NOTICE OF PUBLIC SALE
OFF-SALE LIQUOR LICENSE
NOTICE IS HEREBY GIVEN BY the undersigned Licensing Specialist of the City of Sioux Falls, South Dakota, that the five (5) Off-sale Liquor Licenses hereinafter described, held by the City of Sioux Falls, will be conditionally awarded under sealed bids to the highest suitable bidder(s).
All sealed bids shall be made on a form available from the City. All sealed bid envelopes shall be conspicuously marked “SEALED BID—OFF-SALE LIQUOR LICENSE, BIDDER NAME, PROPOSED ADDRESS FOR LICENSE” and submitted in person to the City Licensing Specialist or designee during regular business hours Monday through Friday, 8 a.m. to 5 p.m., beginning on Monday, July 14, 2025, through Thursday, July 31, 2025. The $100 nonrefundable bid application fee, payable to the City of Sioux Falls, shall be outside the sealed envelope.
Sealed bids will be opened at 10 a.m. on Friday, August 1, 2025, in Attorney Conference Room 103, City Hall, 224 West Ninth Street, Sioux Falls, SD. The public is welcome to attend.
The license type referred to and to be conditionally awarded is described as follows: Five (5) Off Sale Liquor Licenses, to be conditionally awarded separately. This license allows the holders to sell any alcoholic beverage for consumption off the premises where sold. The minimum bid for the license shall be $500.
The bidder(s) providing the highest bid(s), based on the number of available off-sale liquor licenses as prescribed in § 111.013, shall be notified in writing of their conditional award. The names and amounts of bids for those conditionally awarded will be published online within five (5) business days of the date on the written notice of the conditional award(s).
The issuance of the licenses shall be conditioned upon the eligibility of the person or firm to hold the license(s), suitability of the proposed premises upon which the alcoholic beverages will be sold, active use of the license(s) within 90 days of issuance, and compliance with all other state law and City ordinance requirements, including but not limited to applicable zoning, building, and property maintenance codes. The City Council reserves the right to stipulate such other and further conditions for issuance of the license(s) as may be necessary and proper. If the highest bidders do not meet all conditions of § 111.012.1, the next highest bid(s) may be conditionally accepted in the same manner as the highest bid.

RESOLUTION NO. 44-25
A RESOLUTION APPROVING ISSUANCE BY THE SIOUX FALLS REGIONAL AIRPORT AUTHORITY OF ITS AIRPORT REVENUE BONDS.
WHEREAS, the Sioux Falls Regional Airport Authority (the “Authority”) has represented to the City that it desires to make improvements at the Sioux Falls Regional Airport to be financed in part by the issuance by the Authority of its Airport Revenue Bonds in one or more series in an aggregate principal amount of up to $30,000,000 (the “Bonds”), the proceeds of which will be used, together with such other available funds of the Authority as may be required, to finance the addition of five new gates and expansion of the terminal capacity (the “Terminal Project”); and
WHEREAS, under the provisions of Section 147(f) of the Internal Revenue Code of 1986 (the “Code”), an elected representative is required to approve the issuance of the Bonds following a public hearing for which there was reasonable public notice. The Authority held a public hearing on June 25, 2025, with notice of the hearing published not less than seven days before the date of the hearing, as required by the Code; and
WHEREAS, the Authority has no applicable elected representative. Therefore, under Subclause 147(f)(2)(E)(ii), the Authority has requested that the Council approve issuance of the Bonds by the Authority. The Bonds will not be general obligations of the Authority, and the general credit and taxing powers of the Authority will not be pledged to the payment thereof; and
WHEREAS, the City acknowledges its role in approving the bond issuance by the Authority as required under Section 147(f). However, the City expressly disclaims all responsibility or liability as to the potential exemption of interest on the bonds or for the repayment of the bonds or any other obligations arising from the issuance of the bonds. The approval of the bond issuance does not constitute an endorsement or guarantee of the bonds or the Authority. Any bondholders shall have no recourse against the City for any claims related to the bond.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That the Council hereby approves the issuance of the Bonds for purposes of Section 147(f) of the Code.
Section 2. That this resolution shall become effective in accordance with Section 9-19-13, South Dakota Codified Laws.

The School Board of the Sioux Falls School District 49-5 of Minnehaha County, South Dakota, was called into regular session, pursuant to due notice, on Monday, June 23, 2025, at
5:35 pm in the Instructional Planning Center, 201 East 38th Street, Sioux Falls, South Dakota, with the following members present: Marc Murren, Gail Swenson, Nan Kelly, and Vice President Dawn Marie Johnson, and President, Carly Reiter. Absent: none. Dr. Jane Stavem, Superintendent of Schools, Todd Vik, Business Manager, and Brett Arenz, In-House Counsel, were also present.

RESOLUTION
WHEREAS, Carly Reiter has served the Sioux Falls School District 49-5 for the past twelve years, since July 2013; as a valued School Board Member, its Vice President, and President; and,
WHEREAS, Mrs. Reiter has during these twelve years ably served as Board Representative to the following committees: Calendar Committee, Southeast Technical Institute Council, Sioux Falls Education Foundation, Safe and Secure Schools Council, Insurance Committee, Budget Review Committee, Chamber of Commerce, Teacher of the Year, Talent in Workforce, PATH Committee, and Policy Review Committee as well as a contributing member of the City/Counties/Schools meetings, legislative liaison and on the negotiating teams for the Board; and,
WHEREAS, Carly provided exceptional leadership for Sioux Falls and the whole State of South Dakota through her tenure as a school board member.
WHEREAS, Mrs. Reiter provided leadership and significant guidance to the District’s long-range financial planning and Five-Year Budget Plan, while maintaining a high sense of fiscal responsibility and advocating strong, innovative academic programs; and,
WHEREAS, Carly during her tenure was instrumental and provided significant leadership during three Superintendent transitions that included national searches, interviews, and the ultimate hiring of Best In Class Leaders; and,
WHEREAS, during her tenure on the School Board, the School District completed construction of the new Field House at Howard Wood Field, Career and Technical Education Academy, R. F. Pettigrew Elementary School, Susan B. Anthony Elementary School, Sonia Sotomayor Elementary School, George McGovern Middle School, Ben Reifel Middle School, and Thomas Jefferson High School. Additionally, the Vet Tech Addition at Ed Wood Center and Dental Expansion and Renovation at the Health Science Center in 2020 at Southeast Technical College, as well as the acquisition of the Zeal Building in 2022 for Southeast Technical College; and the start of Construction for the new Marcella LeBeau Elementary School and,
WHEREAS, Carly steadfastly served during the pandemic, while taking into consideration the best way to educate students safely and effectively, in unprecedented times.
WHEREAS, Mrs. Reiter encouraged a commitment to understanding and valuing diversity as well as the importance of providing multiple pathways for student success, while advocating for children with special needs; and,
WHEREAS, Carly’s commitment to excellence in education has enhanced opportunities for countless children; and her commitment to increasing involvement of citizens in the decision-making process regarding educational programs has contributed to the overall improvement of the District’s instructional program; and,
WHEREAS, Mrs. Reiter has ably served in these capacities at considerable personal sacrifice and with outstanding dedication to “placing children first” in all her decisions; whether considering budgets, boundaries, bussing, calendars, curriculum, or policies; and,
WHEREAS, we, the School Board, wish to express deep appreciation and thanks to
Carly Reiter on behalf of the members of the School Board, the administration and the entire School District;
NOW, THEREFORE, BE IT RESOLVED, that this resolution be spread upon the minutes of the meeting of the School Board of the Sioux Falls School District 49-5 held Monday,
June 23, 2025, and a copy of the resolution be given to Carly Reiter.

Dr. Nikki Whiting, Accountability & Outcomes Supervisor, shared details of Project SEARCH which places students from Community Campus into the world of work at Sanford Health. The goal is to equip them with workplace skills to succeed after they reach age 21.

Adopting a resolution, as follows:
RESOLUTION
WHEREAS, gifts have been presented to the Sioux Falls School District 49-5 of Minnehaha County, South Dakota, and the School Board hereby accepts the gifts (see MRF #19646 for listing of gifts) and;
BE IT RESOLVED, that said gifts shall become the property of the Sioux Falls School District, all in accordance with Policy KCD.

To authorize the issuance of a three-year contract with Dr. Cory Clasemann, Sioux Falls, South Dakota, for the position of Southeast Technical College President beginning July 1, 2025, at an annual base salary of $185,000 per year plus a benefit package, and further authorizing the President of the School Board and the Business Manager to execute the agreement, for and on behalf of the District.

Casey Meile, Athletics Coordinator, and Shane Weubben, Fine Arts Coordinator, presented the 2024-2025 Athletic/Activities Participation report as follows (MRF #19650):
Participation in school activities, ranging from athletics to fine arts to clubs and academic competitions, is an essential part of the student experience in the Sioux Falls School District (SFSD). These programs play an important role in shaping well-rounded students by building leadership, teamwork, and resilience.
During the 2024-2025 school year, SFSD offered a wide range of athletic and fine arts opportunities across its middle and high schools. Two-thirds of middle schoolers participated in athletics, over half joined music ensembles, and nearly 66% took a visual arts class. At the high school level, nearly half participated in athletics, 60% enrolled in fine arts classes, and 44% took part in South Dakota High School Activities Association (SDHSAA)-sanctioned events.
The District earned several notable accolades this year. For the third year in a row, SFSD was recognized as one of the “Best Communities in Education” by the NAMM Foundation. Students excelled in All-State music, visual arts, debate, Esports, and journalism. Lincoln High School’s performance in the Macy’s Thanksgiving Day Parade and student success at the State Art Gallery were standout moments.
Athletically, SFSD teams and individuals achieved state-level success. Eighty-two of 92 varsity teams earned SDHSAA Academic Achievement Awards. SFSD student-athletes won multiple individual and team state titles in sports like football, tennis, wrestling, and softball.
Coaches from Jefferson and Lincoln were recognized nationally, and the District proudly hosted several major athletic events.
These accomplishments reflect the District’s strong commitment to high-quality extracurricular programming that supports student engagement, academic success, and personal growth. Todd Vik, Business Manager, presented the Opt Out Recommendation, see (MRF#19651) as follows:
In 2019 the Finance Action Network (FAN) was called together and met on April 23, 2019. The purpose of the meeting was to study the $7.5 million opt out expiring in 2022 and make a recommendation to the School Board.
In addition to Superintendent Maher, Business Manager Vik, and Senior Director of Assessments, Technology, and Information Morrison, FAN was comprised of Sara Andrews (Schoeneman’s), Jason Ball (Sioux Falls Area Chamber of Commerce), Keith Severson (Eide Bailly), Bob Thimjon (Ramkota Companies), and Becky Wittrock (Geo Tek). After studying the District’s finances, benchmarking it against other SD districts and its national peers, and projecting future fund balances based on various scenarios, FAN concluded that:
• The opt-out is a critical component to the School District budget.
• The opt-out enables the School District to both deliver its current level of programming but also provides some risk mitigation toward inadequate funding from the State and other sources of revenue.
• The District fund balance was at its lowest point in 25 years and typically cannot be relied upon to balance the budget into the future.
• Not replacing the $7.5 million opt-out expiring in 2022 would be catastrophic to the School District.
• The School District has been fiscally conservative and only uses the portion of the opt-out critical to the District needs.
• A 10-year target amount of $15 million (in 2019 dollars) in opt-out capacity is reasonable to maintain the opt-out used at a constant 5.2% of the budget while also maintaining a two percent contingency for the District.
• An opt-out laddering approach that adjusts for inflation (i.e. opt-out for overlapping smaller amounts every year instead of one or two large amounts every 5+ years) has merit as it would allow the District to react on an annual basis to changes in need.
Based on the input from FAN, the School Board opted out for $1.5 million in 2020, $1.6 million (to account for inflation) in 2021, and $1.7 million in 2022. None of those opt-outs affected the property tax rate as they were partial replacements of the $7.5 million set to expire in 2022 and were not levied. For 2023, the Board opted out for $1.8 million and raised the opt out amount levied to $11 million through the FY23 budget process. In 2024, the Board opted out for $1.9 million and maintained the opt out levy at $11 million and in 2025 opted out for $2 million while increasing the opt out amount to $11.5 million. The current maximum opt out is $15.5 million.
For taxes payable in 2025, Administration is recommending a $2.1 million opt out to move toward providing the District with the two percent contingency recommended by FAN. The new opt out will not affect property taxes as the District has already budgeted $12 million of the opt out for FY26.
Following general discussion, a motion was made by Gail Swenson and seconded by
Nan Kelly, five (5) votes “yes” on roll call, adopting a resolution, as follows:
RESOLUTION
The GOVERNING BOARD OF THE SIOUX FALLS SCHOOL DISTRICT 49-5 do state that the above said Board is unable to operate under the tax limitation measure currently in statute in the general fund. We therefore OPT OUT of such tax limitation in the amount of $2,100,000 starting with taxes payable in calendar year 2026. This opt out will be for ten years, which will be through taxes payable in calendar year 2035. This action has been taken by the Board and approved by at least a two-thirds vote of the Board.
This decision may be referred to a vote of the people upon a petition signed by at least five percent of the registered voters in the District and filed with the governing body within twenty days of the first publication of this decision.
Unless this action is referred to a vote of the people and reversed by such vote, this resolution authorizes the county auditor(s) to spread an excess levy to raise tax dollars in the above-stated amount.

Planning & Zoning Administrator, Ryan Fods called the meeting of the P&Z Board to order at 6:00 PM in the Baltic City Hall, 130 St Olaf Avenue. RE-ZONE PUBLIC HEARING
Planning & Zoning Administrator Ryan Fods outlined the hearing process, then invited Eric Willadsen of Willadsen Lund Engineering to present the rezone request. Willadsen, the project engineer, gave an overview of the proposed multi-family apartments and requested a zoning change from business to residential. Attendees asked questions, and Willadsen clarified that the request was solely for rezoning, not for detailed building plans so he could answer questions on the rezone of the land.
After Willadsen’s presentation, P&Z President Zach Utecht opened the public hearing at 6:19 p.m. Several attendees spoke both for and against the project. Concerns included parking overflow, limited business land, setting a precedent, and utility capacity. Supporters cited the need for housing and potential to attract more businesses. Amy Miller of Charisma Property Management, who will manage the project, urged the commission to approve the rezone.
Utecht closed the public hearing at 6:51 pm.
Nikki Oien made a motion to recommend the City Council not approve the re-zone of 528 Lovely Ave, DeJong seconded. All in favor of recommending the denial of the re-zone to the City Council:

RESOLUTION TO DECLARE CERTAIN MOBILE HOME DISTRESS WARRANTS FOR UNPAID PROPERTY TAXES AS UNCOLLECTIBLE
WHEREAS, SDCL 10-22-30 provides for the county Boards of Commissioners to discharge all distress warrants deemed by the sheriff to be uncollectible; and
WHEREAS, The Office of the Minnehaha County Treasurer has provided an attached list of 6 mobile homes identified as uncollectible, and
WHEREAS, by declaring the property taxes for these mobile homes as uncollectible, these taxes will be added to an uncollectible list and no distress warrant shall thereafter be issued therefore except on order of the Board of Commissioners or on written demand by the sheriff;
NOW THEREFORE BE IT RESOLVED, by the Minnehaha County Board of Commissioners that property taxes on the attached list of mobile homes are declared as uncollectible pursuant to SDCL 10-22-30.

Duane Pierre, Dominick Smith You are hereby summoned to appear before the above-named Court in its courtroom at the Minnehaha County Courthouse, 425 North Dakota Avenue, Sioux Falls, South Dakota, on July 11, 2025, at 9:00 AM to answer the Petition of CARRIE MEES, now on file with the Clerk of said Court, alleging the above named Children to be an abused/neglected Children and praying that said Children be taken from you and that a guardian be appointed with authority to consent to the adoption of said Children. You must appear at the time and place set forth above to show cause, if any you have, why said Children should not be found abused/neglected and the prayer of said Petition granted or said Children otherwise dealt with.
