One of Sioux Falls’ most notable forefathers found himself once again having to wait to get a prior conviction for possessing stolen postage stamps overturned 125 years ago this week after a juror was declared temporarily insane.

Prominent Sioux Falls lawyer and businessman Joe Kirby’s appeal was delayed on Nov. 1, 1899, when a federal judge dismissed the jury, with The Brookings Register reporting the cause being a member of the 12-man jury no longer capable of serving.
