Notice is hereby given that the Sioux Falls City Council will meet on September 2, 2025, at 6 p.m. in the Carnegie Town Hall, 235 W. 10th St., to consider approval of the Assessment Roll for the Downtown Sioux Falls Business Improvement District filed by Sioux Falls Planning and Development Services on July 22, 2025, in the City Finance Office.
All properties within the Downtown Sioux Falls Business Improvement District boundary may be included in the Assessment Roll, and all owners of property subject to the assessment will be notified via postal mail in addition to this publication. NOTICE OF CHILD FIND
The Sioux Falls School District actively seeks to identify, locate, and evaluate children in need of special education, special education and related services, and/or Section 504 services. All children residing within the jurisdiction of the District who are ages birth through 21 regardless of the severity of their disability, including children in all public and private agencies and institutions, private schools, religious schools, and children receiving alternative instruction under SDCL 13-27-3 within the legal boundaries of the District are eligible to participate in Child Find activities. This includes children who are not in school, those who are highly mobile such as children who are migrant or homeless, and those who are advancing from grade to grade but are not receiving special education or 504 services.
If you know of a child who may have a disability and meets the residency requirements described in this Notice, contact the Sioux Falls Special Services Department at 605-367-7689. The Sioux Falls School District conducts child find activities throughout the school year through their multi-tiered system of support (MTSS) framework where children enrolled in the District are continually monitored within a data-driven, problem-solving process to ensure they are making adequate progress. Through this process, children suspected of having a disability may be identified. The Sioux Falls School District will ensure any child enrolled in the District and eligible for special education or 504 services, regardless of the severity of the disability, is provided appropriate special education or 504 services at no cost to the parent(s) of the child.
The Sioux Falls School District maintains publicly available funding applications, evaluations and/or reports required by the state of South Dakota and the Office of Special Education Programs required for compliance with the Individuals with Disabilities Act (IDEA) and Section 504 of the Rehabilitation Act. NOTICE OF DESTRUCTION OF
SPECIAL EDUCATION RECORDS
Special Education records which have been collected by the Sioux Falls School District related to the identification, evaluation, educational placement, or the provision of Special Education in the district, must be maintained in accordance with Board policy JRA/JRA-R. Destruction of records information provided to parents/guardians at each IEP meeting: After 5 years of dropped enrollment, student aging out (21 years old), or one year after the student graduates, the SFSD will place the last evaluation, IEP, and PPWN/Summary of Performance in the student’s permanent file. The remainder of the student’s special education records will be purged.
Special Education services end when the student no longer is eligible for services, graduates, completes his or her educational program on June 30th of the year after he/she turns 21, or moves from the district. This notification is to inform parents/guardians and former students of the Sioux Falls School District’s intent to digitize the Special Education records of students who ended Special Education Services either as a result of graduation, aging out of the program, or dismissal from special education services. Graduate records will be digitized approximately one year after graduation. All other records will be digitized within three years of dismissal from services or leaving the district. Requests for records can be made in accordance with Board Policy JRA/JRA-R. The District may charge a nominal fee for copies.

Megan, Fischer, Vice President for Enrollment and Student Affairs, reported that Southeast Technical College’s marketing efforts have been recognized on a national level with two “Silver” – level recognitions in the 40th Annual Educational Advertising Awards (EduAD), the largest educational advertising awards competition in the country. STC’s awards were for the 24-25 Viewbook and its Integrated Marketing Campaign. The awards are beneficial because they validate STC’s marketing strategy and strengthen the STC brand, while building trust with students and their families and supporting enrollment goals. The marketing department, consisting of director Jen Lambley and graphic designer Carmen Landhuis, were also present to discuss the awards.

SET WEIGHT LOAD LIMITS ON CERTAIN BRIDGES WITHIN MINNEHAHA COUNTY
WHEREAS, the Minnehaha County Highway Department performs regular bridge inspections to assess the condition of individual bridges and considers recommendations for improvements, and
WHEREAS, the Minnehaha County Highway Department performs bridge maintenance and bridge replacement projects in an effort to improve the overall condition of the bridge network, and
WHEREAS, the Minnehaha County Highway Superintendent has identified twenty-one (21) bridges in Minnehaha County that are recommended for weight load limits, and
WHEREAS, SDCL 32-22-47 gives the county commission the authority to establish and identify through the proper signage the maximum weight of any vehicle, laden or unladen, which may enter upon or cross over the bridge, now
THEREFORE, BE IT RESOLVED by the Minnehaha County Board of Commissioners that all of the existing bridge weight load limits described in previous resolutions are hereby removed and superseded with the following gross vehicle weight load limits:

BE IT FURTHER NOTED, under SDCL 32-22-48, the violation of these weight load limits is a Class 2 misdemeanor, and Minnehaha County may recover civil damages from any person who drives or operates, or causes to be driven or operated, any vehicle, laden or unladen, upon, over or across any bridge which has been posted in accordance with § 32-22-47 and which exceeds the maximum posted weight in pounds and causes any injury or damage to said bridge by reason thereof.

BRIEFING
Susan Beaman, Finance & Budget Officer, presented a briefing regarding the 2025 2nd Quarter American Rescue Plan Expenditures. The Auditor’s Office plans to report to the US Treasury regarding last quarter’s expenditures of $271,264.94. The expenditure breakdown is as follows: Emergency Response Infrastructure Improvements had an expenditure of $20,135.25; and construction of additional courtroom had an expenditure of $251,129.69. The total ARPA expenditures through June 30, 2025, were $36,798,975.97. As of June 30, 2025, $715,039.03 remains for obligated projects.
PROVISIONAL BUDGET
Susan Beaman, Finance & Budget Officer, presented the FY 2026 Provisional Budget in the amount of $132,755,447. The provisional budget includes $96,061,899 in General Funds, $16,794,743 in Highway Funds, and $7,966,269 in Bond Redemption Funds. A public hearing on the proposed FY 2026 will be held during the Minnehaha County Commission meeting at 9:00 a.m. on Tuesday, September 2, 2025.

Meredith Jarchow, Assistant Commission Administrative Officer, presented the first reading of an Ordinance Defining Residency Requirements for Appointment to the Minnehaha County Housing and Redevelopment Commission (HRC). The Commission is composed of one Minnehaha County Commissioner as well as four community members, often with experience in housing, financial services, and other related industries. The proposed changes would allow at most two commissioners on the HRC to be nonresidents of Minnehaha County, given that they reside in a directly adjacent county (Lake, Lincoln, McCook, Moody, or Turner). (1)Restrained from transferring, encumbering, concealing or in any way dissipating or disposing of any marital assets, without the written consent of the other party or an order of the Court, except as may be necessary in the usual course of business or for the necessities of life. You are to notify the other party of any proposed extraordinary expenditures and to account to the Court for all extraordinary expenditures made after the Temporary Restraining Order is in effect;
(2)Restrained from molesting or disturbing the peace of the other party; and
(3Restrained from removing any minor children of the parties from the state without the written consent of the other party or an order of the court.
(4)Restrained from making any changes to any insurance coverage for the parties or any child of the parties without the written consent of the other party or an order of the Court, unless the change under the applicable insurance coverage increases the benefits, adds additional property, persons, or perils to be covered, or is required by the insurer.
INITIAL CUSTODY ORDER
South Dakota law, SDCL § 25-4A-11, provides that upon the filing and service of a summons and complaint for divorce or separate maintenance or any other custody action or proceeding, the attached standard guidelines become an order of the Court. Any minor child of the marriage shall remain in the custody of the parent who has been the primary caregiver for the minor child for the majority of time in the twelve months preceding the filing of the summons and complaint, who, in this case, is the Plaintiff, unless the parties agree otherwise. The standard guidelines shall apply and continue in effect, unless the parties agree, or the court orders otherwise. Imposition of the standard guidelines creates no presumption as to who may be awarded custody at any hearing.
The guidelines are also, pursuant to SDCL § 25-4A-14, subject to any provisions established by a South Dakota court in a temporary or permanent domestic protection order, an order arising out of an abuse or neglect proceeding, as bond condition arising out of a criminal case, and an order in any other proceeding affecting child custody or support.
If either party objects to this initial custody and visitation order, the Court shall order a hearing which shall be held not later than 30 days after the date of the objection. The Court shall then issue its temporary custody and visitation order after considering the best interest of the children consistent with the provisions of SDCL § 25-4-45.
IF EITHER PARTY VIOLATES THE TEMPORARY RESTRAINING ORDER OR INITIAL CUSTODY ORDER, THAT PARTY MAY BE HELD IN CONTEMPT OF COURT AND SUBJECT TO SANCTIONS.
ORDER FOR COURT-APPROVED PARENTING EDUCATION
South Dakota law, Supreme Court Rule 22-09, provides that the parties to any action which involves the issues of child custody or parenting time will be required to participate in a court-approved course to educate the parties concerning the impact of the action on the child or children. The course shall be completed within sixty days of the service of the summons and complaint, petition or motion in any action involving child custody or parenting time. Participation in the course may only be waived or delayed by the Judge presiding over the action for good cause shown. Good cause includes but is not limited to a default by one of the parties or a showing that the parties have previously participated in a court-approved course or its equivalent within the past five years.
Participation in the course is not required for a protection order proceeding or if the proceeding involves termination of parental rights of any of the parties. A final decree shall not be granted for a final order shall not be entered until both parties have complied with this requirement, unless participation in the course is waived or delayed for good cause or is otherwise not required. Each party shall be responsible for arranging their participation in the course and for payment of the costs of participation in the course.
Each party shall submit certification of completion of the course to the court prior to the granting of a final decree or the entry of an order, unless participation in the course is waived or delayed for good cause or is otherwise not required as set forth herein. If participation in the court-approved course is waived or delayed for good cause or is otherwise not required under this section, the Judge presiding over the action may order that the parties receive the information in an alternative format.
The State Court Administrator’s Office shall certify approved courses for parties required to participate in a course. Approved courses may include those provided by a public or private entity. At a minimum and as appropriate, an approved course shall include information related to the effects of separation or divorce on children, co-parenting skills and responsibilities, children’s needs and coping techniques, the options for conflict resolution for parenting time and custodial disputes and the financial responsibilities of parents.
