PUBLIC NOTICE
Notice is hereby given that all owners or persons in possession of property abutting on sidewalks to keep the sidewalks free from snow and ice and to remove the same within 48 hours after every fall or accumulation of snow or ice according to the following standards as set forth by Chapter 96 of the Code of Ordinances of Sioux Falls, SD:
§ 96.100 DUTY TO REMOVE SNOW.
(a) The owner or person in possession of any property abutting on any sidewalk shall keep the sidewalk free from snow and ice and shall remove any snow or ice from the sidewalk within 48 hours after the termination of any snow fall, snow or ice accumulation.
(b) The owner or person in possession of any property abutting upon any sidewalk which ends at an intersection or crosswalk shall maintain the sidewalk free from snow and ice to the edge of the street. Snow and ice deposited on the sidewalk in the street removal process shall be removed within 48 hours of being deposited.
If the owner or person in possession of property abutting on sidewalks fails to remove the snow or ice within 72 hours of the falling or accumulation hereof, the City will cause the snow or ice to be removed with an independent snow removal service and charge the cost to the abutting property.
If the bill is left unpaid, the cost will be assessed against that property to include the cost of levying such special assessment. In addition, the City’s Code Enforcement Officer will issue administrative citations in the amount of $100 for the first violation. Subsequent violations will cost more.

SCHOOL BOARD MEETING
The School Board of the Sioux Falls School District 49-5 of Minnehaha County, South Dakota, was called into regular session, pursuant to due notice, on Monday, September 28, 2026, at
5:30 pm in the Instructional Planning Center, 201 East 38th Street, Sioux Falls, South Dakota, with the following members present: Elizabeth Duffy, Dawn Marie Johnson, Marc Murren, Vice President, Gail Swenson, and President, Nan Kelly. Absent: none. Dr. James Nold, Superintendent of Schools, Cameron Kerkhove, Business Manager, and Brett Arenz, In-House Counsel, were also present.
DeeAnn Konrad, Community Relations Coordinator, announced that September is National Deaf Awareness Month. She introduced Dr. Patricia Ward-Maquire, Secondary Special Education Coordinator, who explained that 49 students in the District qualify under Section 504 for hearing loss. The District has two teachers dedicated to the deaf and hearing impaired, and 11 ASL educational interpreters. She gave an example of a spelling test of what a hearing-impaired student would hear.

A motion was made by Gail Swenson and seconded by Dawn Marie Johnson five (5) votes “yes” on roll call, approving the minutes of the meetings held September 14, 2026, which were furnished to Dakota Scout for publication, in unapproved form, all in accordance with SDCL §13-8-35.

1. Acknowledging the administration’s report of the study of bids which have been received during the prior 30 days and were opened, read, and tabulated in the Central Services Center—Purchasing Department and approving the bids of the lowest responsible bidders in accordance with the tabulated lists of contract awards that have been placed on file for reference purposes, as follows: Midwest Technology Products for Tech Ed Equipment Welding (CTE), see PD #3556 and FY27 Legal Publication #15 be awarded to Midwest Technology Products in the amounts $58,998.00, and authorizing the Business Manager to issue a contract to be executed by Midwest Technology Products (see MRF #20061 and Contract 26-079, JH), and upon execution, the contract(s) will be entered into and executed for, and on behalf of the District by the Business Manager and the President of the School Board, and thereupon, the bid security, if any, now on deposit with the Purchasing Supervisor of the District, be surrendered, all in accordance with Policy/Regulation DJ.

Adopting a resolution, as follows:
RESOLUTION
WHEREAS, gifts have been presented to the Sioux Falls School District 49-5 of Minnehaha County, South Dakota, and the School Board hereby accepts the gifts (see MRF #20062 for listing of gifts) and; BE IT RESOLVED, that said gifts shall become the property of the Sioux Falls School District, all in accordance with Policy KCD.

Dr. Kirk Zeeck, Assistant Superintendent, presented the Postsecondary Enrollment report as follows (MRF #20069):
The Bureau of Labor Statistics projects that by 2031, 72% of jobs will require workers to have some postsecondary credential or training beyond high school. As workforce needs continue to change, the Sioux Falls School District (SFSD) prepares students for multiple pathways, including postsecondary education, military service, apprenticeships, and the workforce.
District graduates continue to pursue postsecondary education over time, with a 64% overall average enrolling at any point during the first two years after high school for the classes of 2018 to 2025. For the Class of 2025, 53% enrolled in a postsecondary institution during their first year after graduation, with enrollment in both two-year and four-year institutions remaining steady. Of the 2023 graduates who enrolled, 85% returned for a second year.
The District also continues to strengthen career readiness. An average of 88% of SFSD seniors who took the National Career Readiness (NCRC) exam earned a Bronze certificate or higher. The College & Career Readiness Accountability indicator will change beginning with the 2026-27 Accountability Year, which will place greater emphasis on Capstone Experiences, Advanced Graduation Endorsements, and industry-recognized credentials. The South Dakota Department of Education will no longer offer the NCRC statewide. The District will transition to other industry-recognized credentials as part of its career readiness efforts.
Proposed updates to South Dakota’s CTE Content Standards will modernize career clusters, courses, and essential skills to align them with the state’s Modernized Career Cluster Framework. CTE educators, postsecondary professionals, and industry partners developed the revised standards through collaboration. Public hearings will take place during the 2026-27 school year before the South Dakota Board of Education Standards considers the final adoption. Postsecondary enrollment data will continue to be reviewed annually to monitor District graduates’ progress.

Allison Struck, Sioux Falls School District Education Foundation Executive Director, presented the Sioux Falls Public Schools Education Foundation report as follows (MRF #20070):
The Sioux Falls Public Schools Education Foundation continues to create innovative educational opportunities and fill funding gaps that impact students and teachers. The Education Foundation focuses on three primary areas including Curriculum Enhancements, Talent and Recognition, and Student Success.
Through Curriculum Enhancements, the Education Foundation awarded 80 First-Time Teacher Grants and 210 Replenish the Room Grants at the start of the 2026 school year, providing new and veteran educators with funding for classroom supplies and resources. In the spring of 2026, the Foundation also awarded 95 Public School Proud Grants totaling $140,000 to 148 educators.
Talent and Recognition efforts have expanded this year with a renewed focus on staff mental wellness. The Foundation has allocated $75,000 for staff appreciation activities, funded school team-building opportunities, and partnered with Avera to offer wellness workshops. Staff and parents also now have access to online mental health resources and live classes.
The Student Success Fund helps schools provide food, clothing, hygiene products, school supplies, and other basic needs to students and families. New this year, the Foundation provided $500 to each of the District’s 38 sites to restock supply closets and allocated $10,000 for Summer Connections scholarships at all four high schools. The Foundation also helped facilitate a donation of 400 backpacks for students at eight schools and continues to support college access, the Teacher Pathway Program, Literacy Allies, and cultural events for Native American students and families.
Through strong donor support and volunteer leadership, the Education Foundation continues to connect community resources with the needs of Sioux Falls Public Schools.

This public meeting includes informal discussion with Commissioners and staff about proposed maintenance projects within the County.

COMMISSIONER BRIEFING: Julie Dotzenrod of Tegra Group came before the Board to present information regarding the installation of a Cellular Distributed Antenna System (DAS) at the Justice Center. While Dotzenrod explained the timeline for inspection and installation, it was made clear that this project does not need to be completed immediately. She stated that there is Wi-Fi in the Justice Center, but there are a few areas with low signal strength. Public input was heard.

COMMISSIONER BRIEFING: Chad Brown, Chief Deputy with the Lincoln County Sheriff’s Office, presented to the Board an amendment to the contract between Minnehaha and Lincoln Counties for the housing of prisoners. The original contract was entered into on June 18, 2024, and the amendments address an increase in daily rate for prisoner housing in the Minnehaha County Jail from $131.90 to $142.33 and a decrease in the number of guaranteed beds for Lincoln County prisoners from 45 to 35. Public input was heard.

COMMISSIONER DISCUSSION: Commissioner Arends moved the correspondence from the City of Lennox from Reports to Regular Business; the letter was regarding the formation of an ambulance district. The City of Lennox does not want to participate in an ambulance district, instead they would like Lincoln County to sign a Memorandum of Understanding stating that the city would run everything and Lincoln County would pay them out of the general fund. Commissioner Arends suggested the Lincoln County Commission invite the Turner County Commission to meet and discuss the matter further. Public input was heard.

Bidding Scope
Sioux Falls Regional Airport Concourse Expansion Bid Package #8 will consist of Interior Planters.
Bidding Documents. Bid Documents can be downloaded from Building Connected. Bidders are to contact Brett Smith at [email protected] to request setup and access to the Building Connected website. All official notifications, addenda, and other Bidding Documents will be offered only through the Building Connected website. Anyone requesting, reviewing, or copying Plans and Specifications for this project agrees that they are doing so for the sole purpose of submitting a proposal on the project. Bidder further agrees the Plans and Specifications are the sole property of the SFRAA.
Bid Guarantee. Each bid in the amount of $100,000.00 or more, shall contain a bid bond for ten percent (10%) of the amount of the bid. Such bond to be issued by a surety authorized to do business in the State of South Dakota payable to the Weitz/Journey JV, as a guaranty that the bidder will enter into a contract with the Weitz/Journey JV, its board or officers thereof, in accordance with the terms of the letting and bid in case the bidder be awarded the contract.

Disadvantaged Business Enterprise. The requirements of 49 CFR Part 26 including any amendments thereto apply to this contract. In accordance with the amendment dated October 3, 2025, no DBE goals have been established for this contract. However, the contract clauses in 49 CFR §§ 23.9, 26.13(a-b), and 26.29 still apply to this contract. It is the policy of the Sioux Falls Regional Airport to practice nondiscrimination based on race, color, sex, or national origin in the award or performance of this contract. The Owner encourages participation by all firms qualifying under this solicitation regardless of business size or ownership
Federal Fair Labor Standards Act. All contracts and subcontracts that result from this solicitation incorporate by reference the provisions of 29 CFR part 201, et seq, the Federal Fair Labor Standards Act (FLSA), with the same force and effect as if given in full text. The FLSA sets minimum wage, overtime pay, recordkeeping, and child labor standards for full and part-time workers.
The Contractor has full responsibility to monitor compliance to the referenced statute or regulation. The Contractor must address any claims or disputes that arise from this requirement directly with the U.S. Department of Labor – Wage and Hour Division.
Trade Restriction Certification. By submission of an offer, the Offeror certifies that with respect to this solicitation and any resultant contract, the Offeror -
1) is not owned or controlled by one or more citizens of a foreign country included in the list of countries that discriminate against U.S. firms as published by the Office of the United States Trade Representative (U.S.T.R.);
2) has not knowingly entered into any contract or subcontract for this project with a person that is a citizen or national of a foreign country included on the list of countries that discriminate against U.S. firms as published by the USTR; and
3) has not entered into any subcontract for any product to be used on the Federal project that is produced in a foreign country included on the list of countries that discriminate against U.S. firms published by the USTR.
This certification concerns a matter within the jurisdiction of an agency of the United States of America and the making of a false, fictitious, or fraudulent certification may render the maker subject to prosecution under Title 18 USC § 1001.
The Offeror/Contractor must provide immediate written notice to the Owner if the Offeror/Contractor learns that its certification or that of a subcontractor was erroneous when submitted or has become erroneous by reason of changed circumstances. The Contractor must require subcontractors provide immediate written notice to the Contractor if at any time it learns that its certification was erroneous by reason of changed circumstances.
Unless the restrictions of this clause are waived by the Secretary of Transportation in accordance with 49 CFR § 30.17, no contract shall be awarded to an Offeror or subcontractor:
1) who is owned or controlled by one or more citizens or nationals of a foreign country included on the list of countries that discriminate against U.S. firms published by the U.S.T.R. or
2) whose subcontractors are owned or controlled by one or more citizens or nationals of a foreign country on such U.S.T.R. list; or
3) who incorporates in the public works project any product of a foreign country on such U.S.T.R. list.
Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by this provision. The knowledge and information of a contractor is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
The Offeror agrees that, if awarded a contract resulting from this solicitation, it will incorporate this provision for certification without modification in all lower tier subcontracts. The Contractor may rely on the certification of a prospective subcontractor that it is not a firm from a foreign country included on the list of countries that discriminate against U.S. firms as published by USTR, unless the Offeror has knowledge that the certification is erroneous.
This certification is a material representation of fact upon which reliance was placed when making an award. If it is later determined that the Contractor or subcontractor knowingly rendered an erroneous certification, the Federal Aviation Administration (FAA) may direct through the Owner cancellation of the contract or subcontract for default at no cost to the Owner or the FAA.
Civil Rights - Title VI Assurances. The Municipal Airport Authority in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 U.S.C. §§ 2000d to 2000d-4), 28 CFR § 50.3, and 49 CFR Part 21, hereby notifies all bidders that it will affirmatively ensure that any contract entered into pursuant to this advertisement, all contractors will be afforded full opportunity to submit bids in response to this invitation and will not be discriminated against on the grounds of the owner’s race, color, national origin, sex, creed, age, or disability in consideration for an award.
Prohibition of Covered Unmanned Aircraft Systems (UAS). - The Bidder or Offeror certifies that they are aware of and comply with relevant Federal statutes and regulations, including those from the Federal Aviation Administration (FAA), for operating unmanned aircraft systems (UAS) in accordance, and in compliance with all related requirements in the FAA Reauthorization Act of 2024 (Public Law 118-63), section 936 (49 U.S.C. § 44801 note).
Contractor warrants that all UAS operations will be conducted in full compliance with all applicable Federal Aviation Administration (FAA) regulations, including but not limited to 14 CFR Part 107, and any other applicable local, state, or Federal laws and regulations.
Sponsors and subgrant recipients cannot use AIP grant funds to enter into, extend, or renew a contract related to covered unmanned aircraft systems (UAS). This includes both procurement and operational contracts, as well as contracts with entities that operate such systems
