Winner group home denial triggers lawsuit

Nonprofit that serves persons with developmental disabilities accuses city of violating federal fair housing laws

A nonprofit that provides services to persons with developmental disabilities is taking the city of Winner to court for standing in the way of plans for a new group home in the southern South Dakota community.

Community Connections, Inc. and Roger Little Eagle are accusing the Winner City Council of violating federal law by rejecting a request for a conditional use permit in May 2025. That denial came after the city’s Planning Commission recommended approval, the lawsuit says.

The quest to find a group home started when Little Eagle’s apartment was no longer meeting his needs. The 72-year-old is a client of CCI who struggles with physical impairments that limit his mobility. And he’s now unable to use the apartment bathtub. The apartment itself was falling into disrepair, according to the filing.
