Dispute over Washington Pavilion construction project moves to federal court
Sioux Falls, subcontractor at odds with Nebraska contractor and surety bonding firm
A dispute between the city of Sioux Falls and a contractor that was responsible for major repair work at the Washington Pavilion spilled into federal court this month.
McGill Restoration moved to have a lawsuit filed by the city on behalf of a subcontractor in state court removed to federal court. McGill is a Nebraska company, and the dispute is more than $75,000, making it a federal matter.
McGill won a nearly $6 million contract in 2022 as the main contractor to replace more than 580 balusters, parapet and cornice on the roof of the Pavilion. As the main contractor, McGill hired ARS, A Tecta America Co. to provide roofing labor and materials for the project. ARS is based in Sioux Falls.
