Meeting was called to order at 7:01 p.m.
A brief recess was called at 7:02 p.m. by the Lincoln County Commission.
The meeting came out of recess at 7:03 p.m.

ORDINANCE NO. 67-25
AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AMENDING THE CODE OF ORDINANCES OF THE CITY BY AMENDING CHAPTER 158: 2006 JOINT ZONING REGULATIONS LINCOLN COUNTY AND SIOUX FALLS, SECTION 158.015: BOUNDARIES OF JOINT AND PLATTING JURISDICTION.
BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That Section 158.015 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 158.015 BOUNDARIES OF JOINT AND PLATTING JURISDICTION.
(a) The Lincoln County/City of Sioux Falls joint zoning and platting jurisdiction geographic area shall be geographically portrayed in accordance with the applicable joint jurisdictional boundary delineated in the Official Lincoln County/City of Sioux Falls Joint Zoning and Platting Map. The Official Lincoln County/City of Sioux Falls Joint Zoning and Platting Map, together with all the explanatory matter thereon and attached thereto, is hereby adopted by reference and is declared to be a part of these regulations and defined as follows:
Beginning at the NW corner of Section 10 (T100N R51W) thence south to the NW corner of Section 15, thence east until the intersection of the centerline of 269th Street and 468th Avenue, thence south to the W 1/4 of Section 14 (T100N R51W), thence east along the W 1/4 section line until the middle of 469th Avenue, thence south until the intersection of the centerline of 270th Street, thence east until the center of the right-of-way for Interstate 29, thence south until 271st Street, thence east until 479th Avenue, thence north 3700’, thence east 500’ in NW1/4 of Section 22 (T100N R49W), thence north to the middle of 270th Street, thence east 750’, thence north 1000’ in SW1/4 Section 15 (T100N R49W), thence east 1100’, thence north 1525’, thence east 300’, thence north 700’, thence east to the middle of 480th Avenue, thence north to the intersection of 480th Avenue and Woodsong Place, thence east following Woodsong Place, thence northeasterly 1250’ to the Lincoln County line/Big Sioux River, thence north to the Lincoln/Minnehaha County line, thence following west to the point of beginning excluding existing city limits of Sioux Falls, SD.
(b) Before any territory may come under the jurisdiction of these regulations, the boundary of the joint and platting jurisdiction shall be amended by ordinance adopted by the county commission and city council in compliance with South Dakota Compiled Laws.

NOTICE TO BIDDERS
The City of Sioux Falls, SD, requests formal bids for the CommuniTree Program—Tree Acquisition and Planting Services.
To participate, you must be registered as a vendor in the e-procurement portal. Register at siouxfalls.bonfirehub.com by selecting “Register” next to the login tab. After you have registered, navigate to the Open Public Opportunities tab to view this invitation for bid. Bids will be electronically submitted through the e-procurement portal and will be received in the e procurement portal not later than 2 p.m., Central time, November 13, 2025. Immediately thereafter, the bids will be publicly opened and read at 3 p.m., Central time, City Hall, 224 W. 9th St., Sioux Falls, SD 57104. You may watch the bid opening virtually via Webex by utilizing information and links located at www.siouxfalls.gov/purchasing.
There will be a pre-bid meeting held on November 3, 2025, at 10 a.m. at the City Center, Room 110, 231 N. Dakota Ave., Sioux Falls, SD, for interested bidders. A virtual option is also available upon request. See bid documents for details.
It is the vendor’s responsibility to check the e-procurement portal for any changes or updates to the Invitation for Bid, which will be in the form of an addendum posted to the website.
Telegraphic, fax, email, and hand-delivered responses will not be accepted unless specifically authorized in the terms and conditions of the solicitation.
The City of Sioux Falls reserves the right to reject any or all bids, waive technicalities, and make award(s) as deemed to be in the best interest of Sioux Falls, SD.
Federal financial assistance will be used to fund all or a portion of the contract. The contractor will comply with all applicable federal laws, regulations, executive orders, federal policies, procedures, and directives including, but not limited to 2 CFR §§200.318-200.327. Subject to the OMB guidance in subparts A through F of 2 CFR Part 200 as adopted and supplemented by the USDA in 2 CFR Part 400. Adoption by USDA of the OMB guidance in 2 CFR 400 gives regulatory effect to the OMB guidance in 2 CFR 200 where full text may be found.
All bidders must be registered in the System for Award Management (SAM.gov), provide their Unique Entity ID (UEI), and have an active status.
The low responsive bidder must assure compliance with the requirements of Public Law 115-232, Section 889, Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment. Contractors must assure that telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities), and video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities) WILL NOT be supplied for the project.
Your special attention is invited to the Bidders Activity Report (BAR), Forms A and B, and Debar-2 form. The BAR form must be completed and submitted with your bid proposal, along with either Form A or Form B, and Debar-2 form. Failure to submit the Form BAR, appropriate form A or B, and Debar-2 form will cause the bid to be rejected. Completion of the Bidders Activity Report is necessary in order to fulfill the requirements of obtaining a complete list of contractors contacted with regard to this project, in accordance with 49 CFR 26.11(c). Statistical information used from the Bidders Activity Report will be used in the calculation of the next year’s DBE goals. By completing Form A, you are advising the City how the contract goal will be met. In the event you believe you will be unable to meet the goals, Form B must be completed and submitted with the Bid Proposal. Please be advised that good-faith efforts will be subjected to close scrutiny and if the good-faith effort submission is unacceptable, your bid will be rejected.

SCHOOL BOARD MEETING
The School Board of the Sioux Falls School District 49-5 of Minnehaha County, South Dakota, was called into regular session, pursuant to due notice, on Monday, October 27, 2025, at
5:30 pm in the Instructional Planning Center, 201 East 38th Street, Sioux Falls, South Dakota, with the following members present: Elizabeth Duffy, Dawn Marie Johnson, Gail Swenson, Vice President, Marc Murren, and President, Nan Kelly. Absent: none. Dr. James Nold, Superintendent of Schools, Kenneth W. Mosser, Comptroller, and Brett Arenz, In-House Counsel, were also present.DeeAnn Konrad, Community Relations Coordinator, recognized TeamMates of Sioux Falls for their work in mentoring and their recognition as the South Dakota Chapter of the Year. Hundreds of caring adults volunteer to be mentors to our students each year. Other mentoring partners with the District are LSS of South Dakota and the Helpline Center.

DeeAnn Konrad, Community Relations Coordinator, presented District Demographics report as follows (MRF #19818):
Engaging coursework, real-world learning experiences, and cutting-edge facilities continue to be the drivers behind what makes a public education in the Sioux Falls School District such an exceptional value. The District holds five priorities at the center of all decisions. Those include Academic Success, Staff and Student Well-Being, Community Engagement, Staff Excellence and the Effective Use of Resources.
While enrollment saw a slight decline over the prior year - down 172 students - the annual snapshot of schools shows an impressive 24,059 students in Kindergarten through 12th grades. Additionally, nearly 900 students, ages 3 through 5, receive preschool and early intervention services to prepare them for the rigors of Kindergarten.
Diversity among students continues its trend of moving 1-2% each year with 45.3% of students reporting a diverse background. Approximately 46.5% of students qualify for the Free/Reduced Price Meal Program. Many more are just missing the federal poverty level and are receiving assistance in paying for meals thanks to generous community donations to the Angel Fund.
Special education needs continue to rise among students with 4,397 students - or 17.6% of the overall population - qualifying to receive additional support in the classroom as outlined by Individualized Education Plans (IEPs). This is up 1.2% from the previous year.
Accommodations to ensure equitable access to the learning environment are made available to 2,978 students on 504 Plans. This is nearly 200 more plans than last year.
More than 3,600 staff members support student success in a variety of positions and more than half -1,936 of them - are serving as classroom teachers. Of those teachers, 65% have earned a Master’s degree or higher.
Academic measures of success are typically included in this annual report, but due to a delay in student progress reports, those measures will be added as soon as they become available.

Doug Morrison, Director of Data Services, presented the K12 Fall Enrollment report, as follows (MRF#19819):
The final enrollment for the 2025-2026 school year, covering Junior Kindergarten through 12th grade, is 24,059 students, 172 fewer than last year and 235 below the initial Day 4 count. Nearly 600 enrollment changes were processed between the initial and final counts, with about 400 students leaving and 200 enrolling. These numbers reflect active enrollments as of September 26, 2025, the last Friday in September.
Kindergarten enrollment is 1,723, down 56 from last year, while Junior Kindergarten increased to 83 students. Grades 1 through 5 dropped by 125 students, as the outgoing
fifth-grade class was larger than the incoming kindergarten cohort. Middle school enrollment increased by 62 students, and high school enrollment declined by 93. Open enrollment grew slightly to 1,033 students.
The opening of Marcella LeBeau Elementary School with 281 students affected enrollment at nearby schools, including Hawthorne, Renberg, and Hayward. The Elementary Immersion Center closed, with students now attending other schools in the district.
Fall funding FTE is 24,136, which is 194 fewer than last year. Overall, enrollment reflects modest shifts across grade levels due to school openings and closures, while middle school and open enrollment continue to grow steadily.

Andrew Engdahl, Director of Information Technology Services Technology Update report, as follows (MRF#19820):
The Information & Technology Services (ITS) department continues to strengthen the Sioux Falls School District’s technology infrastructure, security, and operational efficiency.
The department has made significant progress in modernizing systems and improving service performance. Major accomplishments include implementing multifactor authentication (MFA), converting to Microsoft Teams Voice (VoIP), and completing a districtwide network redesign, all designed to enhance reliability and data protection.
These improvements have produced measurable results. The department reduced ticket response times by 18.9% and resolution times by 27.8%, showing improved efficiency while maintaining nearly the same number of support requests as in previous years.
Looking ahead, ITS will continue aligning technology with instructional needs, strengthening cybersecurity, and developing districtwide standards to increase automation and operational consistency, all part of the department’s ongoing commitment to a secure and future-ready digital learning environment.

Mayor Brian McGreevy called the meeting to order at 7:05 PM in the Baltic City Hall, 130 St. Olaf Avenue. Answering roll call were Alderman Eric Comes, Edward Clark-Jessen, Mayor Brian McGreevy, City Attorney Mae Pochop, Alderman Nikki Oien, and Steve Boeve. Also in attendance were Finance Officer Lacey Harrington, Public Works Supervisor Dusty Lau and ISG Engineer Parker Hamann.
Brian McGreevy led the meeting in the Pledge of Allegiance.
APPROVAL/AMEND AGENDA
Lacey Harrington requested an amendment on the agenda to remove the Monthly Meeting Schedule item and the Pay Application #8 for the Oak & Ash Project as ISG is still working on getting a signature from Earthworks. Clark-Jessen made a motion to approve the amended agenda, Comes seconded, all ayes, motion carried.

Veteran’s Memorial Dedication
Mayor McGreevy wanted to remind the community on Saturday, October 25th from 12 pm to 2 pm, the Baltic Legion will be having their Veterans Memorial Park Dedication on the corner of Lovely Ave & 4th St. They will be serving hot dogs, chips and a drink while supplies last.

City Hall Sign
McGreevy presented the council with an image of what the City of Baltic sign looks like for the front of the office. This will be ordered this week and Dusty and Evan will install the sign.
ORDINANCE 321 - SECOND READING OF THE 2026 BUDGET APPROPRIATIONS
Finance Officer, Lacey Harrington, presented the council with the Second Reading of the 2026 Budget Appropriations. Harrington asked for approval and passage of the 2026 Budget Appropriations. Nikki Oien made a motion to approve and adopt the 2026 Budget Appropriations, Boeve seconded, all ayes, motion carried.
Resolution 2025-08 – Front Footage Assessment
Mayor McGreevy presented the Council with Resolution 2025-08 to levy a front foot assessment for annual maintenance of street surfaces as provided in SDCL 9-43-138. Finance Officer Harrington explained the resolution. McGreevy suggested we do not increase this amount and keep it the same for the next year. Boeve made a motion to approve Resolution 2025-08 – Front Footage Assessment, seconded by Oien, all ayes, motion carried.
Set Election Date
City Attorney Mae Pochop discussed the upcoming election calendar with the new election law changes. This was tabled while Attorney Pochop writes a resolution to set the election date.
ENGINEERING UPDATE
Oak & Ash Project – Hamann announced this project has reached full completion pending a signature from the contractor for Pay Application #8.
Main Lift Station – Hamann updated the council on the Main Lift Station progress. Contractor continues to make progress on the lift station building. Large electrical items have been installed. ISG and contractor are working with Xcel to service building with power. Remaining site items include final connection to sanitary forcemain and removal of old lift building.
Transportation Alternatives Grant – 2025 application was submitted on October 1st. Transportation Alternatives FY26 Project Presentations are being held on November 18th.
5th Street Improvements – This project has met substantial completion and all punch list items have been completed.
5th Street Ditch Improvements – 605 Companies plan to start and complete work the last week of October.
PUBLIC WORKS UPDATE
Maintenance Supervisor, Dusty Lau, gave updates on streets, parks, equipment, water & sewer, maintenance and other housekeeping issues.
FINANCE OFFICE UPDATE
Finance Officer Harrington gave updated status on State and County receivables.
LEGAL/COUNCIL/MAYOR UPDATE
Mayor McGreevy stated there will be a survey ordered on 100 Lovely Ave next week. Dusty Lau let the council know that Xcel has disconnected the electricity and MidAmerican is going to be disconnecting the gas next week. When there is a new owner of the land, they will need to put a new gas line in. Dusty and Lacey will work on getting a tear down permit from the state. We have 3 companies bidding out the tear down and will be discussed in November’s meeting.
Mayor McGreevy announced he does have some items to discuss in Executive Session. Alderman Nikki Oien made a motion to go into Executive Session at 8:03 pm, Boeve seconded, all ayes, motion carried.
Brian McGreevy called the Council back from Executive Session at 8:22 pm.
With no further business to discuss, Clark-Jessen made a motion to adjourn at 8:23 pm. Seconded by Boeve, all ayes, motion carried.

RESOLUTION # 2025-08
A RESOLUTION OF THE CITY OF BALTIC TO LEVY A FRONT FOOT
ASSESSMENT FOR ANNUAL MAINTENANCE OF STREET SURFACES AS
PROVIDED FOR IN SDCL 9-43-138.
WHEREAS SDCL 9-43-138 provides for an annual levy by the governing body of a special maintenance fee for the purpose of maintaining or repairing public improvements, that are maintained by the municipality;
WHEREAS the City of Baltic maintains and repairs street surfaces on its streets within the city limits;
NOW THEREFORE BE IT RESOLVED that the assessment of annual maintenance of street surfaces shall be levied as follows:
1. Designation of lots to be assessed. Pursuant to SDCL 9-43-138, all lots in the City of Baltic fronting a street shall be assessed on the front foot basis as provided below.
2. Amount of Assessment. There shall be levied upon all lots
fronting a street $1.00 per front foot. Front foot means the actual front foot of the premises as established by the buildings thereon, record title and use of the property regardless of the original plat; provided, that there be a 66 foot minimum fee and a 300 foot maximum fee.
3. Assessment. The City Finance Officer is directed to add such assessment to the general assessment against the property and certify the assessment together with the regular assessment to the county auditor to be collected as municipal taxes for general purposes.
4. Assessment subject to review. The assessment is subject to review and equalization the same as assessments or taxes for general purposes.

RESOLUTION MC25-29
PETTY CASH ACCOUNTS
AUTHORIZATION FOR DEPARTMENTAL PETTY CASH ACCOUNTS, ADMINISTRATION OF PETTY CASH ACCOUNTS, and REPEAL OF PAST PETTY CASH RESOLUTIONS,
WHEREAS, in past years the Minnehaha County Board of Commissioners has previously authorized various County departments to create and maintain petty cash accounts for the daily administration of such departments; and
WHEREAS, the Minnehaha County Auditor’s Office has recently conducted a review of such accounts including input from the Department Heads on their respective petty cash accounts; and
WHEREAS, based on such review, the Minnehaha County Auditor’s Office has recommended more uniformity in the creation and administration of such petty cash accounts across all departments;
NOW, THEREFORE, BE IT RESOLVED that the Minnehaha County Board of Commissioners authorizes each County department to create and maintain a petty cash account not to exceed Two Thousand Dollars ($2,000.00); and
BE IT FURTHER RESOLVED that the Minnehaha County Board of Commissioners authorizes the Minnehaha County Treasurer’s Office, due the number of customer service windows and the volume of transactions in that office, to create and maintain a petty cash account not to exceed Eleven Thousand Three Hundred Dollars ($11,300.00); and
BE IT FURTHER RESOLVED that the Minnehaha County Auditor shall propose procedures for: the creation of such petty cash accounts, disbursements from such petty cash accounts, accounting and record keeping for such petty cash accounts, and the periodic replacement of funds in such petty cash accounts; and
BE IT FURTHER RESOLVED that the Minnehaha County Auditor shall present such proposed procedures to the Minnehaha County Board of Commissioners for our review and adoption into the Minnehaha County Department Head Policies and Procedures Manual; and
BE IT FURTHER RESOLVED that such petty cash accounts shall be created and maintained according to County policies and all monies expended from such petty cash accounts shall be at the direction of the respective department heads according to County policies; and
BE IT FURTHER RESOLVED that the following Resolutions are hereby repealed: MC-89-22, MC-95-74, MC-97-85, MC-98-29, MC-98-129, MC-99-81, MC-99-82.

You have been identified as the natural mother of child J.K.B. a/k/a J.K.H., born January 31, 2021, in Brookings County, South Dakota.
A Petition for Termination of Parental Rights, for Waiver of Consent to Adoption, and for Leave to Adopt a Minor Child has been filed by Ross Hettinger and Tara Hettinger in this matter.
