ORDINANCE NO. 70-25
AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AUTHORIZING THE ISSUANCE OF ITS WASTEWATER SYSTEM REVENUE BOND TO THE SOUTH DAKOTA CONSERVANCY DISTRICT, AUTHORIZING THE USE OF THE PROCEEDS THEREOF FOR CAPITAL IMPROVEMENTS, PLEDGING THE WASTEWATER SYSTEM REVENUE OF THE CITY TO THE PAYMENT OF SAID WASTEWATER SYSTEM REVENUE BOND, FIXING THE TERMS OF SUCH WASTEWATER SYSTEM REVENUE BOND, AUTHORIZING THE EXECUTION AND DELIVERY OF A LOAN AGREEMENT BETWEEN THE CITY AND THE SOUTH DAKOTA CONSERVANCY DISTRICT, AND AUTHORIZING THE EXECUTION AND DELIVERY OF SUCH WASTEWATER SYSTEM REVENUE BOND TO THE SOUTH DAKOTA CONSERVANCY DISTRICT NOT TO EXCEED $32,761,000.
BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
WHEREAS, the City currently operates a wastewater system and has determined that improvements to the wastewater facilities are necessary and qualify as an improvement, extension, or addition to its wastewater system; and
WHEREAS, the City of Sioux Falls (the “City”) is authorized by its City Charter (the “City Charter”) and by Chapters 9-40 and 6-8B of the South Dakota Codified Laws to issue wastewater system revenue bonds to finance the acquisition of capital improvements to its wastewater system in anticipation of the collection of wastewater system revenues; and
WHEREAS, the City is authorized by its City Charter and Chapter 9-48 of the South Dakota Codified Laws (“SDCL Chapter 9-48”) to establish just and equitable rates of charges to be paid to such City for the use of the wastewater system of the City, directly or indirectly; and the City has adopted and enacted City of Sioux Falls Ordinance No. 43-23 pursuant to its City Charter and SDCL Chapter 9-48 which ordinance establishes charges for the use of the wastewater system of the City; and
WHEREAS, the City has determined that the improvements described in Exhibit A (the “Project”) are necessary for the conduct of the City’s operation of its governmental programs and qualify under its City Charter and Chapter 6-8B of the South Dakota Codified Laws (“Chapter 6 8B”) as improvements that may be financed through the issuance of the Bond; and
WHEREAS, the South Dakota Conservancy District (the “District”) has established the South Dakota State Revolving Fund Loan Program pursuant to SDCL 46A-1-49 (the “Program”) whereby participating public entities, by issuing their bonds to the District, may acquire necessary improvements and reduce the interest and issuance costs of the public entities below what could be achieved if the improvements to be acquired by each public entity individually were to be financed and acquired separately; and
WHEREAS, the City desires to finance $32,761,000 of the costs of the Project through a loan from the Program under the terms of a loan agreement in substantially the form attached hereto as Exhibit B (the “Loan Agreement”), such loan to be evidenced by a Wastewater System Revenue Bond, Series 2025, in the amount of $32,761,000 (the “Bond”); and
WHEREAS, it is in the best interests of the City to participate in the Program, to authorize the borrowing of funds from the District for the financing of the Project by authorizing and issuing its Wastewater System Revenue Bond to the District with the terms approved hereby for an aggregate sum not in excess of $32,761,000 and to pledge the net revenues of the City’s wastewater system as security for the repayment of such Bond;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD, THAT:
Section 1. Findings.
(a) The City desires and hereby determines it is necessary to improve its wastewater facilities by undertaking the Project. The City hereby expressly finds that if the Project is not undertaken, certain deficiencies in the wastewater system will pose a health hazard to the City and its inhabitants who are served by the City’s wastewater system. Because of the functional interdependence of the various portions of the wastewater system and the nature of the improvements financed, the City hereby determines that the Project will substantially benefit the entire wastewater system and all of its users within the meaning of SDCL 9-40-15 and SDCL 9-40-17. Therefore, the City hereby determines that for the purposes of the Act, including, in particular, SDCL 9-40-17, the net income or revenues of the entire wastewater system, as extended, added to, or improved by the Project shall be deemed to be the net income or revenues available to be pledged to the payment of the Bond issued hereunder.
(b) The City finds that it is desirable and expedient to participate in the Program and to authorize and deliver the Loan Agreement and to authorize, issue, and sell the Bond to the District as provided herein and in the Loan Agreement.
Section 2. Authorization. The Loan Agreement and the issuance of the Bond are hereby authorized and approved, with said Bond to be issued on a parity basis, in the aggregate principal amount not in excess of the $32,761,000 with the terms and subject to the provisions as set forth in the Loan Agreement. It is further authorized and approved to secure the repayment of the Bond with a pledge of the wastewater system revenue, as set forth in the Loan Agreement.
Section 3. Execution of Documents. In connection with the authorization, issuance, and delivery of the Bond, the Mayor, City Clerk, Finance Director, City Attorney, and other officers of the City shall be authorized to enter into, execute, and deliver the following documents, instruments, and agreements as may be deemed necessary or appropriate by such officers and the District, consistent with the terms of this ordinance:
(A) The Loan Agreement providing for the issuance of the Bond and setting forth the terms thereof;
(B) The Bond; and
(C) Such other documents, agreements, or instruments as may be necessary to make covenants and recite facts required to demonstrate the validity and enforceability of the Bond under the laws of the state of South Dakota and to assure the exclusion of the interest thereon from the gross income of the owner of the Bond under the Internal Revenue Code of 1986, as amended, and to effectuate the terms and intent of this ordinance.
The execution and delivery of the Loan Agreement, the Bond, and all such other agreements, documents, and instruments as necessary and appropriate are hereby authorized, all of which to be in substantially the form on file with the City on the date hereof and with such necessary and appropriate variations, omissions, and insertions as are consistent with the terms of this ordinance as determined by the Mayor in consultation with the City Attorney.
Execution and delivery of such documents by the Mayor, Finance Director, and/or City Attorney shall constitute evidence that such documents are consistent with the terms of this ordinance and the items have been duly authorized, executed, and delivered by the City and are enforceable against the City in accordance with their terms, subject to customary exceptions relating to bankruptcy, reorganization, insolvency, and other laws affecting creditors’ rights. The Mayor, Finance Director, and the City Attorney are further authorized to take such other actions as may be required to effectuate the terms and intent of this ordinance.
Section 4. Severability. In case any one or more of the provisions of this ordinance, the Loan Agreement, or the Bond authorized hereby shall for any reason be held to be illegal or invalid, such illegality or invalidity shall not affect any other provision of this ordinance, the Loan Agreement, or the Bond, but this ordinance, the Loan Agreement, or the Bond shall be construed as if such illegal or invalid provision had not been contained therein.
Section 5. Satisfaction of Conditions Precedent. All acts, conditions, and things required by the laws of the state of South Dakota, relating to the adoption of this ordinance, to the issuance of the Bond, and to the execution of the Loan Agreement and the other documents referred to above shall be satisfied prior to the issuance of the Bond. The designated officers are hereby authorized to do all acts and things required by them under this ordinance, the Loan Agreement, and the other documents referred to above for the full, punctual, and complete performance of all the terms, covenants, and agreements contained in the Bond, the Loan Agreement, the other documents referred to above, and this ordinance.
Section 6. Publication and Effective Date. After passage, this ordinance (except for Exhibit B hereto which is on file and available for inspection in the offices of the City Clerk) shall be published in the City’s officially-designated newspaper, and will be effective on the 20th day following such publication, unless suspended by referendum in accordance with Chapter 9-20 of the South Dakota Codified Laws. After becoming effective, this ordinance will be irrepealable until the Bond issued hereunder has been paid in full, except that prior to issuance of the Bond, this ordinance may be amended in accordance with South Dakota law.
Section 7. Prior Resolutions. All prior resolutions or ordinances that conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict.

AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AMENDING THE CODE OF ORDINANCES OF THE CITY BY AMENDING CHAPTER 38: ELECTIONS; SECTION 38.005 PERSONS AND ENTITIES REQUIRED TO SUBMIT CAMPAIGN FINANCE DISCLOSURES; TIME FOR SUBMISSION.
BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That Section 38.005 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 38.005 PERSONS AND ENTITIES REQUIRED TO SUBMIT CAMPAIGN FINANCE DISCLOSURES; TIME FOR SUBMISSION.
(a) A campaign finance disclosure whose contents are specified by state law shall be signed and submitted to the city clerk’s office by the treasurer of every municipal candidate or candidate campaign committee, municipal or nonmunicipal political action committee, municipal ballot question committee, and municipal public office holder pertaining to city elections. Any statement pursuant to this section shall be consecutive and shall cover contributions and expenditures since the last statement submitted.
(b) Submissions to the city clerk’s office shall occur pursuant to the schedule established by state law and as follows:
(1) Municipal candidates shall submit a statement of financial interest within 15 days after submitting nominating petitions.
(2) Municipal candidates, municipal candidate campaign committees, municipal ballot question committees, and municipal political action committees shall submit a statement of organization as provided in SDCL ch. 12-27.
(3) Municipal candidates, municipal candidate campaign committees, and municipal political action committees shall submit any required campaign finance disclosures required by state law by 5:00 p.m. on the deadline date, and shall submit an additional campaign finance disclosure within three business days following and complete through the last Monday one week prior to any municipal election.
(4) Ballot question committees shall have submitted a finance disclosure statement by 5:00 p.m. within three business days following and complete through:
A. The last business day of each month during the 90-day period immediately preceding the election;
B. The last Monday one week prior to any municipal election;
C. Sixty calendar days following the election, and shall include the disposition of any remaining funds or obligations of the person or committee; and
D. The requirements of this division (b)(4) shall also apply to any person raising, collecting, or disbursing money for the adoption or defeat of any question submitted to the voters at any election unless the person is engaging in these activities on behalf of a ballot question committee.
E. A ballot question committee that does not meet the signature requirements for placement of the ballot issue on an election ballot shall submit a termination report to the city clerk by 5:00 p.m. on the first Monday in February following the year the statement of organization was submitted to the city clerk.
(5) Nonmunicipal political action committees shall submit a finance disclosure statement with the city clerk by 5:00 p.m. within three business days from the last Monday one week prior to each city election. The statement shall cover the contributions and expenditures of the political action committee from the last submission with the secretary of state’s office. A political action committee that regularly submits a campaign finance disclosure statement with the Federal Election Commission or a report of contributions and expenditures with the Internal Revenue Service is not required to submit a campaign disclosure statement.
(6) Public office holders for the city shall, not more than 15 days after the person assumes office and then not later than the first day of January of every year the person continues to hold the office, file an elected official statement of financial interest setting forth any additions or corrections to any previous statement of financial interest filed pursuant to this chapter or state law.
(7) Any treasurer or other person filing a statement or report pursuant to this chapter shall file an amended statement or report within three days of discovering any omission, inaccuracy, or other change necessary to make the statement or report accurate.

A RESOLUTION ESTABLISHING THE CITY OF SIOUX FALLS’ LEGISLATIVE PRIORITIES FOR THE 2026 STATE LEGISLATIVE SESSION.
WHEREAS, the City Charter states that the Sioux Falls City Council is the policy making and legislative body of the City of Sioux Falls;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
1. The Sioux Falls City Council supports legislative efforts aimed at improving outcomes for individuals reentering society after incarceration. This initiative emphasizes a comprehensive approach to public safety, rehabilitation, and community reintegration through four key areas:
Modernization of Parole Services: Updates to current parole systems to ensure they are more efficient and supportive of successful reentry. This includes increasing the number of parole officers, expanding the use of modern technology, case management improvements, and expanding support services.
Financial Support for Felon-Friendly Housing and Job Training Statewide: Recognizing that stable housing and employment are critical to reducing recidivism, the Council supports legislation that allocates statewide funding for 1) the development or expansion of initiatives that support individuals with felony records in finding stable and affordable housing; and 2) workforce development programs specifically tailored for formerly incarcerated individuals, including vocational training, certifications, and employment placement services.
Funding a Multi-Agency Parole Absconder Task Force: Establish and fund a specialized task force composed of local and state agencies to locate and apprehend parole absconders. The goal is to improve community safety while maintaining a balanced approach to justice enforcement.
Funding to Support 24/7 Access to Triage Assessments: Establish funding for healthcare professionals to provide immediate care and treatment of acute intoxication, substance withdrawal, mental health crisis, and post-sexual assault care. The goal is to address critical service gaps for individuals facing mental health and substance use challenges through a triage facility. Our region offers this innovative approach through the Sioux Falls Link, which opened on June 1, 2021, and has served more than 3,500 individuals and conducted over 13,000 triage assessments. This triage facility is a collaboration between the City of Sioux Falls, Minnehaha County, Avera Health, and Sanford Health.
2. The Sioux Falls City Council recognizes the growing need for meaningful property tax relief across South Dakota. In response to concerns from local homeowners, the City Council acted in 2022 to provide targeted relief by authorizing refunds of up to $500 for the City’s portion of property taxes to residents who qualify for the state’s assessment freeze program for elderly and disabled homeowners. Enabled by the City’s home rule authority, this initiative has provided nearly $800,000 in property tax refunds to eligible residents over the past three years.
We urge the South Dakota Legislature to extend this opportunity to all municipalities by allowing local governments the option to refund their portion of property taxes to those who qualify for the state’s assessment freeze.
3. The City Council recognizes the critical role airports play in driving economic growth, supporting tourism, and strengthening regional access to national and global markets. In July 2025, the City Council reaffirmed its commitment to this vision by approving a $5 million loan to the Sioux Falls Regional Airport Authority. This investment is contingent upon a matching contribution of at least $5 million from the State of South Dakota, whether in the form of a loan, grant, or subsidy.
We urge the legislature to appropriate state funds to support the planned expansion of the Sioux Falls Regional Airport. This project will add a minimum of four new gates and significantly increase terminal capacity—essential improvements to meet the region’s rising demand for air travel and to maintain South Dakota’s competitiveness in the airline, tourism, and business sectors.
Investing in airport infrastructure today ensures long-term economic benefits for the entire state.
4. The City Council supports legislation that appropriates additional funds to increase our water capacity to sustain our state’s growing population and economic opportunities. The City Council urges your favorable consideration of the Dakota Mainstem funding request of $750,000 that will allow it to conduct needed engineering and assessment planning. The Dakota Mainstem project is a grassroots effort that started with 29 water systems and cities and has grown to more than 50 members located in South Dakota, Iowa, Nebraska, and Minnesota.

Notice is given that the City of Sioux Falls Water Division, 2100 N Minnesota Avenue, Sioux Falls SD 57104, has filed an application for a future use permit. Application 8985-3 proposes to appropriate and reserve for future use 5,041 acrefeet of water annually from the Big Sioux: South Aquifer. The area to be reserved for future use is located in Sections 1, 2, 9 through 12, 15, 16, 19, 21, 22, 26 through 30, 31 tlll’ough 34, all in Tl 01N-R49W; Sections 24, 25, 36, all in Tl 0 1NR50W; Sections 9 and 10, both in Tl00N-R50W; Sections 25 and 36, both in Tl02N-R49W; Sections 29 through 32, all in T102N-R48W; Sections 9 through 12, 13 through 16, 21 through 23, 26through 28, 33 through 35, all in T101N-R48W; and Sections 11 through 14, 22 through 24, all in Tl 00N-R49W. The water is reserved for future water supplies for municipal use by the City of Sioux Falls in Minnehaha and Lincoln Counties. This application does not authorize construction of works or application of water to beneficial use. This future use area is located paitially within the city limits of Sioux Falls and west and south of Brandon SD.
Pursuant to SDCL 46-2A-2, the Acting ChiefEngineerrecommends APPROVAL of Application No. 8985-3 because 1) there is reasonable probability that there is unappropriated water available for the applicant’s proposed use, 2) the City of Sioux Falls has demonstrated a reasonable need for the water reserved, 3) the proposed use is a beneficial use and 4) it is in the public interest as it pertains to matters within the regulatory authority of the Water Management Board. RESOLUTION AUTHORIZING THE EXECUTION, DELIVERY AND PERFORMANCE OF (i) A SUPPLEMENT TO A CERTAIN SUBLEASE AGREEMENT BETWEEN THE SCHOOL DISTRICT, AS TENANT, AND THE SOUTH DAKOTA BOARD OF TECHNICAL EDUCATION, AS LESSOR, AND (ii) CERTAIN RELATED MATTERS IN CONNECTION THEREWITH
RECITALS
WHEREAS, SIOUX FALLS SCHOOL DISTRICT NO. 49-5 (the “School District”) is authorized pursuant to law to operate Southeast Technical College, a post secondary vocational technical education college under the general supervision of the South Dakota Board of Technical Education (the “Board”); and
WHEREAS, the South Dakota Health and Educational Facilities Authority (the “Authority”) is authorized pursuant to Chapter 1-16A, South Dakota Codified Laws, to issue bonds to finance the acquisition, improvement, repairing and equipping of post-secondary vocational technical education facilities for lease to and purchase by the Board and/or for use by the School District and other school districts or LEAs authorized to operate post-secondary vocational technical education programs (all such School Districts and LEAs being referred to herein as “Qualified Participating Institutions”); and
WHEREAS, Title 13, SDCL, provides that to secure lease purchase rentals payable by participating institutions and the Board to the Authority, the Board may pledge certain amounts of tuition and other student fees required to be paid to the Escrow Holder for deposit into the Tuition Subaccount; and
WHEREAS, the Authority has established a program (the “Program”) whereby the Board may lease purchase post-secondary vocational technical education facilities from the Authority and sublease such facilities to the Participating Institutions; and
WHEREAS, the Authority and the statutory predecessor to the Board have heretofore entered into a Lease Purchase Agreement dated as of August 1, 1988 as supplemented by various Supplements to Lease Purchase Agreement through and including that certain a Twenty-Second Supplement to Lease Purchase Agreement dated as of May 1, 2022 (collectively, all of the foregoing are referred to as the “Lease”) pursuant to which the Board is leasing with an option to purchase certain facilities the acquisition of which was financed or refinanced with the proceeds derived from the issuance and sale by the Authority of its Vocational Education Program Revenue Bonds of various series (collectively, the “Bonds”) issued pursuant to an Indenture of Trust dated as of August 1, 1988 (the “Original Indenture”) between the Authority and The First National Bank in Sioux Falls, as Trustee (the “Original Trustee”) as most recently amended and supplemented by that certain Twentieth Supplemental Indenture of Trust dated as of May 1, 2022 (collectively, all of the foregoing are referred to as the “Indenture”) between the Authority and U.S. Bank Trust Company, National Association, as successor Trustee (the “Trustee”); and
WHEREAS, in order to provide a credit against Lease Rentals owed by the Board under the Lease, the Participating Institutions have heretofore entered into a certain Amended and Restated Facility Fee Tuition Collection and Deposit Agreement (the “Collection Agreement”) with the Board, the South Dakota Treasurer (the “Treasurer”) and The First National Bank in Sioux Falls, as Escrow Holder (the “Original Escrow Holder” and, together with the successor Escrow Holder, U.S. Bank Trust Company, National Association, the “Escrow Holder”), providing for the collection of Facility Fees on a current basis and the deposit of such Facility Fees to the Tuition Subaccount (an account of the Treasurer’s maintained with the Escrow Holder); and
WHEREAS, pursuant to a Sublease dated as of August 1, 1988 between the Board and the School District (as heretofore supplemented and amended, the “Original Sublease”), the School District is currently leasing certain improvements described therein from the Board; and
WHEREAS, the Authority proposes to issue one or more new series of refunding bonds (the “Refunding Bonds”) in a principal amount not to exceed $34,000,000 to refund the outstanding principal amount of the following Bonds of the Authority: (a) the Vocational Education Program Refunding Bonds, Series 2015A (the “Series 2015A Bonds”), (b) the Vocational Education Program Bonds, Series 2015B (the “Series 2015B Bonds”) and (c) the Vocational Education Program Revenue Bonds, Series 2015C (the “Series 2015C Bonds” and together with the Series 2015A Bonds and Series 2015B Bonds, the “Refunded Bonds”); and
WHEREAS, the Series 2015C Bonds were issued in part to finance the costs of a Transportation Technology Center and other campus improvements for use by the School District (the “Refunded Project”) pursuant to the Original Sublease; and
WHEREAS, the issuance of the Refunding Bonds will refinance such Refunded Project and have the result of shortening the term of the Sublease and reducing the aggregate Sublease rentals; and
WHEREAS, it is necessary for the School District to enter into a Supplement to the Original Sublease to adjust the rentals payable thereunder to reflect debt service on the Refunding Bonds (“Supplemental Sublease”); and
WHEREAS, the Refunding Bonds are to be issued pursuant to a new Supplemental Indenture of Trust between the Authority and the Trustee (the “Supplemental Indenture”); and
WHEREAS, the Authority, Board and various other parties will enter into (1) a new Supplemental Lease Purchase Agreement between the Authority and the Board (the “Lease Supplement”), (2) a Bond Purchase Agreement with Baird Securities (the “Original Purchaser”) (the “Bond Purchase Agreement”) and (3) a Continuing Disclosure Agreement (the “Continuing Disclosure Agreement”) in forms substantially similar to those previously used in connection with the Program, as modified, revised or supplemented to incorporate the terms hereof or otherwise in the manner herein provided or contemplated; and
WHEREAS, the School District has determined it is in the best interest to enter into a supplement the Original Sublease by entering into the Supplemental Sublease (the Original Sublease as amended and supplemented by the Supplemental Sublease and hereafter further amended or supplemented being referred to herein as the “Sublease”);
NOW THEREFORE, BE IT RESOLVED, by the School Board of the School District as follows:
THE PROGRAM
1.1 This School District Board finds that it is desirable and expedient to authorize the amendment to the Original Sublease in order to permit the Authority and the Board to issue the Refunding Bonds pursuant to the Supplemental Indenture. By adoption of this Resolution and the execution of the Supplemental Sublease, this School District Board ratifies and confirms the authorization of the imposition, collection and allocation of the Facility Fees for the benefit of the Board, the Authority and the holders from time to time of all Outstanding Bonds as provided in the Amended and Restated Collection Agreement.
1.2 This School District Board hereby authorizes the execution and delivery of the Supplemental Sublease. In addition, this School District Board hereby authorizes, ratifies and confirms that fee title to the land and building in which the Refunded Project is located shall be in the name of the Authority, subject to the rights of parties to the Lease and the Sublease.
1.3 The execution and delivery by the President and the Business Manager, or in their absence any other officer of the School District (collectively, the “Authorized Officers”), of the Supplemental Sublease, any additional or supplemental documents required in connection with any Additional Bonds, the Continuing Disclosure Agreement (if required by the parties) and other instruments described herein (collectively, the “Program Documents”), shall be conclusive evidence of such authorization without any further requirement of approval or authorization from this School Board. The Supplemental Sublease and other Program Documents shall be executed in the name and on behalf of the School District by the Authorized Officers, in substantially the form of previous supplemental subleases for the Program, but with all such changes therein, not inconsistent with law, as may be approved by the officers executing the same, which approval shall be conclusively evidenced by the execution thereof.
1.4 The Authorized Officers, or any one of them, shall be hereby authorized and directed to prepare and furnish to the Trustee, certified copies of all proceedings and records of the School District relating to the power and authority of the School District to execute and deliver the Supplemental Sublease, and certificates as to matters within their knowledge or as shown by the books and records under their custody and control, including a general and non-litigation certificate, any tax certificate and agreement relating to the Refunding Bonds and matters governed by Section 148 of the Internal Revenue Code of 1986, as amended. Such certified copies and certificates shall be deemed representations, covenants and agreements of the School District as to the facts, covenants and agreements contained therein.
E. Accepting the Consolidated Report of Trust and Agency Funds of September for receipts and disbursements through September 2025 stating for the record receipts total $8,879,339.68 and disbursements total $8,131,842.74 (see MRF #19837),
F. Approving financial transactions (see MRF #19838 on file in the Finance Office for reference purposes).
G. Accepting the K-12 Personnel Report, as follows:

Kristin Grinager, High School Curriculum Coordinator, presented Graduation Rates and Freshmen Transition to Tenth Grade report as follows (MRF #19840):
The Sioux Falls School District (SFSD) continues to strengthen student outcomes, with on-time graduation rates rising from 84.8% in the 2019-20 school year to 88.7% in the 2024-25 school year, nearly three points above the state average. The District’s “Completer Rate”, which includes students who earn a diploma or complete their high school requirements within five years, remains strong at 90.4%, reflecting effective support systems that help students stay engaged and finish high school, even if additional time is needed.
Strong early high school supports play a major role in these results. The Summer Connections Program helps incoming ninth graders build relationships, understand expectations, and feel prepared before the year begins. During the school year, the Freshmen Academy provides a structured, team-based model that includes mentoring and coordinated interventions. This approach has proven highly effective, with more than 95% of students in the Freshmen Academy advancing to tenth grade each year. The program serves roughly 80% of ninth graders districtwide and continues to be a key driver of early high school success.
High schools reinforce this foundation with credit recovery options, academic counseling, advanced coursework, and regular progress monitoring. These combined efforts have increased the total number of on-time graduates while reducing the number of students pursuing GEDs.
Together, these multi-layered strategies reflect a districtwide commitment to preparing every student for graduation and success beyond high school.

Todd Vik, Business Manager, presented the Budget Guidelines and Timeline report, as follows (MRF#19841):
A committee of Sioux Falls School District administration, two school board members, and various staff have developed the proposed budget timeline and guidelines for the FY27 Budget of all funds of the District.
The timeline again contains two public information sessions to be held on March 25, 2026, and on April 1, 2026, to allow for additional community review of budget recommendations prior to the Board’s tentative budget adoption at the first regular school board meeting on April 13, 2026.
The guidelines require most General and Special Education cost centers to include three levels of funding:
● Level Three: 100% of prior year program
● Level Two: 99% of prior year program
● Level One: 98% of prior year program (depending on whether cuts were made the prior year)
The guidelines also require Central Leadership and Budget Advisory teams to prepare significant reduction line items in the Committed Funds cost center.
fifth-grade class was larger than the incoming kindergarten cohort. Middle school enrollment increased by 62 students, and high school enrollment declined by 93. Open enrollment grew slightly to 1,033 students.
The opening of Marcella LeBeau Elementary School with 281 students affected enrollment at nearby schools, including Hawthorne, Renberg, and Hayward. The Elementary Immersion Center closed, with students now attending other schools in the district.
Fall funding FTE is 24,136, which is 194 fewer than last year. Overall, enrollment reflects modest shifts across grade levels due to school openings and closures, while middle school and open enrollment continue to grow steadily.

The Sioux Falls School District is requesting to apply for a waiver from South Dakota Administrative Rule 24:28:16:02.01.(3). Eligibility for reciprocity for international educators. The teacher impacted by this waiver application is Maria Elena Martinez, Sonia Sotomayor Elementary.
24:28:16:02.01.(3). Eligibility for reciprocity for international educators
The secretary may issue an educator certificate to an international applicant for reciprocity certificate, if the applicant:
(1) Holds the U.S. equivalent of a bachelor’s degree or higher, as shown by a course-by-course credential report of university-level credit completed by an agency approved by the Association of International Credential Evaluators or the National Association of Credential Evaluation Services that states the course title, grade, and number of semester credit hours earned for each course and the U.S. equivalency of the degree earned;
(2) Provides documentation showing completion of a program equivalent to a department-approved educator preparation program; and
(3) Submits:
a) Documentation showing that the applicant holds a foreign educator credential in a teaching field comparable to a field recognized in South Dakota; or
b) Documentation, completed by the superintendent, principal, agency director, or designated personnel officer of the foreign school where the applicant is currently or was previously employed, showing that the applicant has at least three years of experience in the applicant’s certification area within the previous five calendar years.

This executive session was held in accordance with Sioux Falls School District Policy/Regulation JK/JK-R, SDCL §13-32-4, 4.2 and 7 and South Dakota Administrative Rule 24:07:04:03. Following general discussion and a review of the evidence, a motion was made by Marc Murren and seconded by Gail Swenson, four (4) votes “yes” on roll call, to uphold the decision of the administration to expel one (1) student for twelve (12) months.

WHEREAS, there is a need to fill three forthcoming vacancies on the Museum Board due to the expiration of terms of three current members; and,
WHEREAS, one current member, with an expiring term, is eligible for reappointment to the Museum Board; and,

BRIDGE INSPECTION REVIEW

Commissioners Bleyenberg and Heisey thanked all the applicants for the open board seats as well as the outgoing members for their hard work and dedication.
