ORDINANCE NO. 15-25
AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AMENDING THE CODE OF ORDINANCES OF THE CITY BY AMENDING CHAPTER 76: TRAFFIC REGULATIONS, CHAPTER 93: NUISANCES, AND CHAPTER 96: STREETS AND SIDEWALKS TO ALLOW RESTRICTED EXHIBITION DRIVING EVENTS.
BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That Section 76.077 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 76.077 EXHIBITION DRIVING.
Any person who drives a vehicle within the limits of the city in a manner that creates or causes unnecessary engine noise, or tire squeal, skid or slide upon acceleration or stopping; or that simulates a temporary race; or that causes the vehicle to unnecessarily turn abruptly or sway, shall be guilty of exhibition driving. Exemption: Nothing in this section shall prohibit participation in a restricted exhibition driving event that is permitted pursuant to § 96.181(c). A restricted exhibition driving event shall be prohibited on any public right-of-way, including any street, highway, sidewalk, alley or easement.
Section 2. That Section 93.002 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 93.002 NOISES PROHIBITED.
(a) General prohibitions. It shall be unlawful for any person or for any person to allow another person to make, cause to be made or continued any noise disturbance within the limits of the city. This includes the following specific prohibitions in division (b) below, along with exceeding the decibel levels set forth in this subchapter or granted through a sound permit.
(b) Specific prohibitions. The following acts are declared to be in violation of this subchapter:
(1) Horns and signaling devices. Sounding of any horn or signaling device on any truck, automobile, motorcycle, emergency vehicle or other vehicle on any street or public place within the county or any city therein except as a danger warning signal or the sounding of any signaling device for an unnecessary and unreasonable period of time;
(2) Radios, television sets, musical instruments and similar devices.
A. Using, operating or allowing the use or operation of any radio receiving set, musical instrument, television, phonograph, drum or other machine or device for the production or reproduction of sound in a manner as to violate § 93.003 or cause a noise disturbance; or
B. Using, operating or allowing the use or operation of any device between the hours of 10:30 p.m. and 6:00 a.m. the following day in a manner as to be plainly audible at the property boundary of the source or plainly audible at 50 feet from the device when operated within a vehicle parked on a public right-of-way or plainly audible at 100 feet from the device when operated within a moving vehicle.
(3) Public loudspeakers. Using, operating or allowing the use or operation of a loudspeaker or sound amplifying equipment in a fixed or movable position or mounted upon any sound vehicle in or upon any street, alley, sidewalk, park, place or public property for the purpose of commercial advertising, giving instructions, directions, talks, addresses, lectures or transmitting music to any persons or assemblages of persons in a manner as to violate § 93.003 or cause a noise disturbance;
(4) Hawkers and peddlers. Selling anything by outcry within any area of the city therein zoned primarily for residential uses in a manner as to violate § 93.003 or cause a noise disturbance. The provisions of this division (b)(4) shall not be construed to prohibit the selling by outcry of merchandise, food and beverages at licensed sporting events, parades, fairs, circuses and other similar licensed public entertainment events, or occasional sale of property by public auction;
(5) Loading operation. Loading, unloading, opening or otherwise handling boxes, crates, containers, garbage containers or other objects between the hours of 10:30 p.m. and 6:00 a.m. the following day in a manner as to violate § 93.003 or cause a noise disturbance;
(6) Enclosed places of public entertainment. Operating or permitting to be operated in any place of public entertainment any loudspeaker or other source of sound which produces, at a point that is normally occupied by a customer, maximum sound pressure levels of 100 dB(A) as read with the slow response on a sound level meter, unless a conspicuous and legible sign at least 225 square inches in area is posted near each public entrance stating: “WARNING: SOUND LEVELS MAY CAUSE HEARING IMPAIRMENT.” This division (b)(6) shall not be construed to allow the operation of any loudspeaker or other source of sound in a manner as to violate § 93.003;
(7) Fireworks or explosives. The use of explosives or fireworks, or the firing of guns or other explosive devices so as to be audible across a property boundary or on a public space or right-of-way, without first obtaining a permit as provided by § 93.007. This division (b)(7) shall not be construed to permit conduct prohibited by other statutes, ordinances or regulations governing the activity.
(8) Racing events. Permitting any motor vehicle racing event at any place in a manner as to violate § 93.003 or cause a noise disturbance, without first obtaining a permit as provided by § 93.006 and § 96.183;
(9) Powered model mechanical devices. The flying of a model aircraft powered by internal combustion engines, whether tethered or not, or the firing or operating of model rocket vehicles or other similar noise-producing devices, between the hours of 10:30 p.m. and 6:00 a.m. the following day; or in a manner as to violate § 93.003 or cause a noise disturbance;
(10) Dynamic braking devices. Operating any motor vehicle with a dynamic braking device engaged except for the aversion of imminent danger;
(11) Defect in vehicle. Operating or permitting to be operated or used any truck, automobile, motorcycle or other motor vehicle which, by virtue of disrepair or manner of operation, violates § 93.003 or causes a noise disturbance;
(12) Standing motor vehicles. The operating or causing or permitting to be operated any motor vehicle or any auxiliary equipment attached thereto in a manner as to violate § 93.003 or cause a noise disturbance for a consecutive period longer than 15 minutes during which the vehicle is stationary in a residential zone;
(13) Noise sensitive zones. Creating noise in excess of the standards as defined in § 93.003 within the vicinity of any school, hospital, institution of learning, court or other designated area where exceptional quiet is necessary, while the school, hospital, institution, court or other area is in use;
(14) Bells and alarms. Sounding, operating or permitting to sound or operate an electronically amplified signal from any bell, chime or clock, including but not limited to bells, chimes or clocks in schools, houses of religious worship or governmental buildings, which fails to meet the standards set forth in § 93.003;
(15) Fixed sirens, whistles and horns. The sounding or causing the sounding of any whistle, horn or siren as a signal for commencing or suspending work, or for any other purpose except as a sound signal of imminent danger, in a manner as to violate § 93.003 or cause a noise disturbance; and/or
(16) Recreational vehicles and snowmobiles. Operating a recreational vehicle or snowmobile in a manner which violates § 93.003 or causes a noise disturbance.
Section 3. That Section 93.006 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 93.006 EXCEPTIONS.
The following exceptions shall be allowed between the hours of 6:00 a.m. and 10:30 p.m. in residential or commercial land use zones. These uses and activities are not required to obtain a sound permit unless otherwise stated:
(a) School events. School outdoor concerts and music activities including marching band activities, sporting activities with musical components, art festivals and student fund-raisers;
(b) Religious events. Religious organizations conducting worship services outdoors;
(c) City-sponsored events. The city, including, but not limited to, parks and recreation department-sponsored activities;
(d) Private events in city parks. Private events in city parks with a duration of one hour or less;
(e) Construction work. Operating, or causing to be used or operated, any equipment used in construction, repair alteration or demolition work on buildings, structures, streets, alleys or appurtenances in any land use district where the operation causes a sound pressure level no more than 75 dbA measured at a distance of 50 feet;
(f) Domestic power equipment. Operating or permitting to be operated any power equipment rated five horsepower or less used for home or building repair or grounds maintenance, including, but not limited to, a power saw, sander, lawn mower or garden equipment in residential or commercial zones at a sound pressure no more than 75 dbA measured at a distance of 50 feet;
(g) Commercial power equipment. Operating or permitting to be operated any power equipment, except construction equipment used for construction activities, rated more than five horsepower, including, but not limited to chain saws, pavement breakers, log chippers or powered hand tools in residential or commercial land use districts at a sound level no more than 82 dbA measured at a distance of 50 feet;
(h) Refuse compacting vehicles or units. Operating or permitting to be operated or used any refuse compacting vehicle or unit at a sound level no more than 75 dbA measured at a distance of 50 feet; and
(i) Permits. Permits approved by the health director or his or her designated agent, and a restricted exhibition driving event permit in accordance with § 96.183.
Section 4. That Section 93.008 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 93.008 MOTOR VEHICLE NOISE.
(a) Unless permitted under § 93.006 and § 96.183, no person shall drive or move or cause or knowingly permit to be driven or moved a motor vehicle or combination of vehicles at any time in a manner as to exceed the following noise limits for the category of motor vehicle shown. Noise shall be measured at a distance of at least 25 feet (7.5 meters) and at a height of at least 4 feet (1.2 meters) above the immediate surrounding surface.
Sound Pressure Level dB(A)
Speed Limit 40 mph or less Speed Limit over 40 mph
Motor vehicles with a manufacturer’s gross vehicle weight rating (GVWR) or gross combination weight rating (GCWR) of 10,000 pounds or more, or any combination of vehicles towed by the motor vehicle 90 94

(b) This section shall apply to the total noise from a vehicle or combination of vehicles and shall not be construed as limiting or precluding the enforcement of any other provisions of this subchapter relating to motor vehicle mufflers for noise control.
(c) No person shall operate or cause to be operated any motor vehicle within the city unless the exhaust system of the vehicle is:
(1) Free from defects which affect sound reduction;
(2) Equipped with a muffler or other noise dissipative device; and
(3) Not equipped with any cutout, bypass or similar device.
Section 5. That Section 96.180 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 96.180 DEFINITIONS.
For the purposes of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
ASSEMBLY. Any block party, demonstration, rally, gathering or group of 25 or more persons, animals or vehicles, or a combination thereof, having a common purpose, design or goal, upon any public street, sidewalk, alley or other public place, which assembly substantially inhibits the usual flow of pedestrians or vehicular travel or which occupies any public area, but does not rise to the definition of a special event.
PARADE. Any scheduled walk, demonstration, procession, motorcade consisting of 25 or more persons, animals or vehicles, or a combination thereof, having a common purpose, design, designation or goal upon any public place, which does not comply with normal and usual traffic regulations and controls.
RESTRICTED EXHIBITION DRIVING EVENT. A city-permitted event that features a vehicle(s) driving in a manner that creates or causes unnecessary engine noise, tires to squeal, skid, or slide upon acceleration or stopping, or that simulates a temporary race or causes the vehicle(s) to turn abruptly or sway.
SPECIAL EVENT.
(1) Any of the following activities involving 25 or more persons, animals or vehicles, or a combination thereof, open to the general public taking place on public space that involves a temporary and exclusive use of public space involving a substantial deviation from current legal land use or legal nonconforming use and may include, but not be limited to:
A. Amusements or carnivals;
B. Entertainment;
C. Music by way of sound amplification;
D. Dancing;
E. Dramatic or theatrical productions;
F. Festivals;
G. Parades;
H. Runs, walks, triathlons and bicycle races or rides that will not comply with the normal or usual traffic regulations or controls or are likely to impede, obstruct, impair or interfere with free flow of traffic;
I. Any activity involving the sale of merchandise, food or alcohol;
J. Any activity making use of structures not already present on the public space such as stages, booths, canopies, awnings, risers, bleachers, fences, partitions, stands or similar constructions; and
K. Any activity taking place on public space that may require for its successful execution city services to a degree significantly over and above that routinely provided under ordinary circumstances, as determined by the special events committee.
SPECIAL EVENTS. Shall not include the use of public space by governmental agencies acting within the scope of their authority.
SPONTANEOUS EVENT. An unplanned or unannounced coming together of persons, animals or vehicles as described in this section, which was not contemplated beforehand by any participants therein and which is caused by or in response to unforeseen circumstances or events and which is neither a parade nor as assembly, as defined in this section.
Section 6. That Section 96.183 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 96.183 APPLICATION FOR PERMIT; HOLD HARMLESS.
Any person desiring to conduct an assembly or special event shall not less than 60 days prior to the start date of a Class 2 or higher special event, not less than 30 days prior to the start date of a Class 3 or lower special event, not less than 14 days prior to the start date of a restricted exhibition driving event, and not less than 48 hours prior to the start of an assembly, file an application with the city upon a form to be furnished by the city, which application shall set forth the following:
(a) The name, address and telephone number of the person responsible for the assembly, restricted exhibition driving event or special event. If the sponsor includes a sponsoring organization or corporation of any kind, the applicant shall provide the name and address of the person within the sponsoring organization who will be responsible for the assembly, restricted exhibition driving event or special event requested as well as the name, address and telephone number of the organization;
(b) The nature of the proposed assembly or special event;
(c) The date, hours and location requested;
(d) An agreement to save and keep the city free and harmless from any and all loss or damages or claims for damages, including attorney’s fees and litigation costs, arising from or out of the assembly, restricted exhibition driving event or special event;
(e) An agreement to comply with all related municipal ordinances, rules, regulations and other applicable laws; and
(f) For a restricted exhibition driving event, the application shall be accompanied with written authorization from the property owner or authorized agent.
(g) Other pertinent information as may be requested.
Section 7. That Section 96.185 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 96.185 APPLICATION; REVIEW; REQUIREMENTS.
(a) No permit shall be issued if the proposed assembly, restricted exhibition driving event or special event:
(1) Will cause unreasonable injury or damage to either the space requested or any space;
(2) Conflicts with a prior permit, or a prior application that is likely to be granted, for the same space and for the same time;
(3) Will continue for a duration longer than seven days, including any setup or teardown time;
(4) Will involve such a number of persons or activities as will exceed the reasonable capacity of the space requested;
(5) Will interfere with the provision of proper fire and police protection to the area adjacent to the space requested or any other area within the city;
(6) Will adversely affect adjacent or neighboring properties by causing excessive noise or creating a nuisance;
(7) Will unreasonably interfere with the safe, orderly and expeditious movement of vehicular or pedestrian traffic;
(8) Will be conducted primarily for the purpose of private monetary gain or commercial advertisement. This subsection does not apply to an application for a restricted exhibition driving event; and
(9) Will fail to comply in any respect with the provisions of this subchapter or any other applicable law.
(b) No permit shall be issued to any applicant that has unpaid or past due fees under this subchapter for any prior special event.
(c) No permit shall be issued for any assembly or special event to be held on any arterial street between the hours of 7:00 a.m. and 9:00 a.m., 11:30 a.m. to 1:00 p.m., and 3:30 p.m. to 6:30 p.m., Monday through Friday, without provision being made for an adequate number of police officers to provide for the safe, orderly and expeditious movement of vehicular and pedestrian traffic.
(d) No permit shall be issued for any restricted exhibition driving event to be held between the hours of 10:30 p.m. and 6:00 a.m.
(e) In determining whether an application should be approved, the city may consider:
(1) Whether in holding any previous assembly, restricted exhibition driving event or special events, the applicant has conformed to all permit requirements and the provisions of this subchapter; and
(2) The financial and practical ability of the applicant to conduct the proposed assembly, restricted exhibition driving event or special event in conformance with the provisions of the permit and this subchapter.
(f) No permit shall be issued for an event within 60 days in the case of a Class 2 or higher special event, 30 days in the case of a Class 3 or lower special event, 14 days in the case of a restricted exhibition driving event or 48 hours in the case of an assembly after the application was filed with the city.
Section 8. That Section 96.186 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 96.186 PERMIT; ISSUANCE.
(a) Upon consideration of the general requirements as set forth in § 96.185, the city may issue a permit for an assembly, restricted exhibition driving event or special event and may, as part of the permit, include those conditions as deemed necessary for the preservation of the public health, safety and welfare and for the protection of the public space to be utilized or otherwise affected by the assembly, restricted exhibition driving event or special event.
(b) No permit shall be issued until the compliance bond and insurance required under this chapter, if any, have been filed with the city.
(c) Issuance of a permit shall not constitute city endorsement or sponsorship of the event, and no permittee shall represent, advertise, promote or otherwise publish any claim whatsoever related to city endorsement or sponsorship of the event.
Section 9. That Section 96.189 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 96.189 REVOCATION OF PERMIT.
(a) The city may immediately revoke any permit issued under this subchapter if it is found that the assembly, restricted exhibition driving event or special event:
(1) Is being conducted in violation of any of the terms and conditions of the permit, the provisions of this subchapter, or any applicable;
(2) Is substantially interfering with fire or police protection;
(3) Is causing physical damage to persons or property;
(4) Is causing a disturbance of the peace;
(5) Is causing a health hazard; and
(6) Is not conducted in a manner consistent with the representation set forth in the application therefor.
(b) The city may immediately revoke any permit issued under this subchapter:
(1) If an emergency arises making it impossible to assign necessary personnel to the assembly or special event required to protect the public safety; and
(2) If information is obtained after the permit is issued from which the city may reasonably conclude that the permit should have been denied.
(c) The city may also immediately revoke any permit issued under this subchapter if it finds that the required compliance bond or insurance has lapsed or has been canceled.
Section 10. That Section 96.191 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 96.191 APPEAL.
(a) Any person who is aggrieved by the denial or granting of a permit as provided in this subchapter may appeal pursuant to the procedures established by the administrative code provisions of this code according to the procedures set forth in §§ 30.040 through 30.046 of this Code.
(b) If the city denies an application or revokes an assembly, restricted exhibition driving event or special event permit, the city shall subsequently notify the applicant or permittee of the denial or revocation in writing, delivered in person or by mail to the applicant’s address stated in the application. The notice shall include the reasons for the denial or revocation and shall advise the applicant or permittee that the decision may be appealed through the procedures established by the administrative code provisions of this code according to the procedures set forth in §§ 30.040 through 30.046 of this Code.

NOTICE IS HEREBY GIVEN That the Board of Lincoln County Commissioners will meet in the Courthouse at Canton, South Dakota, on March 25, 2025, and hold a public hearing between 8:30 a.m. and adjournment, pursuant to SDCL 7-21-22, for the purpose of adopting the following supplements to the 2025 Budget: A supplement adding to the debt service TIF #8 budget for 204,000.00 for current taxes and principal payments, a supplement adding to the Commission budget to fees and contracts in the amount of $150,000.00 per resolution 2412-48 dated 12.24.2024, a supplement adding to the Coroner budget to fees and transports in the amount of $6,000.00 per resolution 2412-18 dated 12.10.2024, a supplement adding to Other Economic Assistance budget in the amount of $67,393.75 per resolution 2412-22 passed on 12.10.2024, a supplement adding to the Sheriff’s budget in the amount of $33,000.00 per resolution 2412-15 passed on 12.10.2024.
The public hearing is open to all interested parties. Anyone unable to attend the public hearing can submit written comments to the Lincoln County Auditor at 104 N. REGULAR BUSINESS:
COMMISSIONER BRIEFING: Joel Arends, Lincoln County Commissioner, presented to the Board a resolution of support to dedicate the Highway 44 Bridge in Lennox to the lasting memory of Captain Verlyn Gwen Meyer. Lincoln County Commissioner Jim Schmidt also spoke about Captain Meyer. No public input was heard.
RESOLUTION: BE IT RESOLVED: WHEREAS, SDCL Ch. 7-18 provides that the powers of a County shall be exercised by a board of county commissioners; and WHEREAS, SDCL 7-18A-2 provides that Counties have the authority to enact such resolutions as may be proper and necessary to carry into effect the powers granted to it by law; and WHEREAS, Verlyn Meyer was born near Lennox, South Dakota on September 20, 1942; and WHEREAS, Verlyn Meyer graduated from the University of South Dakota in 1964 while participating in the University’s ROTC program; and WHEREAS, Captain Meyer was assigned to the 92nd Assault Helicopter Company, 10th Aviation Battalion, 17th Aviation Group, 1st Aviation Brigade of the United States Army; and WHEREAS, Captain Meyer was the Pilot of a UH-1C gunship while supporting Task Force South; and WHEREAS, Captain Meyer’s gunship took hostile fire in Lam Dong Province in South Vietnam on August 22, 1968; and WHEREAS, Captain Meyer and all abord the gunship were Killed in Action; and WHEREAS, Captain Meyer was awarded the following military decorations: Distinguished Flying Cross, Silver Star, Air Medal, Purple Heart, United States Aviator Badge, National Defense Service Medal, Vietnam Campaign Medal, Vietnam Service Medal, Army Presidential Unit Citation, Vietnam Gallantry Cross; and WHEREAS, Captain Meyer’s selfless sacrifice in the service of the United States of America is memorialized on the National Vietnam Veterans Memorial in Washington, D.C., and WHEREAS, the City of Lennox has passed a resolution asking the State of South Dakota to rename the bridge that crosses over Long Creek on Highway 44 in the City of Lennox, South Dakota to be named the Captain Verlyn Gwen Meyer Bridge and has asked this Commission to do the same, and NOW THEREFORE BE IT RESOLVED, by the Board of County Commissioners of Lincoln County, South Dakota, to support the naming of the bridge that crosses over Long Creek on Highway 44 in the City of Lennox, South Dakota to be named the Captain Verlyn Gwen Meyer Bridge. The South Dakota Department of Transportation (SDDOT) is soliciting statements of interest and qualifications from consulting firms for both State and Local Government projects. The purpose is to select a list of consultants in each category of work, for which the SDDOT will enter into a Pre-Qualified Consultant Retainer Agreement for the years of 2026 - 2028. The SDDOT will determine the number of firms selected in each category of work based on the anticipated workload and the qualifications of the firms submitting SD DOT form 925. Firms will be evaluated using the criteria that follows:
Evaluation Criteria: (1) Specialized expertise, capabilities, and technical competence as demonstrated by the proposed approach and methodology to meet the project requirements. (20 pts possible); (2) Resources available to perform the work, including any specialized services, within the specified time limits for the project. (20 pts possible); (3) Record of past performance, including price and cost data from previous projects, quality of work, ability to meet schedules, cost control, and contract administration.
