LETTER | Congress must be careful not to hurt small companies' ability to compete with large retailers
I can’t say it’s easy being a small business owner, but after a few years of upheaval, things are looking up for entrepreneurs here in South Dakota. As the Senate Minority Whip, Senator Thune has been doing his part by supporting business-friendly policies. Now we need him to step up again due to some recent initiatives in Congress that could affect small businesses in the Mount Rushmore State and elsewhere.
Unfortunately, Congress could inadvertently hurt small businesses if they pass bills like the De Minimis Reciprocity Act. The current de minimis threshold allows businesses like mine to avoid excessive taxes and red tape on products valued below $800. As is, de minimis helps me keep my costs low and compete with bigger retailers; any changes to it could severely impact my business model.
Congress shouldn’t make changes without considering all the consequences. Senator Thune has always done a good job representing South Dakotans in Washington, and I know he’ll continue to do so by voting against unnecessarily altering the de minimis threshold.

On paper it sounds good to close a trade loophole but of course the devil is in the details.

The De Minimis Reciprocity Act is a proposed bill in the U.S. Senate that aims to stop China and other countries from exploiting a loophole in U.S. trade laws¹. The bill would prevent imports from China and Russia that have a value of less than $800 from entering the U.S. duty-free and with little customs scrutiny². The bill would also lower the duty-free threshold for other trade partners to match their own policies for U.S. exports³. The bill's sponsors, Senators Bill Cassidy and Tammy Baldwin, argue that the bill would protect U.S. manufacturers from unfair competition, curb the influx of counterfeit goods and illicit drugs, and support reshoring of industry from China⁴⁵.
