RESOLUTION NO. 89-25
A RESOLUTION APPROVING THE SIOUX FALLS PARKS AND RECREATION 5-YEAR COMPREHENSIVE PLAN.
WHEREAS, the Sioux Falls Parks and Recreation Department (the “Department”) has undertaken the goal of being accredited by the Commission for Accreditation of Parks and Recreation Agencies (“CAPRA”); and
WHEREAS, pursuant to Section 95.027 of the Code of Ordinances of Sioux Falls, SD, the Department is required to have a comprehensive plan adopted by its board and governing bodies; and
WHEREAS, through the process of being accredited, the Department has refined its comprehensive plan to comply with the standards as required by CAPRA; and
WHEREAS, the Sioux Falls Parks and Recreation Board approved the 5-Year Comprehensive Plan on October 28, 2025, and recommends approval of the same to the Sioux Falls City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
That the Sioux Falls Parks and Recreation 5-Year Comprehensive Plan as attached hereto and made a part of this resolution is hereby approved.

RESOLUTION NO. 90-25
A RESOLUTION APPROVING THE SCHEMATIC DESIGN AND PRELIMINARY ARCHITECTURAL PLANS FOR THE NEW RECREATIONAL FACILITY AT FRANK OLSON PARK.
WHEREAS, on January 14, 2025, Ordinance 01-25 was adopted, which authorized the issuance of one or more series of sales tax revenue bonds (the “New Series of Bonds”) to design, construct, equip, and/or furnish a new recreational facility at Frank Olson Park (“Frank Olson Park Project” or “Project”);
WHEREAS, Section 2(e) of Ordinance 01-25 requires that the portion of the New Series of Bonds intended to fund the hard construction costs for the Frank Olson Park Project shall not be issued until the Sioux Falls City Council approved the Project’s schematic design and preliminary architectural plans;
WHEREAS, a Design Advisory Team was formed comprising of City staff, Sioux Falls Parks and Recreation Board members, and City Council members to assist in the schematic design process of the Project;
WHEREAS, since the passage of Ordinance 01-25, updates regarding the Project’s schematic design and preliminary architectural plans have been provided at informational meetings occurring on June 3, 2025, and October 21, 2025;
WHEREAS, eighty-five percent (85%) of the Project’s schematic design and architectural plans are now complete;
WHEREAS, on October 28, 2025, the Sioux Falls Parks and Recreation Board recommended for approval the Project’s schematic design and preliminary architectural plans;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
That the current schematic design and architectural plans for the Project attached to and made part of this resolution are hereby approved.
That the approval requirements of Section 2(e) of Ordinance 01-25 are considered met.
That the City shall publish this resolution, without attachments, after its passage. The attachments are on file and available for inspection in the office of the City Clerk.

A RESOLUTION DISCONTINUING THE USE OF CERTAIN PROPERTY OF THE CITY AS ANY PARKING LOT OR AREA OR OFF-STREET PARKING FACILITY.
WHEREAS, the City owns the following real property:
Lots 7 through 12 in Block 18 of Gales Sioux Falls, Minnehaha County, South Dakota, according to the Recorded Plat Thereof
hereinafter referred to as the “Property”;
WHEREAS, pursuant to SDCL 9-51-51, the governing body of any municipality may discontinue or use for another purpose any parking lot or area or off-street parking facility heretofore or hereafter acquired upon resolution of the governing body provided no contract provision or bond covenant binding the City prohibits such discontinuance or diversion;
WHEREAS, there is no contract provision or bond covenant binding the City that prohibits such discontinuance or diversion;
WHEREAS, the City contemplates the surplus and sale of the Property, which is commonly referred to as 113 E. 13th Street, Sioux Falls, SD;
WHEREAS, any sale of the Property shall be in compliance with SDCL Chapter 6-13, and pursuant to Section 2.12(7) of the City Charter;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
Section 1. The City authorizes discontinuing the use of the following described property as any parking lot or area or off-street parking facility for purposes of:
Lots 7 through 12 in Block 18 of Gales Sioux Falls, Minnehaha County, South Dakota, according to the Recorded Plat Thereof
Section 2. The Property shall be discontinued as being used as any parking lot or area or off-street parking facility, pursuant to SDCL Chapter 9-51, on or before the closing date of the sale of the Property.

ORDINANCE NO. 68-25
AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, DECLARING CERTAIN REAL PROPERTY OF THE CITY SURPLUS AND AUTHORIZING THE EXCHANGE OF CITY LAND WITH A PRIVATE LANDOWNER.
BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
Section 1. Notwithstanding the provisions of SDCL Chapter 6-13, and pursuant to Section 2.12(7) of the City Charter, the City of Sioux Falls hereby declares the following property to be surplus property that is no longer necessary, useful, or suitable for the purpose for which it was acquired:
Tract 4A of Rubin’s Addition to the City of Sioux Falls, Minnehaha County, SD, containing 174,307 square feet, more or less.
Section 2. That H & W Contracting, LLC, a South Dakota limited liability company, owns property with the following legal description:
That part of Tract 1A of Rubin’s Addition to the City of Sioux Falls, Minnehaha County, SD, lying north of the tract of land formerly described as Tract 1 of Rubin’s Addition to the City of Sioux Falls, Minnehaha County, SD, containing 242,897 square feet, more or less.
Section 3. That it is in the City’s interest to exchange real property owned by the City for real property owned by H & W Contracting, LLC, a South Dakota limited liability company, in accordance with the provisions of SDCL Chapter 6-5-4.
Section 4. An appraisal of the City of Sioux Falls’ property prepared by CBRE by Josh Luther, MAI, licensed by the state to do fee appraisals, dated March 13, 2025, is recognized as the appraisal of this property, which is hereby made a part of this ordinance by reference and is on file with the City Clerk. The appraisal shows the fee simple estate market value of the property as of March 13, 2025, is $60,000.
Section 5. An appraisal of H & W Contracting, LLC’s property prepared by CBRE by Josh Luther, MAI, licensed by the state to do fee appraisals, dated March 13, 2025, is recognized as the appraisal of this property, which is hereby made a part of this ordinance by reference and is on file with the City Clerk. The appraisal shows the fee simple estate market value of the property as of March 13, 2025, is $60,000.
Section 6. On September 17, 2025, the Sioux Falls Parks and Recreation Board unanimously recommended surplus of the above-described City property and the “Agreement for Exchange of Property.”
Section 7. That it approves the document titled “Agreement for Exchange of Property.” That said agreement is hereby made a part of this ordinance and is on file with the City Clerk.
Section 8. That the City of Sioux Falls and H & W Contracting, LLC agree to an even exchange of the properties, as the appraised values are equal.
Section 9. That the Mayor is authorized to sign the attached “Agreement for Exchange of Property” on behalf of the City, and any and all documents necessary to make the transfer and conveyance of the above-described property between the City of Sioux Falls and H & W Contracting, LLC, a South Dakota limited liability company, pursuant to and subject to all other conditions and terms and as set forth in the “Agreement for Exchange of Property.”
Section 10. That the City shall publish this ordinance, without attachments, after its passage. The attachments are on file and available for inspection in the office of the City Clerk.

Scott Wick, President and CEO of the Sioux Empire Fair Association, presented the annual presentation on the 86th Annual Sioux Empire Fair. Discussion followed about the various day sponsors, special events, livestock and static displays, arts center, commercial and food vendors, fairgrounds improvements, community service, and the fair financials, which included total expenses of $1,241,915 and total revenues of $1,433,350 for a net profit of $191,435.

RESOLUTION MINNEHAHA COUNTY 25-30
RESOLUTION AUTHORIZING THE COMMENCEMENT OF A CIVIL ACTION
WHEREAS, if any person dies a resident of Minnehaha County without money or means to defray burial expenses, and whose relatives or friends are unable or unwilling to defray such expense, the Board of Commissioners must provide the means for burial or cremation pursuant to SDCL Ch. 28-17; and
WHEREAS, in compliance thereof, Minnehaha County paid for final expenses of cremation for a decedent by agreement with a local funeral home, such expense in the original amount of Two Thousand Dollars ($2,000.00); and
WHEREAS, pursuant to SDCL § 28-14-5, Minnehaha County established a lien upon all real and personal property of the decedent including joint tenancy and homestead interests belonging to the decedent, such lien of record appearing in file # 101103 in the amount of Two Thousand Dollars ($2,000.00); and
WHEREAS, such lien was recorded with the Minnehaha County Office of Register of Deeds on the 13th day of April, 2020;
WHEREAS, the decedent’s next of kin entered into an agreement to pay Twenty Dollars ($20.00) per month for repayment of such expense but has only made payments in the amount of Eighty Dollars ($80.00) leaving a lien balance of One Thousand Nine Hundred Twenty Dollars ($1,920.00); and
WHEREAS, subsequent to the decedent’s death, the Minnehaha County Sheriff’s Office received a Distress Warrant issued by the Minnehaha County Treasurer seeking the collection of unpaid property taxes on a mobile home owned by the decedent; and
WHEREAS, such Distress Warrant resulted in a Sheriff’s Sale of the property on May 16, 2024, which sale resulted in surplus funds in the amount of Thirty-One Thousand Two Hundred Ninety Dollars and Forty-four Cents ($31,290.44); and
WHEREAS, based upon a search of filings with the Unified Judicial System, no probate has been filed with regard to the decedent’s estate; and
WHEREAS, Minnehaha County has authority to foreclose the lien by action pursuant to SDCL § 28-14-11.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners of Minnehaha County, South Dakota, that the Minnehaha County State’s Attorney is hereby authorized to institute and proceed with a civil action seeking to foreclose the county’s lien and determine disposition of the remaining surplus funds from the Sheriff’s Sale presently held by the County Auditor.

CONTINUED REZONING REQUEST PUBLIC HEARING
Scott Anderson, Planning Director, was present for the continued public hearing and second reading of Proposed Zoning Ordinance Amendment, Rezoning #25-02, to rezone approximately 14.87 acres from A-1 Agriculture District to the C Commercial District. The property is legally described as Tract B Schreurs’ Addition (Ex H-1) S 1/2 of the SE 1/4 in section 23-T103N-R49W Sverdrup Township and is located approximately 1 1/2 miles east of the 475th Avenue and 254th Street intersection. The hearing was continued from September 23, 2025, to allow the applicant time to consider other options.

COMMISSIONER BRIEFING: Michelle Burkhart, Finance Manager, came before the Board to answer questions regarding travel reimbursement rates for 2026. Effective October 1st, the State of South Dakota has increased the rate of reimbursement for mileage, to be consistent with the mileage reimbursement rate for business set by the Internal Revenue Service. This would be a $.01 increase when vehicles are available and a $.03 increase when vehicles are not available from last year. No public input was heard.

COMMISSIONER BRIEFING: David Ekle, Veterans Service Officer, asked the Board to approve a proclamation for Supporting Operation Green Light for Veterans. The proclamation states; PROCLAMATION BY THE LINCOLN COUNTY BOARD OF COUNTY COMMISSIONERS IN SUPPORT OF OPERATION GREEN LIGHT FROM NOVEMBER 4th THROUGH NOVEMBER 11th, 2025. WHEREAS, the residents of Lincoln County have great respect, admiration, and the utmost gratitude for all the men and women who have selflessly served our country and this community in the Armed Forces; and WHEREAS, the contributions and sacrifices of those who served in the Armed Forces have been vital in maintaining the freedoms and way of life enjoyed by our citizens; and WHEREAS, Lincoln County seeks to honor individuals who have made countless sacrifices for freedom by placing themselves in harm’s way for the good of all; and WHEREAS, veterans continue to serve our community in the American Legion, Veterans of Foreign Wars, religious groups, civil service, and by functioning as County Veterans Service Officers in 29 states to help fellow former service members access more than $52 billion in federal health, disability and compensation benefits each year; and WHEREAS, approximately 200,000 service members transition to civilian communities annually; and an estimated 20 percent increase of service members will transition to civilian life in the near future; and WHEREAS, studies indicate that 44-72 percent of service members experience high levels of stress during transition from military to civilian life; and WHEREAS, active military service members transitioning from military service are at a high risk for suicide during their first year after military service; and WHEREAS, the National Association of Counties encourages all counties, parishes and boroughs to recognize Operation Green Light for Veterans; and WHEREAS, Lincoln County appreciates the sacrifices of our United States military personnel and believes specific recognition should be granted; NOW, THEREFORE, with designation as a Green Light for Veterans County, Lincoln County hereby PROCLAIMS November 4th through November 11th, 2025, as a time to salute and honor the service and sacrifices of those transitioning from active service; and BE IT FURTHER PROCLAIMED, that in observance of Operation Green Light, the Lincoln County Courthouse will be illuminated green; and BE IT FURTHER PROCLAIMED, that Lincoln County encourages its citizens in patriotic tradition to recognize the importance of honoring all those who made immeasurable sacrifices to preserve freedom by displaying green lights in a window of their place of business or residence from November 4th through the 11th, 2025. South Dakota State University is looking for firms interested in providing professional Engineering services for the design, bidding, and construction administration for the UNIVERSITY STUDENT UNION MECHANICAL UPGRADES PROJECT (OSE # R0326-17X/DEL) at South Dakota State University in Brookings, South Dakota, 57007.
Services will include a comprehensive systems review, documentation of existing conditions, design development, preparation of bid documents, and construction administration. The project scope will be prioritized based on the findings from the investigation and documentation of facility needs, with construction activities scheduled to occur in multiple phases.
Current considerations include connecting the building to the campus chilled water distribution system (piping connections are already in place within the building), upgrading or replacing air handling units, implementing building control system upgrades, and replacing sanitary piping systems. Additional improvements may be identified and incorporated as part of the ongoing planning process.
Firms wishing to be considered for this project should send a statement of interest that outlines the qualifications and experience as it pertains to this project. Statements of Interest should at a minimum include the following:
