidelines must be in writing, signed by both parties, and filed with the Court. The agreed plan shall be approved by order of the Court and replace the standard guideline or any plan previously filed.

Pursuant to SDCL 25-4A-13, if either party objects to this initial order and implementation of the South Dakota Parenting Guidelines (Form UJS-302), the objecting party shall file an objection with the Clerk of Court. The Court shall order a hearing which shall be held not later than thirty (30) days after the date of the objection. The Court shall then issue its temporary custody and visitation order after considering the best interest of the child(ren) consistent with the provisions of SDCL 25-4-45.
