NOTICE OF PUBLIC SALE
OFF-SALE LIQUOR LICENSE
NOTICE IS HEREBY GIVEN BY the undersigned Licensing Specialist of the City of Sioux Falls, South Dakota, that the five (5) Off-sale Liquor Licenses hereinafter described, held by the City of Sioux Falls, will be conditionally awarded under sealed bids to the highest suitable bidder(s).
All sealed bids shall be made on a form available from the City. All sealed bid envelopes shall be conspicuously marked “SEALED BID—OFF-SALE LIQUOR LICENSE, BIDDER NAME, PROPOSED ADDRESS FOR LICENSE” and submitted in person to the City Licensing Specialist or designee during regular business hours Monday through Friday, 8 a.m. to 5 p.m., beginning on Monday, July 14, 2025, through Thursday, July 31, 2025. The $100 nonrefundable bid application fee, payable to the City of Sioux Falls, shall be outside the sealed envelope.
Sealed bids will be opened at 10 a.m. on Friday, August 1, 2025, in Attorney Conference Room 103, City Hall, 224 West Ninth Street, Sioux Falls, SD. The public is welcome to attend.
The license type referred to and to be conditionally awarded is described as follows: Five (5) Off Sale Liquor Licenses, to be conditionally awarded separately. This license allows the holders to sell any alcoholic beverage for consumption off the premises where sold. The minimum bid for the license shall be $500.
The bidder(s) providing the highest bid(s), based on the number of available off-sale liquor licenses as prescribed in § 111.013, shall be notified in writing of their conditional award. The names and amounts of bids for those conditionally awarded will be published online within five (5) business days of the date on the written notice of the conditional award(s).
The issuance of the licenses shall be conditioned upon the eligibility of the person or firm to hold the license(s), suitability of the proposed premises upon which the alcoholic beverages will be sold, active use of the license(s) within 90 days of issuance, and compliance with all other state law and City ordinance requirements, including but not limited to applicable zoning, building, and property maintenance codes. The City Council reserves the right to stipulate such other and further conditions for issuance of the license(s) as may be necessary and proper. If the highest bidders do not meet all conditions of § 111.012.1, the next highest bid(s) may be conditionally accepted in the same manner as the highest bid.

RESOLUTION NO. 45-25
A RESOLUTION OF NECESSITY AUTHORIZING THE COMMENCEMENT OF CONDEMNATION PROCEEDINGS FOR ACQUISITION OF REAL PROPERTY LOCATED IN SIOUX FALLS, SD, FOR PUBLIC USE.
WHEREAS, the City of Sioux Falls (the “City”) is authorized and proposes to undertake and carry out for public use a roadway construction project to construct North Marion Road Phase 3 in northern Sioux Falls (the “Project”). The Project preserves the function and performance of the area’s future road system and includes additional reconstruction of arterial roadways; and
WHEREAS, in connection with the Project, it is necessary to acquire right-of-way from the landowners and parcels listed below; and
WHEREAS, a portion of the construction of the Project will require the acquisition of additional land for right-of-way and construction, which may include borrow pits, cut slopes, fill slopes, impoundments, and channel changes, either by purchase or condemnation; and
WHEREAS, the Project is scheduled for construction in 2026; and
WHEREAS, in connection with such acquisition, the City has obtained independent real estate appraisals to determine fair market value, which appraisals have been reviewed by an independent real estate appraiser; and
WHEREAS, purchase offers at fair market value based on the appraisals and waive valuations have been made by the City of Sioux Falls for the right-of-way; and
WHEREAS, the City of Sioux Falls has been unable to acquire, by voluntary purchase or agreement, the rights-of-way and permanent and temporary easements described below that are necessary for the construction of the Project; and
WHEREAS, it is deemed necessary and in the best interest of the City of Sioux Falls that the acquisition of the Project right-of-way proceed expeditiously; and
WHEREAS, SDCL § 9-27-1 authorizes a municipality to acquire real property by condemnation for any purpose authorized by law when approved by a two-thirds majority vote;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:

ASBESTOS NOTIFICATION
SIOUX FALLS SCHOOL DISTRICT 49-5
The Sioux Falls School District is required by Asbestos Hazardous Emergency Response Act regulations to annually publish this notice regarding its current and planned asbestos activities. The District has identified asbestos materials in several of its facilities. The District’s asbestos management plan is available for public inspection at Operational Services-Central Services Center, 1101 North Western Avenue, or at the administrative office at each individual school building.
The District has removed all friable asbestos material over the past 30 years. The District does however, have non-friable asbestos materials remaining in the form of floor tile, transite boards and/or pipe insulation materials in concealed spaces. These materials are identified in the individual facility’s management plan.
The District is required to conduct semiannual surveillance for all confirmed and assumed asbestos material in each facility. These inspections will be conducted in the fall and spring of the year. The District has completed its required three-year surveillance review. ACT Associates, Inc. conducted this review. These reports are on file with the management plants at the respective school buildings.
If damaged asbestos material is detected anytime, Operational Services will be notified and will have the material removed by a certified individual or company. This notice may be viewed free of charge on a 13 statewide public notice website maintained pursuant to §17-2-1.

The School Board of the Sioux Falls School District 49-5 of Minnehaha County, South Dakota, was called into special session, pursuant to due notice, on Wednesday, July 2, 2025, at 3:00 p.m. in the Instructional Planning Center, 201 East 38th Street, Sioux Falls, South Dakota, with the following members present: Gail Swenson, Marc Murren, Nan Kelly, Vice President Dawn Marie Johnson. The purpose of this work session was to answer any questions regarding the upcoming topics for the school board retreat, and to present the new Promising Futures College & Career Access Partnership. Dr. Nold, provided a general preview of the Agenda of Topics for the August 25, 2025, School Board Retreat, followed by a general discussion. Steve Hildebrand, Founder of the Promising Futures Fund, and Daniel Conrad, Assistant Superintendent, presented the goals for the College and Career Access as follows:
1. Break the poverty cycle
2. Increase student and parent awareness of Post Secondary Opportunities, Military Careers, and Professional Careers.
The focus of the College and Career Advisors at Jefferson High School will be the following:
1. Students who will be the first in their family to attend college
2. Students from low-income backgrounds
3. Any student who needs CCA support
4. Working with supports currently in place such as programs JAG and TRIO

MOTION by Arends to approve proposed resolution condemning antisemitism: A RESOLUTION BY THE LINCOLN COUNTY BOARD OF COUNTY COMMISSIONERS STRONGLY CONDEMNING AND DENOUNCING ANTISEMITISM Whereas, SDCL Ch. 7-18 provides that the powers of a County shall be exercised by a board of county commissioners; Whereas, SDCL 7-18A-2 provides that Counties have the authority to enact such resolutions as may be proper and necessary to carry into effect the powers granted to it by law; Whereas, acts of intimidation, discrimination, and violence based on ethnicity or religion have no place in our county, state and country; Whereas, SDCL 20-13-57 provides that the International Holocaust Remembrance Alliance’s working definition of antisemitism is widely accepted and serves as a critical tool to help individuals comprehend and identify the various manifestations of antisemitism; NOW THEREFORE BE IT RESOLVED, that the Board of County Commissioners of Lincoln County, South Dakota: (1) strongly condemns and denounces all instances of antisemitism occurring in the United States and globally; (2) reaffirms and reiterates its strong support for the Jewish community at home and abroad; (3) calls on elected officials and world leaders to condemn and fight all forms of domestic and global antisemitism; (4) clearly and firmly states that anti-Zionism is antisemitism; and (5) rejects all forms of terror, hate, discrimination, and harassment of members of the Jewish community. Motion fails for lack of a second.
