A South Dakota man who pled guilty to ingestion of a controlled substance should not lose his commercial driver’s license, the South Dakota Supreme Court has ruled.

The decision is a loss to the Department of Public Safety, which had sought to revoke Russell Stanley’s CDL.

Law enforcement pulled over Stanley while he was riding his motorcycle on Aug. 21, 2020 in Meade County. He was charged with driving under the influence while intoxicated by a combination of alcohol and drugs. A subsequent urine test was positive for methamphetamine.

The DUI charge was eventually dismissed and the judge in the case imposed a suspended imposition of sentence for the ingestion charge.
