FINDING OF NO SIGNIFICANT IMPACT
TO ALL INTERESTED GOVERNMENTAL AGENCIES AND PUBLIC GROUPS
As required by guidelines for the preparation of environmental impact statements, an environmental review has been performed on the proposed Clean Water State Revolving Fund action below:
PROJECT: Southeast Basin Sanitary Sewer Expansion
LOCATION: Lincoln County, South Dakota
PROJECT NUMBER: C461232-50
TOTAL COST/SRF SHARE: $17,746,000/$17,746,000 (100%)
Sioux Falls is proposing to construct new sanitary sewer force main and gravity trunk lines, lift stations, equalization basin, and gravity extensions along the north side of Lincoln County Highway 106 from Western Avenue to South Dakota Highway 11 and then north along Highway 11 to 57th Street. The project will be constructed in phases; however, the entire project area was reviewed during the environmental assessment. Phase 1 runs from Western Avenue to near Southeastern Avenue along the north side of Lincoln County Highway 106.
The South Dakota Board of Water and Natural Resources (BWNR) awarded Sioux Falls a $17,746,000 Clean Water State Revolving Fund (SRF) loan on January 8, 2026, for Phase 1 of the project. The loan has a rate of 3.5 percent and a term of 20 years. Repayment of the SRF loan will be with system revenues.
The project will not affect any historical or archaeological resources as determined by a Cultural Resources Inventory Survey of the project area. In the event of an archaeological or historical resource being unearthed during construction, work will be stopped, and the State Historic Preservation Office will be notified. The project should have no direct or indirect adverse effects on plant life or wildlife. The improvements, if necessary, will be flood-proofed to above the 100-year base flood elevation. The proposed project will not adversely affect wetlands. The United States Department of Agriculture determined that there will be no significant impact on farmland of statewide importance in Lincoln County, and the Department of Agriculture determined that no further alternatives need be considered.
The review process did not indicate that significant environmental impacts would result from the proposed action. Consequently, a preliminary decision not to prepare an Environmental Impact Statement has been made. This action is taken on the basis of a careful review of the engineering report, environmental information documents, and other supporting data, which are on file at the Department of Agriculture and Natural Resources (DANR), Division of Financial and Technical Assistance, Pierre, South Dakota, and are available for public scrutiny at the City offices in Sioux Falls, South Dakota.
Comments supporting or disagreeing with this decision may be submitted for consideration by DANR at DANRMail@state.sd.us. After evaluating the comments received, the department will make a final decision; however, no final administrative action will be taken on the project for at least 30 calendar days after release of the Finding of No Significant Impact.

The February 23, 2026, regular school board meeting at the Heritage Elementary Board Room, was called to order at 6:00 p.m. by Chairperson Terra Vennard. Board members present were Terra Vennard, Linda Kirchhevel, Mike Knudson, Jay Hutton and Sara Vande Kamp. Also in attendance were Superintendent Lowery, and Director of Finance/HR Conway.

COMMUNICATION ITEMS
Administrator/Committee Reports by Administration: Superintendent Lowery and Strategic Planning committee members, Hutton & Kirchhevel, reported on the Core Values progress. ASBSD Representative Vandekamp addressed the Board with updates on legislation that impacts our District. Knudson reported on the Finance Committee Meeting and the state of the major funds in the District, noting Bond Redemption, Capital Outlay, and Special Education funds are doing well, and that we are monitoring the General Fund as our enrollment is flattening and state aid is a concern. Kirchhevel announced nominations have been received by the Teacher of the Year Committee. Negotiations will begin soon. Reminder of petitions for 2 board member openings due March 24; election to be held June 2, 2026.

An ordinance amending Ordinance MC16-90, the 1990 Revised Zoning Ordinance for Minnehaha County.
The Minnehaha County Board of Commissioners adopted Ordinance MC16-186-26 on February 24, 2026. This ordinance amended Ordinance MC16-90, the 1990 Revised Zoning Ordinance for Minnehaha County by rezoning the property legally described as: Tract B & Tract C Schreurs’ Addition (Ex. H-1) S½ SE¼ Section 23 T103N-R49W Sverdrup Township, Minnehaha County, SD is hereby rezoned from A1 Agriculture District to the Ransom Planned Development District and the official zoning map referred to in Article 2.04 is amended to include the property in the Ransom Planned Development District.
The entire ordinance is on file in the office of the County Auditor and available for inspection during regular business hours.

PRESENTATION
Lynne Keller Forbes, Southeastern Council of Governments Executive Director, gave a presentation on the Southeastern Council of Governments (SECOG). Discussion followed on organizational structure; 2025 information including revenues, dues, funding secured with SECOG assistance, regional return on investment, funding secured by County, infrastructure return on investment by county; land use regulations. Further discussion was held on the coordination of the Metro Planning Organization, Southeastern Development Foundation, and Dakota Business Finance.

Scott Anderson, Planning Director, was present for the deferred hearing from September 23, 2025, for rezoning #25-02, to rezone approximately 14.87 acres from the A1 Agriculture District to the C Commercial District. The property is legally described as Tract B Schreurs’ Addition (Ex H-1) S1/2 of the SE1/4 in Section 23-T103N-R49W Sverdrup Township and is located approximately 1 1/2 miles east of the 475th Avenue and 254th Street intersection. The applicant chose to pursue a larger planned development area which was approved on February 24, 2026. PRESENTATION

Discussion followed on completed projects, accessory dwelling units map, new/replace dwelling units map, development highlights map, current projects, planning & zoning administration, code enforcement, and future projects.

Bill Hoskins, Museum Director, presented the Siouxland Heritage Museums Annual Presentation. Discussion followed on museum by the numbers in 2025, cooperative ventures, exhibits and programming, management of artifacts, conservation/special projects, and information related to the Endowment fund.
LEGISLATIVE UPDATE
Meredith Jarchow, Assistant Commission Administrative Officer, gave a briefing on the 101st Legislative Session and summarized the legislation that the Commission Office is following and which was provided with the online agenda. Discussion on the upcoming important dates and the status of HB 1107 and the property tax legislation. Auditor Anderson provided an update on election-related legislation.
COMMISSIONER LIAISON REPORTS
Commissioner Bleyenberg commented on the Human Services annual report and the National Association of County Officials legislative event as well as telling the story of the county focusing on the Highway Department.

NOTICE OF RESPONSIBILITY TO CONTROL NOXIOUS WEEDS AND DECLARED PESTS
NOTICE IS HEREBY GIVEN this 1st day of March 2026 pursuant to SDCL 38-22 as amended to all owners, occupants, agents, and public officials in charge of lands in Lincoln County, South Dakota, that they are responsible for the suppression, control, and eradication of noxious weeds and declared pest infestations that may exist on such lands.
Chemical, biological, and / or cultural control methods used for the suppression, control and eradication of noxious weed and declared pest infestations shall be those approved for such purposes by the Lincoln County Weed and Pest Supervisor, Agronomy Weed Field Specialist, or the South Dakota State University Experiment Station.
Upon failure to observe this notice, the county weed and pest board is required to proceed pursuant to the law and have the noxious weeds or declared pests destroyed by such methods as they may find necessary, the expense of which shall constitute a lien and be entered as a tax against the land, and be collected as other real estate taxes are collected, or by other means as provided by law.
Plant and animals designated as being noxious weeds and declared pests in the state of South Dakota are Absinth Wormwood, Canada Thistle, Hoary Cress, Leafy Spurge, Perennial Sow Thistle, Purple Loosestrife, Salt Cedar, and Gypsy Moth.
In addition, Musk Thistle, Plumeless Thistle, Spotted Knapweed, have been approved by the South Dakota Weed and Pest Control Commission as locally Noxious Weeds and are subject to the same suppression, control, and eradication requirements as the before mentioned plants and animals.
NOTICE IS HEREBY GIVEN that upon establishing probable cause to believe a noxious weed or declared pest infestation exists upon any property in Lincoln County, a representative of the Lincoln County Weed and Pest Control board will enter upon said property for the purpose of inspecting and confirming that such infestation actually exists.

The effect of the rules will be to require vehicles to be registered and titled in an individual’s legal name, to establish the Electronic Title and Registration (ERT) program, set forth ERT application requirements, require ERT provider annual fees, responsibility for technical costs, document retention requirements, and establish penalties for failure to remit state taxes and fees as required.
The reason for adopting the proposed rules is to implement the ERT program as required by state law, to ensure that ERT providers comply with necessary technical requirements of DOR’s 605Drive system, ensure the timely remittance of state taxes and fees by ERT providers, and ensure compliance with federal document retention laws.
Persons interested in presenting amendments, data, opinions, and arguments for or against the proposed rules may appear in-person at the hearing, or mail or e-mail them to the Department of Revenue at the address or email address listed below, Agency Mailing Address and E-mail Address. The deadline to submit any such written comments for consideration by the Department is April 14th at 5:00 p.m. Central.
