RESOLUTION NO. 25-25
A RESOLUTION AMENDING THE SHAPE SIOUX FALLS 2040 COMPREHENSIVE PLAN.
WHEREAS, the Planning Commission has proposed a plan for the physical development of the municipality and including areas outside the boundary and within its planning jurisdiction; and
WHEREAS the Planning Commission held a public hearing on April 2, 2025, to gain input from the public; and
WHEREAS, the City Council held a public hearing on May 6, 2025, to gain input from the public; and
WHEREAS, the comprehensive plan shows the Planning Commission’s recommendations of guiding and accomplishing a coordinated, adjusted, and harmonious development of the municipality, which will, in accordance with existing and future needs, best promote health, safety, morals, order, convenience, prosperity or the general welfare, as well as efficiency and economy in the process of development;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
That Map 2.A: Development Areas of the Shape Sioux Falls 2040 Comprehensive Plan be amended as attached hereto.
That Map 2.B: Sanitary Availability of the Shape Sioux Falls 2040 Comprehensive Plan be amended as attached hereto.
That Map 2.C: Water and Roads of the Shape Sioux Falls 2040 Comprehensive Plan be amended as attached hereto.
That Map 2.D: Public Facilities and Proposed Drainage Basins of the Shape Sioux Falls 2040 Comprehensive Plan be amended as attached hereto.
Said plan shall be on file and is available for public inspection by any interested person in the office of the City Clerk, the City Planning Office, and the City website.
The City shall publish the resolution, without attachments, after its passage.

A RESOLUTION DECLARING CERTAIN EQUIPMENT OF THE CITY SURPLUS AND AUTHORIZING THE GIFTING TO SANFORD HEALTH.
WHEREAS, the City owns nine digital and two static score tables; and
WHEREAS, pursuant to SDCL 6-5-2, any political subdivision may convey and transfer any real or personal property which is held or owned by it, the title to which has been obtained and which is not held for public use or which is about to be abandoned for public purposes, to another political subdivision or nonprofit corporation for public, charitable, or humanitarian purposes and accommodation without offering the property for sale and without requiring the political subdivision or nonprofit corporation to pay for the property; and
WHEREAS, pursuant to SDCL 6-13-1, the governing board of a political subdivision may sell, trade, loan, destroy, or otherwise dispose of any land, structures, equipment, or other property which the governing board has, by appropriate motion, determined is no longer necessary, useful, or suitable for the purpose for which it was acquired; and
WHEREAS, the above-described personal property is no longer necessary, useful, or suitable for the purpose for which it was acquired by the City and has been declared as surplus; and
WHEREAS, Sanford Health finds it desirable to acquire said property; and
WHEREAS, Sanford Health is a South Dakota domestic nonprofit corporation;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That the recitals above are adopted and are incorporated herein by this reference as if set out in full.

Kym Christiansen, Commission Recorder, was present for the public hearing to consider a Special Event On-Sale Wine Retailers License and Special Event Malt Beverage Retailer’s License for the Siouxland Renaissance Association at the W.H. Lyon Fairgrounds on June 7th and 8th. The application was provided to the Sheriff’s Office, State’s Attorney’s Office, and Planning Department for review and there were no objections or concerns reported.

Upon the request of Maria Munkvold, Emergency Management Assistant Director, MOTION by Kippley, seconded by Heisey, to Authorize the Minnehaha County Sheriff’s Office to Apply for the Walmart Community Grant Program. By roll call vote: 3 ayes.
PRESENTATION
Kari Benz, Human Services Director, and Lori Montis, Assistant Human Services Director, presented the Human Services Annual presentation. Discussion followed on efficiencies being implemented for 2025 and 2026, goals and significant projects or initiatives for 2026, and potential impacts on the FY2026 budget.
WHEEL TAX BRIEFING
Jacob Maras, Highway Superintendent, provided a briefing on Highway Revenue and Wheel Tax. Discussion followed about the history of the wheel tax, comparison to neighboring counties, revenue per year compared to project cost increases, rising costs for pavement management, safety improvements, and the 5-year plan for the department.
PURCHASE AUTHORIZATION
Upon the request of Jacob Maras, Highway Superintendent, MOTION by Kippley, seconded by Heisey, to Authorize the Highway Department to Purchase up to $130,000 of Metal Culverts from Beadle County’s Metal Culvert Bid. By roll call vote: 3 ayes.
PRESENTATION
Tom Greco, Commission Administrative Officer, presented the Commission Office Annual Presentation. Discussion followed on the organization of the department, the 2024 annual snapshot, 2025 major projects, and the 2026 project outlook.

Anna Vorhes, Siouxland Renaissance Association, invited the Minnehaha County Commission to the Renaissance Festival on June 7th and 8th, 2025.

Commissioner Heisey reported on the construction occurring at the Museum and meeting with various department heads regarding FY 2026 requests.
Commissioner Bleyenberg reported on the recent School/City/County meeting with a presentation on the Juvenile Justice Center, and meeting with representatives from the Glory House.
Commissioner Kippley reported on the recent meeting of the Minnehaha County Planning Commission and the upcoming joint meeting with the City of Dell Rapids.

CONVENED AT 8:00 AM on May 6, 2025, pursuant to adjournment on April 1, 2025. COMMISSIONERS PRESENT WERE: Bleyenberg and Kippley; Auditor Anderson, Director of Facilities and Construction Kriens, and Commission Administrative Officer Greco. Commissioner Karsky was absent. Commissioner Beninga was present via electronic means. Also present were Kym Christiansen, Commission Recorder, and Eric Bogue, Chief Civil Deputy State’s Attorney.

JUVENILE JUSTICE PROJECT
Tom Greco, Commission Administrative Officer, and representatives from Architecture Incorporated, Henry Carlson Construction, and Tegra Group, provided an update on the proposed addition of unfinished shell space to the Juvenile Justice Center project Phase II Footprint. Discussion followed on the shell space plan, budget impact on the project, and shell space impacts. It was the consensus of the building committee to move forward with the addition of the shell space.
Commissioner Heisey arrived at 8:08 a.m.
CONDITION ASSESSMENT
Mark Kriens, Director of Facilities and Construction, provided a Fairgrounds EXPO Building Condition Assessment Presentation. Discussion followed on the condition of the present building, an opinion of the probable cost of the work to be completed, an update on the civil action related to the deed restrictions, and next steps to address the findings of the report. The committee agreed that the report should be shared and discussed with the Fair Board at one of their future meetings.

Submission Withdrawal
Submissions may be withdrawn by submitter upon written request any time prior to the submission.
Submission Acceptance
The Construction Manager and/or Owner will review and score submitted Preapproval Forms based upon an objective scoring process and statutory criteria. Submissions meeting or exceeding minimum scoring criteria shall be deemed as an approved bidder for the project. The Construction Manager and/or Owner retain the rights to reject any/all submission documents if documentation is deemed flawed, incomplete, or insufficient to properly score.
All submitters must complete and submit the correct Prequalification Forms and supporting documentation to be considered responsive.

Notice of Public Hearing to Adopt Rules
A public hearing will be held at 101 N. Main Ave., in the First Dakota National Bank building in room 306, Sioux Falls, South Dakota on June 12, 2024 at 9:00 a.m. (CT)/ 8:00 a.m. (MT). The public hearing will also be accessible via Microsoft Teams (Meeting ID: 213 526 357 567 3 and Passcode: o48An7k7) to consider the adoption and amendment of proposed Administrative Rules of South Dakota numbered
§§ 20:61:01 and 20:61:04.
The effect of the rules will be updates to the Emergency Medical Services personnel scope, enacting a community paramedic endorsement, and updating language regarding ambulance drivers and supervision requirements.
The reason for adopting the proposed rules is prompted by enacted legislation updates to the Emergency Medical Services practice act.
Persons interested in presenting amendments, data, opinions, and arguments for or against the proposed rules may appear in-person at the hearing, or mail or e-mail them to Board of Medical and Osteopathic Examiners, 101 N. Main Ave. Suite 301, Sioux Falls, SD 57104 or SDBMOE@state.sd.us. The deadline to submit any such written comments for consideration must reach the Board by June 6, 2025.
After the written comment period, the Board of Medical and Osteopathic Examiners will consider all written and oral comments it receives on the proposed rules. NOTICE OF TEMPORARY RESTRAINING PROVISIONS
South Dakota law provides that upon the filing and service of the Summons and Complaint on the Defendant, a Temporary Restraining Order shall be in effect against both parties until the final decree is entered or until further order of the court.
TEMPORARY RESTRAINING ORDER
By Order of the Court, you are:
(1) Restrained from molesting or disturbing the peace of the other party; and
(2) Restrained from removing any minor children of the parties from the state without the written consent of the other party or an order of the court.
INITIAL CUSTODY ORDER
South Dakota law, SDCL § 25-4A-11, provides that upon the filing and service of a summons and complaint for divorce or separate maintenance or any other custody action or proceeding, the attached standard guidelines become an order of the Court. Any minor child of the marriage shall remain in the custody of the parent who has been the primary caregiver for the minor child for the majority of time in the twelve months preceding the filing of the summons and complaint, who, in this case, is the Plaintiff, unless the parties agree otherwise. The standard guidelines shall apply and continue in effect, unless the parties agree, or the court orders otherwise. Imposition of the standard guidelines creates no presumption as to who may be awarded custody at any hearing.
The guidelines are also, pursuant to SDCL § 25-4A-14, subject to any provisions established by a South Dakota court in a temporary or permanent domestic protection order, an order arising out of an abuse or neglect proceeding, as bond condition arising out of a criminal case, and an order in any other proceeding affecting child custody or support.
If either party objects to this initial custody and visitation order, the Court shall order a hearing which shall be held not later than 30 days after the date of the objection. The Court shall then issue its temporary custody and visitation order after considering the best interest of the children consistent with the provisions of SDCL § 25-4-45.
IF EITHER PARTY VIOLATES THE TEMPORARY RESTRAINING ORDER OR INITIAL CUSTODY ORDER, THAT PARTY MAY BE HELD IN CONTEMPT OF COURT AND SUBJECT TO SANCTIONS.
ORDER FOR COURT-APPROVED PARENTING EDUCATION
South Dakota law, Supreme Court Rule 22-09, provides that the parties to any action which involves the issues of child custody or parenting time will be required to participate in a court-approved course to educate the parties concerning the impact of the action on the child or children. The course shall be completed within sixty days of the service of the summons and complaint, petition or motion in any action involving child custody or parenting time. Participation in the course may only be waived or delayed by the Judge presiding over the action for good cause shown. Good cause includes but is not limited to a default by one of the parties or a showing that the parties have previously participated in a court-approved course or its equivalent within the past five years.
Participation in the course is not required for a protection order proceeding or if the proceeding involves termination of parental rights of any of the parties. A final decree shall not be granted for a final order shall not be entered until both parties have complied with this requirement, unless participation in the course is waived or delayed for good cause or is otherwise not required. Each party shall be responsible for arranging their participation in the course and for payment of the costs of participation in the course.
Each party shall submit certification of completion of the course to the court prior to the granting of a final decree or the entry of an order, unless participation in the course is waived or delayed for good cause or is otherwise not required as set forth herein. If participation in the court-approved course is waived or delayed for good cause or is otherwise not required under this section, the Judge presiding over the action may order that the parties receive the information in an alternative format.
The State Court Administrator’s Office shall certify approved courses for parties required to participate in a course. Approved courses may include those provided by a public or private entity. At a minimum and as appropriate, an approved course shall include information related to the effects of separation or divorce on children, co-parenting skills and responsibilities, children’s needs and coping techniques, the options for conflict resolution for parenting time and custodial disputes and the financial responsibilities of parents.
