WHEREAS, the Arts and Cultural Plan identifies the expansion of public art throughout Sioux Falls as a key strategy to increase access to arts and culture, strengthen neighborhood destinations, and integrate creativity into public infrastructure and civic spaces; and
WHEREAS, the City of Sioux Falls maintains a commitment to providing residents and visitors with opportunities to experience high-quality public art in parks, civic spaces, and other publicly accessible locations; and
WHEREAS, the Visual Arts Committee and other appropriate advisory bodies have reviewed the proposed artwork and locations and recommended approval of the placements described herein; and
WHEREAS, the placement of these sculptures will enhance the cultural, aesthetic, and educational value of public spaces throughout the community; and

ASBESTOS NOTIFICATION
SIOUX FALLS SCHOOL DISTRICT 49-5
The Sioux Falls School District is required by Asbestos Hazardous Emergency Response Act regulations to annually publish this notice regarding its current and planned asbestos activities. The District has identified asbestos materials in several of its facilities. The District’s asbestos management plan is available for public inspection at Operational Services-Central Services Center, 1101 North Western Avenue, or at the administrative office at each individual school building.
The District has removed all friable asbestos material over the past 30 years. The District does however, have non-friable asbestos materials remaining in the form of floor tile, transite boards and/or pipe insulation materials in concealed spaces. These materials are identified in the individual facility’s management plan.
The District is required to conduct semiannual surveillance for all confirmed and assumed asbestos material in each facility. These inspections will be conducted in the fall and spring of the year. The District has completed its required three-year surveillance review. ACT Associates, Inc. conducted this review. These reports are on file with the management plants at the respective school buildings.
If damaged asbestos material is detected anytime, Operational Services will be notified and will have the material removed by a certified individual or company. This notice may be viewed free of charge on a 13 statewide public notice website maintained pursuant to §17-2-1.

Mayor, Brian McGreevy called the meeting to order at 6:00 pm in the Baltic City Hall, 130 St. Olaf Avenue. Answering roll call were Alderman Eric Comes, Edward Clark-Jessen, Mayor Brian McGreevy, Nikki Oien and Steve Boeve. Also, in attendance was Public Works Supervisor Paul Osthus and Finance Officer Lauren Utecht.
McGreevy led the meeting in the Pledge of Allegiance.
OATH OF OFFICE
Finance Officer Lauren Utecht administered the Oath of Office to Cody Jans for Planning & Zoning Commission. Edward Clark-Jessen made a motion to approve Cody Jans to the Planning & Zoning Commission. Seconded by Eric Comes. All ayes. Motion carried.
FIREWORKS
Oien made a motion to approve fireworks in City Limits July 3, 4 & 5 from 8am – 11pm each day. Seconded by Clark-Jessen. All ayes. Motion carried.
Comes made a motion to approve street closure on July 4th on Aana & 6th St down Aana Ave. Seconded by Oien. All ayes. Motion carried.
Comes made a motion to approve street closure on July 4th on Valley View from 507 Valley View to 510 Valley View. Seconded by Boeve. All ayes. Motion carried.

Briefing on Emergency Management Building Projects
Mark Kriens, Director of Facilities and Construction, provided a briefing regarding Emergency Management Building Projects. Discussion followed on 2026 budgeted repairs for the Emergency Management parking lot, 2027 allocated funds for a new roof on the Emergency Management facility, and the possible addition of additional square footage to the proposed Highway Facility phase 2 project as well as the next steps. It was the consensus of the building committee to look at the feasibility of the creation of additional space at the Highway Facility.

Opt Out Resolution
Susan Beaman, Finance & Budget Officer, presented a request to approve a $2,378,000 Opt Out Resolution. The Financial Action Network (FAN) Committee recommended pursuing the passage of additional opt outs while currently authorized opt out funds were available. Minnehaha County’s forecast indicates that need for new opt out funds to be levied in 2028. The General Fund budget and forecast continues to project increases in public safety and justice-related expenses in response to growing service needs and these budgeted expenses have increased by 53% since 2022. There is currently $2,622,000 in General Fund opt out capacity that has not yet been levied and projections indicate potential opt out levy needs in 2028 and 2029 of approximately $6,000,000.

THE GOVERNING BOARD OF MINNEHAHA COUNTY do state that the above said board is unable to operate under the tax limitation measure currently in statue. We therefore OPT OUT of such tax limitation in the amount of $2.378 million starting with calendar year 2026 taxes payable in the calendar year 2027. This opt out will be for 25 years, which will be through taxes payable in the calendar year 2051. This action has been taken by the board and approved by at least a two-thirds vote of the board.
This decision may be referred to a vote of the people upon a petition signed by at least five percent of the registered voters of the County and filed with the governing body within twenty days of the first publication of this decision.
Unless this action is referred to a vote of the people and reversed by such vote, this resolution authorizes the county auditor to spread an excess levy to raise tax dollars in the above stated amount.

The contract is for 5 years; the terms will be $41,429.73 payable in July of this year and years two through five will be $37,645.92. No public input was heard.

COMMISSIONER DISCUSSION: Sheri Lund, Lincoln County Auditor, presented to the Board the results of the post-election audit, which was held as noticed on 06.16.2026 at 10a.m. There were two boards of 5 members each. The audit took 4 hours to complete. Per Lund, the post-election audit went very well. The Primary Election had a total of 14,117 ballots cast; the audited ballots totaled 1,343, which is approximately 9.51% of the total ballots.
We audited Sioux Falls 1-14: United States Representative and Sioux Falls Charter Amendment B; and Sioux Falls 2-10: United States Representative and At-Large A Council Member for Sioux Falls. In both United States Representatives races, no errors were found. The Sioux Falls 1-14 Charter Amendment B was off by 1 vote. On election night, we had one ballot that was counted as an overvote. The Board was unable to locate the overvoted ballot which resulted in an additional no vote.
Sioux Falls 2-10 At-Large A Council Member for Sioux Falls was off. On election night, we stated we had one unstamped ballot that was not counted. The audit board was unable to locate the unstamped ballot, so one additional ballot was tallied during the audit. No public input was heard.
COMMISSIONER DISCUSSION: The Board conducted interviews with 10 candidates for the open Commissioner position vacated by Betty Otten in District 2. Public input was heard.
COMMISSIONER DISCUSSION: The Board of Commissioners postponed the work session regarding the proposed budget until July 7, 2026. No public input was heard.

The effect of the rules will be to: set the education, work experience, supervision, and examination requirement for peer support services; update the education, work experience, supervision and examination requirements for addiction counseling and prevention services; establish the requirements of board approved supervision to meet the requirements for the board to certify or license providers of peer support, addiction counseling and prevention services; set the standards for renewal of a recognition, certification or license issued by the Board; and clarify the standards for providing services through electronic means.
The reason for the proposed rules is to fully implement House Bill 1029 which established the Board’s jurisdiction for the certification of peer support specialists and establishes the role and responsibilities of a board approved supervisor to ensure completion of the required work experience for certification or licensure. The proposed rules provide a comprehensive update through a repeal and replace of the current administrative rules for certification and licensure of addiction counseling and prevention services. The update reorganizes the education, work experience, supervision, and examination requirements for each category of services certified or licensed by the Board for consistency among the services. The proposed rules also set the standards for ethical practice, reciprocity and certification or licensure by endorsement, and standards for services provided through electronic means.

You have the right to ask the Court to modify the terms of the guardianship and conservatorship, terminate or discharge the guardian and conservator. The termination, revocation or modification may be ordered if:
(1) The protected person is no longer in need of the assistance or protection of a guardian or conservator;
(2) The extent of protection, management, or assistance previously granted is either excessive or insufficient considering the current need therefore;

(4) No suitable guardian and conservator can be secured who is willing to exercise the assigned duties.
Upon the filing of a Petition to terminate, revoke or modify the guardianship and conservatorship, the Court may appoint an attorney for the protected person if the Court determines that an appointment is necessary.
The Court will set a hearing on the petition to terminate, revoke or modify and the guardian and conservator and the protected person shall attend the hearing except for good cause shown.
If a petition to terminate, revoke or modify is filed, the Protected Person has the same rights as existed with the filing of the original petition.
A petition for removal or modification may be granted if a Guardian and Conservator:
(1) Is acting under letters secured by material misrepresentation or mistake, whether fraudulent or innocent;
(2) Has an incapacity or illness, including substance abuse, which affects fitness of office, or is adjudged to be a protected person in this or any other jurisdiction;
(3) Is convicted of a crime which reflects on fitness for office;
(4) Neglects the care and custody of the protected person;
(5) Has an interest adverse to the faithful performance of duties such that there is a substantial risk that the Guardian and Conservator will fail to properly perform those duties;
(6) Fails to file reports when required, or fails to comply with any order of the Court;
(7) Acts in a manner that threatens the personal security of a Guardian and Conservator;
(8) Avoids service of process or notice;
(9) Becomes incapable of or unsuitable for the discharge of duties; or
(10) Is not acting in the best interest of the protected person even though without fault.
