A Mexican national who was in the country illegally and being held in the Lawrence County Jail can be deported, a federal judge has ruled.

Jose Luis Ginez Ginez had filed a writ of habeas corpus with the Federal District Court of South Dakota seeking to block his removal. Judge Karen Schreier earlier this month granted Ginez Ginez with a temporary restraining order blocking the Department of Homeland Security from removing him from South Dakota.

The 14-day temporary restraining order gave Schreier time to consider the legitimacy of Ginez Ginez’s claim.
