STC Instructor and Service to Community Day Coordinator Kristin Wellnitz shared Southeast Technical College’s Service to Community Days were off to a great spring start as STC partnered with the Sioux Falls chapter of Sleep in Heavenly Peace to build 86 builds for children in the community. The volunteer event was the largest single-day event in STC history with 367 volunteers contributing more than 464 community service hours. Community outreach is an integral part of learning.

Action ST00914 Vice President of Finance Christine Goldsmith provided the Proposed FY26 Budget report (MRF #670). Highlights of the report included an overall increase to the budget of 1.46% compared to the prior year for a total budget of $40,019,640. Also, a proposal to include facility fees paid by students as a pass thru account to more fully represent the program costs from student perspective. Following general discussion, a motion was made by Marc Murren and seconded by Gail Swenson, three (3) votes “yes” on roll call approving the proposed FY26 budget and schedule the public hearing for the final budget during the June 2025 meeting.

SCHOOL BOARD MEETING
The School Board of the Sioux Falls School District 49-5 of Minnehaha County, South Dakota, was called into regular session, pursuant to due notice, on Monday, April 28, 2025, at
5:30 pm in the Instructional Planning Center, 201 East 38th Street, Sioux Falls, South Dakota, with the following members present: Marc Murren, Gail Swenson, Nan Kelly, and Vice President Dawn Marie Johnson, and President, Carly Reiter. Absent: none. Dr. Jane Stavem, Superintendent of Schools, Kenneth Mosser, Comptroller, and Brett Arenz, In-House Counsel, were also present.
DeeAnn Konrad, Community Relations Coordinator, presented 19 National Merit Finalists for the 2024-2025 school year. Students and parents were able to celebrate at a reception prior to the school board meeting. Landon Gross, a Jefferson High School senior, was also recognized as a U.S. Presidential Scholar Finalist. Patrick Purdy, Marcella LeBeau Elementary School Principal, announced the school’s new mascot and colors. The school will be known as the Marcella LeBeau Bears and will have a color scheme of blues, greens, and purples, inspired by the natural South Dakota landscape and the flag of the Cheyenne River Sioux Tribe.

Shane Wuebben, Coordinator-Fine Arts, presented the Fine Arts Implementation Curriculum report as follows (MRF#19606):
The Sioux Falls School District (SFSD) Fine Arts program engages students in creative experiences that build artistic skills, critical thinking, and lifelong appreciation for the arts. In March 2024, the School Board approved a new K-12 Fine Arts curriculum, aligned with the updated 2022 South Dakota Fine Arts Standards for dance, music, theatre, and visual arts.
The three-year curriculum development process began in Fall 2022 with a K-12 Steering Committee, comprised of teachers, administrators, parents, and community members. Writing teams met regularly to develop a vision, mission, goals, pacing guides, assessments, and rubrics to ensure consistent, high-quality instruction. Select teachers piloted materials in the 2023-2024 school year, providing valuable feedback to refine the curriculum.
A major focus of the work has been on creating clear, District-wide assessments and course-specific grading rubrics. Professional development for teachers began in Summer 2024 and continues throughout the 2024-2025 school year through in-service days and additional training sessions.
Instructional support is provided by a full-time music coach and a part-time visual arts coach, who work alongside teachers, lead professional learning, and develop resources. Ongoing teacher feedback has identified professional development priorities in areas like digital art, fiber arts, percussion skills, jazz techniques, and technical theatre.
This work ensures students develop the skills, confidence, and opportunities to enjoy and pursue the arts throughout their lives. A motion was made by Gail Swenson and seconded by Marc Murren five (5) votes “yes” on roll call acknowledging the Fine Arts report.

A motion was made by Marc Murren and seconded by Gail Swenson, five (5) votes “yes” on roll call, authorizing an executive session of the School Board to consider student issues in accordance with SDCL §1-25-2 (2). The School Board, thereupon went into executive session at 6:03 p.m. The School Board came out of executive session at 6:10 pm.

This executive session was held in accordance with Sioux Falls School District Policy/Regulation JK/JK-R, SDCL §13-32-4, 4.2 and 7 and South Dakota Administrative Rule 24:07:04:03. Following general discussion and a review of the evidence, a motion was made by Gail Swenson and seconded by Nan Kelly, five (5) votes “yes” on roll call, to uphold the recommendation of the administration to expel two (2) students for twelve (12) months.

SECOND READING & PUBLIC HEARING was held as advertised for an Ordinance of Lincoln County, SD, amending Chapter 154: Zoning, Section 154.021, Definitions; Section 154.058, Conditional Uses (A-1 Agricultural District); Section 154.178, Conditional Uses (RC Recreation/Conservation District); Section 154.254, Additional Use Regulations; and Section 154.379(A), Notification, for the regulation of carbon oxide pipelines, carbon oxide pump stations, carbon oxide mainline valves, carbon oxide capture facilities, and carbon oxide launcher and receiver facilities. Toby Brown, Planning and Zoning Director, presented the information contained within the Ordinance and was available to answer questions. The Planning Commission recommends approval (5-0-1). Proponent testimony was heard, no one spoke in opposition.
A MOTION TO APPROVE AN ORDINANCE OF LINCOLN COUNTY, SD, AMENDING CHAPTER 154 OF THE LINCOLN COUNTY CODE OF ORDINANCES TO PROVIDE FOR THE REGULATION OF CARBON OXIDE PIPELINES, CARBON OXIDE PUMP STATIONS, CARBON OXIDE MAINLINE VALVES, CARBON OXIDE CAPTURE FACILITIES, AND CARBON OXIDE LAUNCHER AND RECEIVER FACILITIES. BE IT ORDAINED BY LINCOLN COUNTY, SD: Section 1. That the following definition in § 154.021 of the Lincoln County Code of Ordinances is hereby amended to read as follows: NEIGHBORHOOD UTILITY FACILITY. Telephone, electric, and cable television lines, poles, and equipment; water, oil, or gas pipes; mains and valves; sewer pipes and valves; lift stations; telephone exchanges and repeaters; and all other facilities and equipment (excluding buildings that exceed 120 square feet of roof area) necessary for conducting a service by governmental agencies or commissions or public or private utilities. This definition does not include an electrical substation, carbon oxide pipeline, carbon oxide pump station, carbon oxide mainline valve, carbon oxide capture facility, or carbon oxide launcher and receiver facility. Section 2. That § 154.058, conditional uses, in the A-1 Agricultural District, is hereby amended by adding new uses as follows: (FF) Carbon oxide pipeline in conformance with § 154.254; (GG) Carbon oxide pump station, carbon oxide mainline valve, carbon oxide capture facility, or carbon oxide launcher and receiver facility in conformance with § 154.254; Section 3. That § 154.178, conditional uses, in the RC Recreation/Conservation District, is hereby amended by adding a new use as follows: (S) Carbon oxide pipeline in conformance with § 154.254; (T) Carbon oxide pump station, carbon oxide mainline valve, carbon oxide capture facility, or carbon oxide launcher and receiver facility in conformance with § 154.254; Section 4. That § 154.254, CARBON OXIDE PIPELINES, CARBON OXIDE PUMP STATIONS, CARBON OXIDE MAINLINE VALVES, CARBON OXIDE CAPTURE FACILITIES, AND CARBON OXIDE LAUNCHER AND RECEIVER FACILITIES, is hereby added as follows: (A)Intent and purpose. (1) The county worked for two years to prepare a Comprehensive Plan to address the planning requirements of state law while also providing a sound and logical basis for county growth management strategies; and to provide some predictability about the potential land uses and timing of development so that public, nonprofit, and private sectors can make informed decisions in the area of real estate and capital investments. (2) Multiple pipeline routes have been brought forward to the public from multiple pipeline companies. (3) The South Dakota Public Utilities Commission determined in September 2023, during permit hearings for a carbon oxide pipeline, that counties could regulate the siting of carbon oxide pipelines by rejecting Summit’s initial permit application, stating it would violate state and county ordinances. (4) Plume models have not been made available to the residents of Lincoln County. (5) Property owners may wish to build additional buildings on property without concern that the established setbacks were from a residence and not a property line. (6) The South Dakota Public Utilities Commission used SDCL § 49-41B-6 to define an “affected area” for communications of 10,560 ft. (B) Setbacks. (1) Carbon Oxide Pipeline Setback. There shall be a minimum setback of 500 feet from a carbon oxide pipeline to a property line. The setback shall be measured from the pipeline to the closest point of the property line. Any authorized person that is within the minimum set back may waive the set back through a written instrument to be filed with the Lincoln County Register of Deeds. This waiver would run with the land. (2) Carbon Oxide Pump Station, Carbon Oxide Mainline Valve, Carbon Oxide Capture Facility, or Carbon Oxide Launcher and Receiver Facility Setback. There shall be a minimum setback of 1,320 feet from a carbon oxide pump station, carbon oxide mainline valve, carbon oxide capture facility, or carbon oxide launcher and receiver facility to a dwelling, church, school or business. The setback shall be measured from outermost point of the use to the closest point of the dwelling, church, school or business. Any authorized person that is within the minimum setback may waive the setback through a written instrument to be filed with the Lincoln County Register of Deeds. This waiver would run with the land. An easement signed and filed with the Lincoln County Register of Deeds prior to or after this ordinance takes effect shall constitute a waiver. (3) No carbon oxide pipeline, carbon oxide pump station, carbon oxide mainline valve, carbon oxide capture facility, or carbon oxide launcher and receiver facility shall be located within any municipal jurisdiction as set forth under SDCL § 11-6-26. Any municipality may, by resolution of the governing body, waive this provision. (C) Application requirements. (1) Application materials shall include complete plume dispersion modeling, with no redactions, to the Lincoln County Planning and Zoning Department. This plume model(s) shall estimate the maximum distance that carbon oxide may disperse at a level likely to be fatal to persons and livestock and at a level immediately dangerous to life and health for a worst-case discharge from each of the pipeline diameters used for carbon oxide line sections in the county. The applicant shall include all data, information, and assumptions used to produce the model output. (2) Upon a finding that the plume dispersion modeling inadequately estimates the risk to County residents, the Planning and Zoning Department, in conjunction with the Board of Commissioners, may perform an independent plume model study for some or all of the carbon oxide pipeline in the county or for specific locations that may be subject to further development. The Department may assess a fee against the applicant for the cost of such study. (3) In the event that the County Planning and Zoning Department finds that a minimum setback required by § 154.254(B) would not adequately protect future land use and development, the Department may increase the setback distance or may require the applicant to provide information, funding, equipment, or training to County emergency response agencies or the public to mitigate risks to public health and welfare. (4) All plume model studies provided or performed during this process shall become public record in their entirety upon submission. (5) Any carbon oxide pipeline, carbon oxide pump station, carbon oxide mainline valve, carbon oxide capture facility, or carbon oxide launcher and receiver facility shall be in compliance with all federal, state, and local rules, regulations, and permitting requirements. (6) The Planning Director may request additional information reasonably related to a carbon oxide pipeline, carbon oxide pump station, carbon oxide mainline valve, carbon oxide capture facility, or carbon oxide launcher and receiver facility not contained in these regulations. (D)Other requirements. (1) If a conditional use is granted for a carbon oxide pipeline, the applicant or actual operator or their successors, assigns and agents shall pay to the County an annual fee of $5.00 per linear foot of pipeline within the County. The fee shall be used to defray the direct and indirect costs associated with general administration and enforcement of this section and shall be adjusted on January 1 of each year, commencing on January 1, 2026, by 2.5%. The fee shall be payable by January 20th of each year and deposited in the general fund of the County. (2) Depth of cover. There shall be a minimum depth of cover of seven (7) feet for any carbon oxide pipeline within the county. The applicant or actual operator or their successors, assigns and agents shall maintain the minimum depth of cover. Section 5. That § 154.379(A), planning commission hearing, is hereby amended as follows: (A) Notification. The applicant shall notify all property owners (inclusive of contract for deed buyers at last known address) of land lying within 500 feet, inclusive of right-of-way, of the outer boundaries of the property involved in the request. (1) For applicable commercial WECS and CAFO applications, the applicant shall notify all property owners (inclusive of contract for deed buyers at last known address) of land lying within one mile, inclusive of right-of-way, of the outer boundaries of the property involved in the request. (2) For applicable carbon oxide pipeline, carbon oxide pump station, carbon oxide mainline valve, carbon oxide capture facility, or carbon oxide launcher and receiver facility applications, the applicant shall notify all property owners (inclusive of contract for deed buyers at last known address) of land lying within two miles, inclusive of right-of-way, of the outer boundaries of the property involved in the request. (3) The Planning Department shall provide the applicant with “Notice of Hearing” forms for this purpose, and the notices shall be sent by the applicant to all parties on the aforementioned list by first class mail no less than ten calendar days prior to the public hearing on the request held by the Planning Commission. The applicant shall sign an affidavit certifying that the required mailing was completed. The affidavit shall be provided to the Planning Department prior to the Planning Commission meeting. NOTICE OF TEMPORARY RESTRAINING PROVISIONS
South Dakota law provides that upon the filing and service of the Summons and Complaint on the Defendant, a Temporary Restraining Order shall be in effect against both parties until the final decree is entered or until further order of the court.
TEMPORARY RESTRAINING ORDER
By Order of the Court, you are:
(1) Restrained from molesting or disturbing the peace of the other party; and
(2) Restrained from removing any minor children of the parties from the state without the written consent of the other party or an order of the court.
INITIAL CUSTODY ORDER
South Dakota law, SDCL § 25-4A-11, provides that upon the filing and service of a summons and complaint for divorce or separate maintenance or any other custody action or proceeding, the attached standard guidelines become an order of the Court. Any minor child of the marriage shall remain in the custody of the parent who has been the primary caregiver for the minor child for the majority of time in the twelve months preceding the filing of the summons and complaint, who, in this case, is the Plaintiff, unless the parties agree otherwise. The standard guidelines shall apply and continue in effect, unless the parties agree, or the court orders otherwise. Imposition of the standard guidelines creates no presumption as to who may be awarded custody at any hearing.
The guidelines are also, pursuant to SDCL § 25-4A-14, subject to any provisions established by a South Dakota court in a temporary or permanent domestic protection order, an order arising out of an abuse or neglect proceeding, as bond condition arising out of a criminal case, and an order in any other proceeding affecting child custody or support.
If either party objects to this initial custody and visitation order, the Court shall order a hearing which shall be held not later than 30 days after the date of the objection. The Court shall then issue its temporary custody and visitation order after considering the best interest of the children consistent with the provisions of SDCL § 25-4-45.
IF EITHER PARTY VIOLATES THE TEMPORARY RESTRAINING ORDER OR INITIAL CUSTODY ORDER, THAT PARTY MAY BE HELD IN CONTEMPT OF COURT AND SUBJECT TO SANCTIONS.
ORDER FOR COURT-APPROVED PARENTING EDUCATION
South Dakota law, Supreme Court Rule 22-09, provides that the parties to any action which involves the issues of child custody or parenting time will be required to participate in a court-approved course to educate the parties concerning the impact of the action on the child or children. The course shall be completed within sixty days of the service of the summons and complaint, petition or motion in any action involving child custody or parenting time. Participation in the course may only be waived or delayed by the Judge presiding over the action for good cause shown. Good cause includes but is not limited to a default by one of the parties or a showing that the parties have previously participated in a court-approved course or its equivalent within the past five years.
Participation in the course is not required for a protection order proceeding or if the proceeding involves termination of parental rights of any of the parties. A final decree shall not be granted for a final order shall not be entered until both parties have complied with this requirement, unless participation in the course is waived or delayed for good cause or is otherwise not required. Each party shall be responsible for arranging their participation in the course and for payment of the costs of participation in the course.
Each party shall submit certification of completion of the course to the court prior to the granting of a final decree or the entry of an order, unless participation in the course is waived or delayed for good cause or is otherwise not required as set forth herein. If participation in the court-approved course is waived or delayed for good cause or is otherwise not required under this section, the Judge presiding over the action may order that the parties receive the information in an alternative format.
The State Court Administrator’s Office shall certify approved courses for parties required to participate in a course. Approved courses may include those provided by a public or private entity. At a minimum and as appropriate, an approved course shall include information related to the effects of separation or divorce on children, co-parenting skills and responsibilities, children’s needs and coping techniques, the options for conflict resolution for parenting time and custodial disputes and the financial responsibilities of parents.
