ORDINANCE NO. 46-25
AN ORDINANCE OF THE CITY OF SIOUX FALLS, SD, AUTHORIZING THE MAYOR TO ENTER INTO A NAMING AGREEMENT FOR INTERIOR SPACES IN THE FIRST TEE BUILDING N/K/A DENNY SANFORD LEARNING CENTER.
WHEREAS, Elmwood Golf Course is located on property owned by the City located at 2604 West Russell Street, Sioux Falls, SD 57104; and
WHEREAS, the City desired to partner with First Tee and construct Improvements which will be known as the First Tee building (the “Building”) located adjacent to the Elmwood Clubhouse on City property; and
WHEREAS, the City entered into a “Conditional Gifting Agreement for Future Cash Gift for the Constructing of the First Tee Building to be located at Elmwood Golf Course,” City Agreement No. 24-4333, wherein the terms of the gift gave the City ownership of the Building upon construction completion; and
WHEREAS, the City, following a first reading on February 20, 2024, and a second reading on March 5, 2024, approved Landscape Golf Management Company of Lincoln, NE (“Golf Course Manager”) lease of the Building to First Tee by adopting Ordinance 12-24 (the “Lease”), which is attached as Exhibit A and incorporated into this Agreement by reference; and
WHEREAS, in Section 9 of the Lease, First Tee, as tenant of the Building, may pursue naming rights agreements for the Building, and such naming rights agreements shall not exceed the term of the Lease, be subject to the City’s right to buyout and early termination rights in Section 2 of the Lease, and comply with applicable ordinances of the Code of Ordinances of Sioux Falls, South Dakota; and
WHEREAS, First Tee seeks to
name various interior spaces in the Building in recognition of donors and donations received to fund the construction of the Improvements to the Building; and
WHEREAS, Don and Ann Platt made a significant contribution to First Tee in consideration for naming the putting green the “Don and Ann Platt Putting Green at the Denny Sanford Learning Center” and may be referred to as the “Don and Ann Platt Putting Green” on any signage; and
WHEREAS, the Austad Family made a significant contribution to First Tee in consideration for naming the simulator room the “Austad Family Simulator Room at the Denny Sanford Learning Center” and may be referred to as the “Austad Family Simulator Room” on any signage; and
WHEREAS, the Boys of Summer Cup (BOSC) made a significant contribution to First Tee in consideration for naming the outdoor room the “BOSC Outdoor Room at the Denny Sanford Learning Center” and may be referred to as the “BOSC Outdoor Room” on any signage; and
WHEREAS, Showplace Cabinetry made a significant contribution to First Tee in consideration for naming the kitchen the “Showplace Cabinetry Kitchen at the Denny Sanford Learning Center” and may be referred to as the “Showplace Cabinetry Kitchen” on any signage; and
WHEREAS, Petition No. 2025-03 was submitted by First Tee to the City to name the outdoor room, Petition No. 2025-04 was submitted by First Tee to the City to name the simulator room, Petition No. 2025-05 was submitted by First Tee to the City to name the kitchen; and Petition No. 2025-06 was submitted by First Tee to the City to name the putting green; and
WHEREAS, First Tee and the City agree that naming rights for the putting green shall be for the term of the lease; and
WHEREAS, First Tee and the City agree that the naming rights for the simulator room shall be for a period of five (5) years; and
WHEREAS, First Tee and the City agree that the naming rights for the outdoor room shall be for a period of five (5) years; and
WHEREAS, First Tee and the City agree that the naming rights for the kitchen shall be for a period of ten (10) years; and
WHEREAS, on June 18, 2025, the Sioux Falls Parks and Recreation Board considered Naming Petition No. 2025-03, Naming Petition 2025-04, Naming Petition 2025-05, and Naming Petition 2025-06, and the “Naming Agreement for Interior Spaces in the First Tee Building n/k/a Denny Sanford Learning Center” and unanimously recommended City Council approval.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF SIOUX FALLS, SD:
Section 1. That the document attached to and made a part of this ordinance entitled, “Naming Agreement for Interior Spaces in the First Tee Building n/k/a Denny Sanford Learning Center,” naming the putting green as the “Don and Ann Platt Putting Green at the Denny Sanford Learning Center” and may be referred to as the “Don and Ann Platt Putting Green” on any signage; referring to the simulator room as the “Austad Family Simulator Room at the Denny Sanford Learning Center” and may be referred to as the “Austad Family Simulator Room” on any signage; naming the outdoor room as the “BOSC Outdoor Room at the Denny Sanford Learning Center” and may be referred to as the “BOSC Outdoor Room” on any signage; and naming the kitchen as the “Showplace Cabinetry Kitchen at the Denny Sanford Learning Center” and may be referred to as the “Showplace Cabinetry Kitchen” on any signage is hereby approved.
Section 2. That the Mayor is authorized to sign the “Naming Agreement for Interior Spaces in the First Tee Building n/k/a Denny Sanford Learning Center,” after it is ratified and executed by First Tee.
Section 3. That the City shall publish the ordinance, without attachment, after its passage. The attachment is on file and available for inspection in the office of the City Clerk.

NOTICE OF PUBLIC MEETING FOR THE CLEAN WATER FACILITY PLAN FOR THE SOUTHEAST BASINS SANITARY SEWER IMPROVEMENTS
Sioux Falls, South Dakota: The City of Sioux Falls has identified the southeast region of the city to accommodate future growth needs. A Southeast Basins Sanitary Sewer Study was completed in 2021. The study recommends constructing a backbone, gravity sanitary sewer trunk line, a pump station, and a sanitary sewer force main to accommodate the future growth. This project will be constructed in phases and installed along the north side of Lincoln County Highway 106, from Western Ave. to SD Highway 11, and from SD Highway 11 to the north to 57th St. When fully constructed, this project will open approximately 6,000 acres for development.
These projects will utilize the Clean Water State Revolving Fund (CWSRF) for design and construction. The City is proposing to apply for a new CWSRF loan for the first phase of the project. This phase will include a gravity sanitary sewer pipe installation.
The City is seeking to borrow up to $17,746,000 of CWSRF for 20 years at a rate up to 4 percent. The purpose of the meeting is to discuss the proposed projects, the proposed financing, and the source of the repayment of the loan. The public is invited to attend and comment on the project. RESOLUTION NO. 52-25
A RESOLUTION ESTABLISHING THE CITY OF SIOUX FALLS’ PROVISIONAL LEGISLATIVE PRIORITIES FOR THE 2026 STATE LEGISLATIVE SESSION.
WHEREAS, the City Charter states that the Sioux Falls City Council is the policy making and legislative body of the City of Sioux Falls;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF SIOUX FALLS, SD:
1. The Sioux Falls City Council supports legislative efforts aimed at improving outcomes for individuals reentering society after incarceration. This initiative emphasizes a comprehensive approach to public safety, rehabilitation, and community reintegration through three key areas:
Modernization of Parole Services: Updates to current parole systems to ensure they are more efficient and supportive of successful reentry. This includes increasing the number of parole officers, expanding the use of modern technology, case management improvements, and expanding support services.
Financial Support for Felon-Friendly Housing and Job Training Statewide: Recognize that stable housing and employment are critical to reducing recidivism, the Council supports legislation that allocates statewide funding for 1) the development or expansion of initiatives that support individuals with felony records in finding stable and affordable housing; and 2) workforce development programs specifically tailored for formerly incarcerated individuals, including vocational training, certifications, and employment placement services.
Funding a Multi-Agency Parole Absconder Task Force: Establish and fund a specialized task force composed of local and state agencies to locate and apprehend parole absconders. The goal is to improve community safety while maintaining a balanced approach to justice enforcement.
Funding to support 24/7 access to triage assessments: Establish funding for healthcare professionals to provide immediate care and treatment of acute intoxication, substance withdrawal, mental health crisis, and post-sexual assault care. The goal is to address critical service gaps for individuals facing mental health and substance use challenges through a triage facility. Our region offers this innovative approach through the Sioux Falls Link, which opened on June 1, 2021, and has served more than 3,500 individuals and conducted over 13,000 triage assessments. This triage facility is a collaboration between the City of Sioux Falls, Minnehaha County, Avera Health, and Sanford Health.
2. The Sioux Falls City Council recognizes the growing need for meaningful property tax relief across South Dakota. In response to concerns from local homeowners, the City Council acted in 2022 to provide targeted relief by authorizing refunds of up to $500 for the City’s portion of property taxes to residents who qualify for the state’s assessment freeze program for elderly and disabled homeowners. Enabled by the City’s home rule authority, this initiative has provided nearly $800,000 in property tax refunds to eligible residents over the past three years.
We urge the South Dakota Legislature to extend this opportunity to all municipalities by allowing local governments the option to refund their portion of property taxes to those who qualify for the state’s assessment freeze.
3. The City Council recognizes the critical role airports play in driving economic growth, supporting tourism, and strengthening regional access to national and global markets. In July 2025, the City Council reaffirmed its commitment to this vision by approving a $5 million loan to the Sioux Falls Regional Airport Authority. This investment is contingent upon a matching contribution of at least $5 million from the State of South Dakota, whether in the form of a loan, grant, or subsidy.
We urge the legislature to appropriate state funds to support the planned expansion of the Sioux Falls Regional Airport. This project will add a minimum of four new gates and significantly increase terminal capacity—essential improvements to meet the region’s rising demand for air travel and to maintain South Dakota’s competitiveness in the airline, tourism, and business sectors.
Investing in airport infrastructure today ensures long-term economic benefits for the entire state.
4. The City Council supports legislation that appropriates additional funds to increase our water capacity to sustain our state’s growing population and economic opportunities. The City Council urges your favorable consideration of the Dakota Mainstem funding request of $750,000 that will allow it to conduct needed engineering and assessment planning. The Dakota Mainstem project is a grassroots effort that started with 29 water systems and cities, and has grown to more than 50 members located in South Dakota, Iowa, Nebraska, and Minnesota.

NOTICE OF PUBLIC MEETING FOR THE CLEAN WATER FACILITY PLAN FOR THE SOUTHEAST BASINS SANITARY SEWER IMPROVEMENTS
Sioux Falls, South Dakota: The City of Sioux Falls has identified the southeast region of the city to accommodate future growth needs. A Southeast Basins Sanitary Sewer Study was completed in 2021. The study recommends constructing a backbone, gravity sanitary sewer trunk line, a pump station, and a sanitary sewer force main to accommodate the future growth. This project will be constructed in phases and installed along the north side of Lincoln County Highway 106, from Western Ave. to SD Highway 11, and from SD Highway 11 to the north to 57th St. When fully constructed, this project will open approximately 6,000 acres for development.
These projects will utilize the Clean Water State Revolving Fund (CWSRF) for design and construction. The City is proposing to apply for a new CWSRF loan for the first phase of the project. This phase will include a gravity sanitary sewer pipe installation.
The City is seeking to borrow up to $17,746,000 of CWSRF for 20 years at a rate up to 4 percent. The purpose of the meeting is to discuss the proposed projects, the proposed financing, and the source of the repayment of the loan. The public is invited to attend and comment on the project. B5. Acknowledgement of Receipt of Opt-Out Petitions
Acknowledging for the record that 157 petitions were received containing 2,302 signatures while 5,490 valid signatures were needed to refer the decision of the School Board to opt out of the property tax limitation imposed by state statue in the amount of $2,100,000 for ten years, and further declaring the opt out as approved (see Action 39779, adopted 6-23-2025 and MRF# 19763).
B6. Ratification of the Agreement Between the Sioux Falls School District and the Sioux Falls Education Assistants’ Association
Approving terms of the SFEAA Working Agreement, effective July 1, 2025 through June 30, 2028 (on language) and authorizing the Business Manager and President of the Board to sign the Agreement.
B7. Approval of Angel Fund Meal Assistance Program
Per Policy/Regulation EFD-R, approving the Angel Fund meal assistance program through the end of the first semester of 2025-2026 School Year as follows:
1. Only students who have a Free and Reduced Application on file are eligible.
2. Students over 185 percent and up to 210 percent of poverty shall receive free breakfast and lunch via the Angel Fund.
3. All other restrictions contained in EFD-R apply.
The status of the Angel Fund balance and donor commitments will be re-evaluated in November to determine if funding is adequate to continue these guidelines beyond the first
semester.

BRIEFING
Carey Deaver, Human Resources Director, provided a briefing on proposed policy changes following the issuance of Executive Order 14173, which rescinds affirmative action requirements for federal contracts. Discussion followed on revisions to the Equal Employment Opportunity section of the County’s employee handbook as well as the corresponding sections of the department head policies and procedures manual.
Carey Deaver, Human Resources Director, provided a briefing on proposed changes related to the County’s Compensation and Benefits study. Discussion followed on the implementation approach for the new pay plan for non-elected, non-union employees; handbook changes to reflect the new pay plan structure and to adopt benefit changes resulting from McGrath’s Consulting recommendations; and seasonal and variable hour salary ranges and adjustments for 2026.
HOUSING AND REDEVELOPMENT COMMISSION ORDINANCE
Meredith Jarchow, Assistant Commission Administrative Officer, gave the second reading of an ordinance defining residency requirements for appointment to the Minnehaha County Housing and Redevelopment Commission. The proposed ordinance would allow for at most two Commissioners of the Housing and Redevelopment Commissions to be nonresidents of Minnehaha County, given that they reside in a directly adjacent county.
MOTION by Beninga, seconded by Kippley, to Adopt Ordinance MC 69-25 Defining Residency Requirements for Appointment to the Minnehaha County Housing and Redevelopment Commission. By roll call vote: 5 ayes.

AN ORDINANCE DEFINING RESIDENCY REQUIREMENTS FOR APPOINTMENT TO THE MINNEHAHA COUNTY HOUSING AND REDVELOPMENT COMMISSION
WHEREAS, Minnehaha County adopted Resolution MC 10-17 on February 9, 2010, which activated the Minnehaha County Housing and Redevelopment Commission (“HRC”) pursuant to SDCL 11-7-7; and,
WHEREAS, SDCL 11-7-11 states that such a housing and redevelopment commission shall consist of five commissioners who, unless otherwise provided by ordinance, shall be residents of the County; and,
WHEREAS, the Minnehaha County Board of County Commission recognizes that given the unique nature of Minnehaha County and its workforce there may be potential housing and redevelopment commissioners who may be particularly qualified for service on the HRC and who are not residents of Minnehaha County; and
WHEREAS, the Minnehaha County Commission County Commissioners hereby determines that it best furthers the purpose of the HRC to appoint the most qualified individuals to the Commission regardless of their county of residence.
NOW THEREFORE, BE IT ORDAINED BY MINNEHAHA COUNTY, SOUTH DAKOTA:
1. That, pursuant to SDCL 7-11-11, the Chair of the Minnehaha County Board of County Commissioners may appoint, with the approval of the Board of County Commissioners, nonresidents of Minnehaha County to serve on the HRC.
2. No more than two HRC commissioners may be nonresidents of Minnehaha County.
3. Any individual appointed by the Chair of the Minnehaha County Board of County Commissioners to serve on the HRC who is not a resident of Minnehaha County, must be a South Dakota resident and must reside within Lake, Lincoln, McCook, Moody or Turner County directly adjacent to Minnehaha County.

INITIAL CUSTODY ORDER
South Dakota law, SDCL § 25-4A-11, provides that upon the filing and service of a summons and complaint for divorce or separate maintenance or any other custody action or proceeding, the attached standard guidelines become an order of the Court. Any minor child of the marriage shall remain in the custody of the parent who has been the primary caregiver for the minor child for the majority of time in the twelve months preceding the filing of the summons and complaint, who, in this case, is the Plaintiff, unless the parties agree otherwise. The standard guidelines shall apply and continue in effect, unless the parties agree, or the court orders otherwise. Imposition of the standard guidelines creates no presumption as to who may be awarded custody at any hearing.
The guidelines are also, pursuant to SDCL § 25-4A-14, subject to any provisions established by a South Dakota court in a temporary or permanent domestic protection order, an order arising out of an abuse or neglect proceeding, as bond condition arising out of a criminal case, and an order in any other proceeding affecting child custody or support.
If either party objects to this initial custody and visitation order, the Court shall order a hearing which shall be held not later than 30 days after the date of the objection. The Court shall then issue its temporary custody and visitation order after considering the best interest of the children consistent with the provisions of SDCL § 25-4-45.
IF EITHER PARTY VIOLATES THE TEMPORARY RESTRAINING ORDER OR INITIAL CUSTODY ORDER, THAT PARTY MAY BE HELD IN CONTEMPT OF COURT AND SUBJECT TO SANCTIONS.
ORDER FOR COURT-APPROVED PARENTING EDUCATION
South Dakota law, Supreme Court Rule 22-09, provides that the parties to any action which involves the issues of child custody or parenting time will be required to participate in a court-approved course to educate the parties concerning the impact of the action on the child or children. The course shall be completed within sixty days of the service of the summons and complaint, petition or motion in any action involving child custody or parenting time. Participation in the course may only be waived or delayed by the Judge presiding over the action for good cause shown. Good cause includes but is not limited to a default by one of the parties or a showing that the parties have previously participated in a court-approved course or its equivalent within the past five years.
Participation in the course is not required for a protection order proceeding or if the proceeding involves termination of parental rights of any of the parties. A final decree shall not be granted for a final order shall not be entered until both parties have complied with this requirement, unless participation in the course is waived or delayed for good cause or is otherwise not required. Each party shall be responsible for arranging their participation in the course and for payment of the costs of participation in the course.
Each party shall submit certification of completion of the course to the court prior to the granting of a final decree or the entry of an order, unless participation in the course is waived or delayed for good cause or is otherwise not required as set forth herein. If participation in the court-approved course is waived or delayed for good cause or is otherwise not required under this section, the Judge presiding over the action may order that the parties receive the information in an alternative format.
The State Court Administrator’s Office shall certify approved courses for parties required to participate in a course. Approved courses may include those provided by a public or private entity. At a minimum and as appropriate, an approved course shall include information related to the effects of separation or divorce on children, co-parenting skills and responsibilities, children’s needs and coping techniques, the options for conflict resolution for parenting time and custodial disputes and the financial responsibilities of parents.
