Mike Curtis asked about what the city’s process is going to be about possible future deportations of immigrants in Sioux Falls.
Sam Clikeman spoke about receiving his wine license and about expanding his business in Sioux Falls. He spoke about how impressed he is with Sioux Falls, so much so that his family is moving to Sioux Falls soon.
Sierra Broussard spoke about Tzadik Property Management in Sioux Falls.
Adam Buss asked about the need for digital signage on Rice Street in regards to the long train traffic along that route.
Chad Bishop spoke about diversity, equity and inclusion in policy and language in city government.

WHEREAS, the City of Sioux Falls, 224 W. 9th St., P.O. Box 7402, Sioux Falls, SD 57117 7402 (the Lessor), and Sioux Falls School District 49-5 201 E. 38th St., Sioux Falls, SD 57105, (the Lessee).
WHEREAS, Sioux Falls School District 49-5 wishes to enter into a lease located at 1200 North Western Ave., Sioux Falls, SD, a.k.a. Howard Wood Field. ORDINANCE NO. 101-24
AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AMENDING THE CODE OF ORDINANCES OF THE CITY BY AMENDING CHAPTER 117: PEDDLERS AND VENDORS.
BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That the definition of PEDDLER in Section 117.001 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.001 DEFINITIONS.
PEDDLER. As used in this chapter means any person, whether a resident of this city or not, traveling from place to place, from house to house, or from street to street for the purpose of selling or soliciting for sale of goods, wares, merchandise or services, including food and beverages not intended to be immediately consumed, and shall also mean and include any person transacting a temporary business within the city. This definition does not include mobile food vending in compliance with Chapter 117 of this Code.
Section 2. That Section 117.021 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.021 APPLICATION.
Applicants will have 15 days to complete the permitting process. Any incomplete application 15 days or older will require a new application fee and background recheck. The application for a permit required by the provisions of this subchapter shall include at least the following information:
(a) A statement as to whether or not the applicant has been convicted of any crime, misdemeanor, or violation of any state or federal law or municipal ordinance or code other than traffic offenses; the nature of the offense; the punishment or penalty assessed therefor, if previously convicted; and the place of conviction;
(b) Whether the applicant, upon any sale or order, shall demand, accept, or receive payment or deposit of money in advance of final delivery;
(c) The period of time the applicant wishes to engage in business within the city;
(d) The local and permanent addresses of the applicant;
(e) The local and permanent addresses and the name of the entity, if any, that the applicant represents;
(f) The kind of goods, wares, merchandise, or services the applicant wishes to peddle within the city;
(g) The cities or towns wherein the applicant has worked as a peddler for the last five years prior to application; and
(h) The applicant’s date of birth, state of issuance and government picture identification number, and social security number or other identifying number.
(i) The state of South Dakota sales tax number for the applicant and/or the entity that the applicant represents.
Section 3. That Section 117.022 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.022 INVESTIGATION, EXAMINATION OF APPLICANT.
(a) The application for a peddler permit shall be investigated by the police chief or his or her designee. No permit shall be granted to any person:
(1) Who has an active warrant relating to any offense;
(2) Who has been convicted for a sex crime as defined by SDCL 22-24B-1 or any indecent exposure for which he or she is still subject to sex offender registration requirements;
(3) Who has a conviction or date of discharge from prison, jail, probation, or parole within the last five years of application for all other indecent exposures;
(4) Who has a conviction or date of discharge from prison, jail, probation, or parole within the last ten years of application for a crime of violence as defined by SDCL 22-1-2(9);
(5) Who has a conviction or date of discharge from prison, jail, probation, or parole within the last ten years of application for any burglary;
(6) Who has a conviction or date of discharge from prison, jail, probation, or parole within the last five years of application for a felony possession or distribution of controlled substances;
(7) Who has a conviction or date of discharge from prison, jail, probation, or parole within the last five years of application for any offense involving theft or fraud;
(8) Who has knowingly omitted or provided false information on the application; or
(9) For any good cause.
(b) Convictions in other states considered. Any known conviction for an offense in another state which, if committed in this state, would be a violation of one of the offenses listed in subsection (a) shall be used to determine if an applicant is eligible for a permit.
(c) Any denial of an application for permit may be appealed through the procedures established by the administrative code provisions of this code according to the procedure set forth in § 30.040.
Section 4. That Section 117.042 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.042 VENDING OUTSIDE CENTRAL BUSINESS DISTRICT.
Vending goods, wares, merchandise, and/or services outside the central business district is permitted upon receipt of a peddler’s license. Vending food and beverages outside the central business district requires a mobile food vending permit or a health permit if not classified as a mobile food vendor.
Section 5. That the definition of FURNITURE ZONE LIMITED LEASE in Section 117.061 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.061 DEFINITIONS.
FURNITURE ZONE LIMITED LEASE. An annual limited lease granted by the city to a sidewalk café or pub licensed to serve alcoholic beverages, which shall convey the exclusive right to the use of a portion of the city’s right-of-way to the adjoining business only for those business purposes designated in the lease, which shall include the sale and service of alcoholic beverages. A partial-year limited lease may also be granted by the city to a parklet.
Section 6. That Section 117.067 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.067 APPLICATION FOR PERMIT OR LEASE.
(a) All applicants for furniture zone use permits or furniture zone limited leases shall complete an online application. Any permit or limited lease shall be granted on forms prepared by the city.
(b) Applicants requesting to extend the furniture zone into the public right-of-way, which would otherwise be used for vehicle parking, shall be subject to the additional rules in § 117.099.
Section 7. That Section 117.110 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.110 SPECIAL EVENTS.
Any downtown special event which has been approved by the city’s special event committee may be exempt from the requirements of this chapter.
Section 8. That Section 117.111 of the Code of Ordinances of Sioux Falls, SD, is hereby repealed:
§ 117.111 (REPEALED)
Section 9. That Section 117.112 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.112 SPECIAL EVENT PREEMPTION OF FURNITURE ZONE USE.
Certain special events conducted by Downtown Sioux Falls, Inc. for the betterment and promotion of downtown may be designated as promotional. Any designated promotional event may preempt any approved sidewalk use within the event venue area during the event time upon 30 days’ written notice to the affected permit/leaseholder(s).
Section 10. That Section 117.120 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.120 DEFINITIONS.
For the purposes of this subchapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
APPLICANT. As used in this chapter means the primary person conducting sale or service of food or beverages, or the primary operator of a mobile food truck.
MOBILE FOOD TRUCK. A licensed and operable vehicle or concession trailer, which is enclosed and self-contained, independent with respect to water, sewer, and power utilities, that contains equipment for the preparation and sale or service of food or beverages with or without charge which are designed for immediate consumption.
MOBILE FOOD VENDING. The act of preparation and sale or service of food or beverages with or without charge that are designed for immediate consumption.
MOBILE FOOD VENDOR. As used in this chapter means any person or entity conducting the sale or service of food and beverages with or without charge that are designed for immediate consumption in the public right-of-way or on private property.
OPERATE. Shall mean all activities associated with the conduct of mobile food vending, including setup and takedown and/or actual hours where the mobile food vending unit is open.
PRIMARY OPERATOR. The registered owner of a mobile food truck or the owner’s designated agent.
Section 11. That Section 117.123 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.123 MOBILE FOOD VENDING PERMIT ISSUANCE AND FEES.
(a) Prior to any mobile food vending permit being issued under the provisions of this subchapter, the applicant shall have all applicable state and city permits and licenses, shall pay an application fee of $75, and submit to and pass a background check pursuant to § 117.125.
(b) The primary person or operator is required to obtain a mobile vending permit for each operating mobile food truck and shall not transfer the permit between persons or vehicles.
(c) Permit shall remain in effect until December 31 of the year of issuance.
(d) Permit fees shall be as follows:

Section 12. That Section 117.126 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.126 BACKGROUND CHECK.
(a) A background check will be conducted annually by the Sioux Falls Police Department with all applicable information being provided.
(b) The applicant for a permit required by this subchapter shall submit to photographing by the police department.
(c) No permit shall be granted to any person:
(1) Who has an active warrant relating to any offense.
(2) Who does not possess a valid driver’s license.
(3) Who has been convicted for a sex crime as defined by SDCL 22-24b-1 or any indecent exposure for which they are still subject to registration requirements.
(4) Who has a conviction or date of discharge from prison, jail, probation, or parole within the last five years for all other indecent exposure (Class 1 misdemeanor).
(5) Who has a conviction or date of discharge from prison, jail, probation, or parole within the last ten years of application for a crime of violence as defined by SDCL 22-1-2(9).
(6) Who has a conviction or date of discharge from prison, jail, probation, or parole within the last five years of application for a felony possession/distribution of controlled substances.
(7) For any good cause.

Section 14. That Section 117.129 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.129 DISPLAY OF PERMIT.
Primary operators having a permit issued under the provisions of this subchapter shall display their permit at all times in a conspicuous place where it can be read by the general public.
Section 15. That Section 117.130 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.130 REVOCATION.
Any permit issued under the provisions of this subchapter may be revoked for violation of any provision of this Code, state law, or city ordinance by the Sioux Falls Police Department or other licensing authority within the city. Upon the revocation, the permit shall immediately be surrendered, and failure to do shall be an offense.
Section 16. That Section 117.131 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.131 ALLOWED MOBILE VENDING LOCATIONS.
(a) Mobile food vending is permitted on the public right-of-way inside the central business district as defined by § 37.106 and is also permitted in the public right-of-way abutting C-2, C-3, C-4, I-1, and S-2 zoning districts as per the official zoning map of the city of Sioux Falls. Mobile food vendors must be actively engaged in mobile food vending operations at all times while parked in any allowed mobile vending location;
(b) Mobile food vending is permitted on private property inside the central business district as defined by § 37.106 and is also permitted on private property within the DT-PUD, C-2, C-3, C-4, I-1, and S-2 zoning districts as per the official zoning map of the city of Sioux Falls. Mobile food vendors must be actively engaged in mobile food vending operations at all times while parked in any allowed mobile vending location.
Section 16. That Section 117.137 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.137 FIRE SAFETY.
(a) No mobile food vendor shall operate without a completed and approved fire inspection by Sioux Falls Fire Rescue in the current year, which shall include proof of an annual third-party inspection or receipt of propane fill or gas-related capabilities as applicable;
(b) No mobile food vendor shall vend from within parking garages, overhangs, or within 10’ of any entrance to any property.
Section 17. That Section 117.139 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read:
§ 117.139 PROHIBITED CONDUCT.
No mobile food vendor shall:
(a) Vend on the public right-of-way within 50 feet of a licensed restaurant property line or 50’ from a sidewalk patio, whichever is greater, unless the restaurant is closed for business.
(b) Operate a mobile food truck or vending stand within 300 feet of any sanctioned event held in the central business district without obtaining permission from the event sponsor;
(c) Operate in or abutting a city park without proper permissions and permits from the parks and recreation department;
(d) Place any object that blocks the pedestrian pathway;
(e) Utilize signage in addition to what is already permanently displayed on the mobile food truck;
(f) Conduct mobile food vending from an unhooked concession trailer in the public right-of- way;
(g) Operate without commercial license plates. This applies to vehicles pulling a food trailer or self-contained mobile food trucks without a trailer

BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That Section 77.003 of the Code of Ordinances of Sioux Falls, SD, is hereby amended to read
§ 77.003 PLACES WHERE STOPPING, STANDING OR PARKING PROHIBITED.
Except when necessary to avoid conflict with other traffic, or in compliance with law or the directions of a law enforcement officer, no person shall stop, stand or park a vehicle:
(a) On the roadway side of any vehicle stopped or parked at the edge or curb of a street;
(b) On a sidewalk; unless the vehicle is attended and is being loaded or unloaded and the area adjacent to the sidewalk has been designated by appropriate signs as a sidewalk loading zone by the city engineer or unless the vehicle is properly identified as a vehicle for transporting of disabled persons, it is necessary for the vehicle to be located on the sidewalk for loading and unloading purposes, and only two wheels on the loading/unloading side are on the sidewalk;
(c) Within an intersection;
(d) On a crosswalk;
(e) Between a safety zone and the adjacent curb or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless a different length is indicated by signs or markings;
(f) Alongside or opposite any street excavation or obstruction, when stopping, standing or parking would obstruct traffic;
(g) Upon any bridge or other elevated structure upon a highway or within a highway tunnel;
(h) On any railroad tracks;
(i) Upon any street, alley or parkway for the purpose of selling or offering the same for sale or rent. Any vehicle that is parked or placed within 50 feet of the property of the residence of the owner of the vehicle is exempt from the provisions of this section; and
(j) In such a manner as to leave available less than ten feet of the roadway from the portion of the vehicle nearest to the center line of the road for the free movement of vehicular traffic in their lane of travel on Phillips Avenue between Ninth and 13th Streets. A violation of this subsection shall be subject to the penalty provisions of § 77.999. The effective date of this subsection shall be May 1, 2025.

An application has been submitted to the Foreign-Trade Zones (FTZ) Board by the Sioux Falls Development Foundation, grantee of FTZ 220, requesting subzone status for the facility of Wurth Electronics Midcom, Inc., located in Watertown, South Dakota. The application was submitted pursuant to the provisions of the Foreign-Trade Zones Act, as amended (19 U.S.C. 81a– 81u), and the regulations of the FTZ Board (15 CFR part 400). It was formally docketed on November 20, 2024.
The proposed subzone (8.03 acres) is located at 121 Airport Drive, Watertown, South Dakota. No authorization for production activity has been requested at this time. The proposed subzone would be subject to the existing activation limit
of FTZ 220.
In accordance with the FTZ Board’s regulations, Camille Evans of the FTZ Staff is designated examiner to review the application and make recommendations to the Executive Secretary.
Public comment is invited from interested parties. Submissions shall be addressed to the FTZ Board’s Executive Secretary and sent to: ftz@trade.gov. The closing period for their receipt is January 6, 2025. Rebuttal comments in response to material submitted during the foregoing period may be submitted through January 21, 2025.

Bids for the construction of the Project will be received at the office of the Owner located at 130 St. Olaf Avenue, Baltic, South Dakota, 57003, until Tuesday, December 17th at 3:00 pm local time. At that time the Bids received will be publicly opened and read.
The Project includes the following Work:
Installation of sanitary sewer lift station, sanitary sewer forcemain, and other associated work as required per the project specifications.

Bidding Documents may be downloaded from the designated website. Prospective Bidders are urged to register with the designated website as a plan holder, even if Bidding Documents are obtained from a plan room or source other than the designated website in either electronic or paper format. The designated website will be updated periodically with addenda, lists of registered plan holders, reports, and other information relevant to submitting a Bid for the Project. All official notifications, addenda, and other Bidding Documents will be offered only through the designated website. Neither Owner nor Engineer will be responsible for Bidding Documents, including addenda, if any, obtained from sources other than the designated website.

Prospective Bidders may obtain or examine the Bidding Documents at the Issuing Office on Monday through Friday between the hours of 8:00 am – 5:00 pm, and may obtain copies of the Bidding Documents from the Issuing Office as described below. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including addenda, if any, obtained from sources other than the Issuing Office.
Bidding Documents may be downloaded online at the designated website. Resident South Dakota contractors who intend, in good faith, to bid upon this project may obtain a paper set of these documents free of charge. Non-resident contractors may receive these documents upon payment of $100.00, none of which is refundable.
All submitters shall have a valid South Dakota Contractor’s license of the appropriate Class for the work as required by ARSD 20:53:06 or SDCL 36-25. Submitters shall include a copy of their renewal within their package. No submittal will be considered unless it fully complies with the proof of bond and license requirements.
This project may be partially funded using American Rescue Plan Act (ARPA) funds. Refer to instructions to Bidders section of the specification for ARPA requirements.
Bidders on this work will be required to comply with Title 40 CFR 33 and Executive Order 12138. The requirements for bidders and contractors under this regulation which concerns utilization of Disadvantaged/Minority Business Enterprises (DBE/MBE) and Women’s Business Enterprises (WBE) are explained in the specifications. The DBE/MBE and WBE goals for participation in this contract in terms of percentage of contract value are as follows: MBE 1.0 percent; WBE 4.0 percent.
Bidders on this work will be required to comply with the President’s Executive Order Nos. 11246 as amended, 11518 and 11625 as amended. The requirements for bidders and contractors under these orders are explained in the specifications.
To be considered a responsive bidder, the bidder must certify to compliance with the American Iron and Steel provision of the Consolidated Appropriations Act of 2014. This certification form may be found on page AIS-21 of the State Revolving Fund (SRF) General Conditions and must be included in the bid proposal.
Davis Bacon and Related Acts wages apply to this project. All provisions relative to those acts must be met.
The low responsive bidder must assure compliance with the requirements of Public Law 115-232, Section 889, Prohibition on Certain Telecommunications and Video Surveillance Services or Equipment. Contractors must assure that telecommunications equipment produced by Huawei Technologies Company or ZTE Corporation (or any subsidiary or affiliate of such entities), and video surveillance and telecommunications equipment produced by Hytera Communications Corporation, Hangzhou Hikvision Digital Technology Company, or Dahua Technology Company (or any subsidiary or affiliate of such entities) WILL NOT be supplied for the project.
Submitters of this work will be required to comply with State Revolving Fund (SRF) General Conditions including the requirements of Minority and Women Business Enterprise procurement, Equal Employment Opportunity, Davis-Bacon wage rates, American Iron and Steel Act of 2014 (AIS), Certification of Debarment, and all other pertinent legislation and rules associated with the Clean Water SRF Program and South Dakota Codified law.
The City of Baltic reserve the right to reject any or all bids, waive technicalities, and make award(s) as deemed to be in the best interest of the City of Baltic, SD.
