A RESOLUTION DECLARING THE RESULTS OF THE CITY OF SIOUX FALLS MUNICIPAL RUNOFF ELECTION HELD IN THE CITY OF SIOUX FALLS, SD, ON TUESDAY, THE 23RD DAY OF JUNE 2026.

On Tuesday, the 23rd day of June 2026, a City of Sioux Falls Municipal Runoff Election was held. The purpose of this election was to elect one Mayor and three Council Members for the City of Sioux Falls, SD.

The City Council of the City of Sioux Falls met as the Canvassing Board pursuant to law on Friday, June 26, 2026, at the Carnegie Town Hall, 235 W. 10th St., Sioux Falls, SD, at 8 a.m., to canvass the votes cast for said offices at said Municipal Runoff Election.

Pursuant to the Canvassing Board’s report, candidates for the offices of one Mayor; one At Large Council Member “A” position; one Southeast District position; and one Central District position received the following votes:

For the Mayor of Sioux Falls, four-year term position: Christine Erickson—18,280; Jamie Smith—18,278.

For At-Large Council Member “A,” four-year term position: James Oppenheimer—18,693; Vince Danh—11,990.

For the Southeast District Council Member, four-year term position: Michael A. Crane—4,245; Sara Pankonin—5,027.

For the Central District Council Member, four-year term position: Zach DeBoer—2,822; Zak Okuwe—3,313.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SIOUX FALLS, SD:

That pursuant to the Canvassing Board’s report, Christine Erickson received 49.91 percent of the votes cast at said election and is hereby declared elected to the office of Mayor.

That pursuant to the Canvassing Board’s report, James Oppenheimer received 51.04 percent of the votes cast at said election and is hereby declared elected to the office of At-Large Council Member “A.”

That pursuant to the Canvassing Board’s report, Sara Pankonin received 45.81 percent of the votes cast at said election and is hereby declared elected to the office of Southeast District Council Member.

That pursuant to the Canvassing Board’s report, Zak Okuwe received 49.40 percent of the votes cast at said election and is hereby declared elected to the office of Central District Council Member.

The School Board of the Sioux Falls School District 49-5 of Minnehaha County, South Dakota, was called into regular session, pursuant to due notice, on Monday, June 22, 2026, at 5:30 pm in the Instructional Planning Center, 201 East 38th Street, Sioux Falls, South Dakota, with the following members present: Elizabeth Duffy, Gail Swenson, Dawn Marie Johnson, and Vice President, Marc Murren. Absent: President, Nan Kelly. Dr. James Nold, Superintendent of Schools, Todd Vik, Business Manager, and Brett Arenz, In-House Counsel, were also present.

RESOLUTION

WHEREAS, Todd Vik has served the Sioux Falls School District 49-5 for the past twenty-five years, since June 2001; as a valued Business Manager; and, WHEREAS, Mr. Vik has during these twenty-five years ably served as a District Representative to the following committees: Insurance Committee, Budget Review Committee, Chamber of Commerce, as well as a contributing member of the City/Counties/Schools meetings, legislative liaison and on the negotiating teams for the District; and, WHEREAS, Todd provided exceptional leadership for Sioux Falls and the whole State of South Dakota through his tenure as the business manager; and, WHEREAS, Mr. Vik provided leadership and significant guidance to the District’s long-range financial planning and Five-Year Budget Plan, while maintaining a high sense of fiscal responsibility and advocating strong, innovative academic programs; and, WHEREAS, Todd during his tenure was instrumental and provided significant leadership during four Superintendent transitions that included national searches, interviews, and the ultimate hiring of Best In Class Leaders; and, WHEREAS, during his tenure with the School District completed countless construction projects and acquisitions for the District and Southeast Technical College, including the completion of the new Marcella LeBeau Elementary School and, WHEREAS, Todd steadfastly served during the pandemic, while taking into consideration the best way to educate students safely and effectively, in unprecedented times. WHEREAS, Mr. Vik encouraged a commitment to understanding and valuing diversity as well as the importance of providing multiple pathways for student success, while advocating for children with special needs; and, WHEREAS, Mr. Vik has ably served in these capacities at considerable personal sacrifice and with outstanding dedication to “placing children first” in all his decisions; whether considering budgets, boundaries, bussing, calendars, curriculum, or policies; and, WHEREAS, we, the School Board, wish to express deep appreciation and thanks to Todd Vik on behalf of the members of the School Board, the administration and the entire School District; NOW, THEREFORE, BE IT RESOLVED, that this resolution be spread upon the minutes of the meeting of the School Board of the Sioux Falls School District 49-5 held Monday, June 22, 2026, and a copy of the resolution be given to Todd Vik. Approval of the Employment Agreement Between the Sioux Falls School Board and the Custodial Manager’s Association

To authorize the issuance of a five-year contract with the Custodial Manager’s Association, Sioux Falls, South Dakota, beginning July 1, 2026 through June 30, 2031, and further authorizing the President of the School Board and the Business Manager to execute the agreement, for and on behalf of the District.

C4. Approval of the Employment Agreement Between the Sioux Falls School Board and the Custodial and Maintenance – AFSCME Local 1025

To authorize the issuance of a five-year contract with the Custodial and Maintenance – AFSCME Local 125, Sioux Falls, South Dakota, beginning July 1, 2026 through June 30, 2031, and further authorizing the President of the School Board and the Business Manager to execute the agreement, for and on behalf of the District.

Casey Meile, Athletics Coordinator, and Shane Weubben, Fine Arts Coordinator, presented the 2025-2026 Athletics and Fine Arts Activities Participation report as follows (MRF #19999):

Participation in athletics, fine arts, and student activities continues to play an important role in the student experience in the Sioux Falls School District. During the 2025-2026 school year, nearly 89% of middle school students participated in at least one music ensemble or visual arts class, while more than 65% participated in athletics. At the high school level, 64% of students enrolled in at least one fine arts course, and 51% participated in athletics. These opportunities complement classroom learning by helping students develop leadership, teamwork, creativity, discipline, and a stronger connection to their school community.

Students achieved success at the local, state, and national levels throughout the year in both fine arts and athletics. SFSD was once again recognized as one of the nation’s Best Communities for Music Education for the fourth consecutive year, while students earned a range of honors, including All-State recognition, national speech and debate qualifications, top placements in visual arts competitions, and state championships in Esports.

In athletics, student-athletes earned individual and team state titles, numerous All-State and All-Conference recognitions, and prestigious honors such as the Gatorade Player of the Year Award and the Spirit of Su Award.

Academic excellence remained a hallmark of participation, with more than 93% of eligible fine arts groups and nearly 98% of varsity athletic teams earning SDHSAA Academic Achievement Awards.

These participation numbers and wide-ranging accomplishments reflect SFSD’s continued commitment to providing high-quality extracurricular opportunities that engage students and help prepare them for success in school and beyond.

Dawn Marie Johsnon presented the Opt Out Recommendation, see (MRF#20000) as follows:

South Dakota law requires the Sioux Falls School District to publish an ad in a legal publication with the title of “Notice of Tax Increase.” That ad will appear in the Dakota Scout on June 26 and July 3. While the exact title is mandatory by law, it is misleading. A Sioux Falls homeowner’s school portion of property taxes will actually decrease by over 20% in 2027 and the opt out amount utilized by the Sioux Falls School District will also decrease for the 2026-27 school year.

The School Board tentatively approved the budget for the 2026-2027 school year in April 2026, and this opt out replaces a portion of a $5 million dollar levy that ends in 2027. The recommendation is to reduce the opt out by $1 million from the previous year and by $1.5 million from what was originally projected. The district works hard to respect taxpayers while still providing a quality education, demonstrated by eliminating $3 million from the ongoing budget one year ago and another $2 million this year.

South Dakota law requires education be funded at 3% or the rate of inflation, whichever is less. Despite this, for the 2025-26 school year, the state did not meet funding requirements and instead allocated 1.25% while the rate of inflation was over 3%. For the 2026-27 school year, the state allocated a 1.4% increase while the rate of inflation was 2.54%.

Counting one-time money being used to temporarily fill the gap until the full restoration of the three/tenths of the half penny sales tax the Legislature increased in 2016, State Aid as a share of the total state general fund budget will be 32 percent. While this is seemingly in line with what one might expect had K12 funding kept pace with the rest of the budget, about $210 million of that increase has been property tax relief funded through the state aid formula. Without that $210 million of property tax relief since 1998, State Aid would be only 26% of the general fund budget (or $210 million short of “keeping pace” with the rest of the state).

This reality creates a challenging gap for school staff who face cost-of-living increases while their salary doesn’t keep pace. For this reason, and because Sioux Falls has identified other essential programs and priorities, the District exercises the option to opt out of property tax limitations to provide a quality education to every student.

Following advice of a committee of local business professionals called the Finance Action Network, the District has used a laddered approach to opt-outs since 2019. The group recommended overlapping smaller amounts each year to adjust for inflation, if needed, rather than requesting larger amounts at intervals of 5 to 10 years. The laddered approach, combined with a $5 million reduction in ongoing expenses over the past two years, results in a lower recommended opt-out amount in FY27. Rather than adjusting “up” for inflation, the Board recommends dropping the opt-out amount by $1 million from the amount levied last year.

The result is that the overall school mil rate for homeowners is projected to drop from $7.13 in 2026 to $5.36 in 2027. This reduction will lower the school tax bill by 23% on a typical home. Homeowners will not see an increase in school property taxes; they will see a decrease, despite the required notice with the misleading title.

RESOLUTION

The GOVERNING BOARD OF THE SIOUX FALLS SCHOOL DISTRICT 49-5 do state that the above said Board is unable to operate under the tax limitation measure currently in statute in the general fund. We therefore OPT OUT of such tax limitation in the amount of $1,900,000 starting with taxes payable in calendar year 2027. This opt out will be for ten years, which will be through taxes payable in calendar year 2036. This action has been taken by the Board and approved by at least a two-thirds vote of the Board.

This decision may be referred to a vote of the people upon a petition signed by at least five percent of the registered voters in the District and filed with the governing body within twenty days of the first publication of this decision.

Unless this action is referred to a vote of the people and reversed by such vote, this resolution authorizes the county auditor(s) to spread an excess levy to raise tax dollars in the above-stated amount.

This route is being removed from the primary county highway system in Minnehaha County due to a Jurisdiction Transfer Agreement between Minnehaha County and the City of Valley Springs. The City of Valley Springs will add this segment to the city’s jurisdiction as part of its municipal street system.

Briefing on the VP-09 Precinct Committeeman Recount

Leah Anderson, Auditor, provided a briefing on the VP-09 Precinct Committeeman Recount. The recount was held on June 19, 2026. The board convened at 10:00 a.m. and adjourned at 11:00 a.m. The results remained at a tie and no ballots were disputed. Pursuant to SDCL 12-21-43, the candidates met on June 22, 2026, at 10:15 a.m. to determine the tie based on the drawing of lots. The candidates or their representatives chose to use a deck of cards, and the winner would be the high card drawn. The first draw resulted in a tie and the second draw resulted in a winner of the precinct committeeman for VP-09

Briefing on Proposed Updates to the Employee Handbook

Carey Deaver, Human Resource Director, provided a briefing on proposed updates to the Employee Handbook. Discussion followed on the updates to the following sections: Section 3.8 on Equal Employment Opportunity Guidelines and Reporting; Section 7.3 on Payroll Deductions; Section 10.1 on Holidays; Section 11.9 on Worker’s Compensation; and Section 15.1 on Standards of Conduct.

Also acknowledged was the resignation of Commissioner Otten effective June 18, 2026. An appropriate timeline was established for the application process and the public hearings to interview candidates. Public input was heard.

MOTION by Tiffani Landeen and seconded by Joel Arends to establish the following timeline: Letters of Interest for the Commissioner position need to be received by the Commission Office by Monday, June 29, 2026.
