1. Joint Budget Hearing for Siouxland Libraries by Alysia Boysen
A motion was made by Council Member Basye and seconded by Council Member Sigette to approve Item 1.
A motion was made by Council Member Basye and seconded by Council Member Sigette to amend by amending the 2026 General Fund Siouxland Libraries Department operating budget by increasing the budget $270,000 to dedicate to staffing and facility operations, to sustain current hours of operation. Funding to come from City’s General Fund Reserves.

3. Joint Budget Hearing for Metro Communications by Aimee Chase
A motion was made by Council Member Soehl and seconded by Council Member Basye to approve Item 3.

PUBLIC INPUT
There was public input given on the following: property taxes and assessment values, difficulty selling a home, bringing TIFs and buyouts to a public vote, comments made by an elected official at the July 22nd Minnehaha County Commission Meeting, concerns on election integrity, and the prison.

NOTICE OF PUBLIC MEETING FOR THE DRINKING WATER FACILITY PLAN FOR THE TRANSMISSION SYSTEM IMPROVEMENTS SIOUX FALLS, SOUTH DAKOTA:
The City of Sioux Falls has plans of completing water transmission piping system for drinking water infrastructure. These plans include completing the third connection to the Lewis and Clark Regional Water System (L&C) at the intersection of SD 42 (W.12th Street) and 467th Avenue. This is the third connection and will be constructed in order to fully utilize the capacity that L&C anticipates supplying for Sioux Falls as well as provide a redundancy transmission main to mitigate demands. The City has identified emerging containments impacted wells near the Sioux Falls Regional Airport. These wells have been taken out of service to remove the source of contamination in drinking water. A drinking water source replacement is needed.
The City will be applying for the Emerging Contaminants in Small or Disadvantaged Communities (EC-SDC) grant program. This grant program focuses on addressing emerging contaminants, including perfluoroalkyl and polyfluoroalkyl substances (PFAS), in small or disadvantaged communities’ drinking or source water. The statutory authority for the EC-SDC grant program requirements is within Section 1459A of the Safe Drinking Water Act (SDWA) which authorizes the Environmental Protection Agency (EPA) to award grants to states to fund projects that address emerging contaminants in small or disadvantaged communities.
The City is applying for a grant for $7,648,000 to construct this project. The purpose of the meeting is to discuss the proposed projects and the proposed financing. The public is invited to attend and comment on the project. Anyone unable to attend may submit written comments prior to the meeting to: Shannon Ausen, P.E., Engineering Program Manager, 231 N. Absent: none. Dr. James Nold, Superintendent of Schools, Todd Vik, Business Manager, Dr. Kirk Zeeck, Assistant Superintendent, Daniel Conrad, Assistant Superintendent, and Becky Dorman, Senior Director of Human Resources were also present.

In considering this conflict of interest, as presented, the Board has determined that the matter underlying the contract is fair, reasonable, and not contrary to the public interest, and that it is appropriate to grant a prospective general waiver for any substantially similar contracts or transactions between the time of the authorization and the next annual disclosures date, a motion was made by Gail Swenson and seconded by Dawn Marie Johnson, five (5) votes “yes:” on roll call, approving the waiver for a conflict of interest from a District administrator and directing the administration to send the waiver to the South Dakota Auditor General pursuant to SDCL Ch. 3-23 (see MRF# 19770).

C7. Ratification of the Head Start Certification of Governance and Leadership Capacity Screening
The Leadership Capacity Screening was approved by the Head Start Policy Council on 8-18-25. Organizations that accept federal funds to operate Head Start programs must have strong governance systems in place to safeguard federal dollars and provide oversight and direction to the Head Start Program. The Sioux Falls School District Head Start program completed the screening and is fully in compliance.

Rebecca Wimmer, Community Partners & Afterschool Programs Coordinator, presented the CLC Programming Update and Summer Programming Information report as follows (MRF #19776):
The Sioux Falls Community Learning Centers (CLCs) initiative, in partnership with more than 70 community organizations, continues to support student growth through extended academic learning, enrichment activities, life skills development, college and career readiness, and family engagement.
Now in its second year, the elementary program has seen an increase in before-and-after-school care as well as summer enrollment, with overall participation growing by more than 175 students compared to last year. Scholarship support also expanded by $130,000 compared to the previous year, despite the loss of federal funding.
Student outcomes demonstrate the program’s strong impact. This year, 92% of CLC students improved their math scores, and 88% improved in reading. Most students also showed gains in attendance, punctuality, behavior, and learning habits. Chronic absenteeism, a nationwide challenge, declined more sharply among CLC students than the general student population, and their academic performance continues to outpace peers with similar backgrounds.
Looking ahead, CLC services will grow significantly in the 2025-2026 school year. Before-school care is expanding from one elementary site to eight sites, and after-school care now reaches 23 elementary schools with the addition of Marcella LeBeau Elementary. Middle school programming is also launching at Whittier, Ben Reifel, and George McGovern. The donor-funded Boys & Girls Club attached to McGovern highlights community investment in youth and provides extended hours, food support, and summer opportunities. At the high school level, CLC efforts include the College and Career Readiness pilot program at Jefferson, with intramural sports under consideration for future expansion.
Family listening sessions expanded across the District, helping schools set goals based on parent feedback. While districtwide sessions were less effective, the CLC is reassessing its approach to broader engagement. Overall, the CLC program shows how targeted support before, during, and after school can make a meaningful difference for students.

Sara Klaahsen, Language Immersion & Professional Development Coordinator, presented the 2025-2026 Professional Development Update report, as follows (MRF#19777):
The Sioux Falls School District (SFSD) is committed to providing professional learning for all 3,600 employees, a priority outlined in the Sioux Falls School District Priorities.
In the weeks leading up to the 2025-2026 school year, the District provided comprehensive, job-specific training for all employee groups, including clerical staff, education support professionals, related service providers, specialists, teachers, administrators, and substitute teachers. Principals also facilitated building-specific training sessions on health and safety protocols, emergency preparedness, school improvement goals, and other targeted professional development areas.
This year’s professional development emphasized literacy instruction, curriculum design in social studies, CTE, and math, expanded financial literacy opportunities, and the use of artificial intelligence in education. Additional training focused on student well-being, behavioral supports, leadership development, and collaboration with community partners in health and safety.
Staff development will continue throughout the school year with ongoing literacy support, Al applications, ACT preparation, curriculum refinement, and opportunities for staff to propose new training ideas aligned with District Priorities. In-service days are built into the year to strengthen and reinforce best practices that ensure the delivery of a high-quality education.

BALTIC CITY COUNCIL SPECIAL MEETING

Mayor Brian McGreevy called the meeting to order at 7:07 PM in the Baltic City Hall, 130 St. Olaf Avenue. Answering roll call were Alderman Steve Boeve, Nikki Oien, Brian McGreevy, Edward Clark-Jessen. Also in attendance were Finance Officer Lacey Harrington, Public Works Assistant Evan Brown and ISG Engineer Parker Hamann and City Attorney Mae Pochop.
Brian McGreevy led the meeting in the Pledge of Allegiance.
MINUTES
The council reviewed the July 8th, 2025 Regular Council Meeting minutes. Nikki Oien noticed the title of the meeting stated Special Meeting and should say Regular Council Meeting, Lacey Harrington will correct and Nikki Oien made a motion to approve July 8th minutes with that correction, Boeve seconded. All ayes, motion carried.
CLAIMS PAYABLE The Council reviewed the Claims Payable. Finance Officer Harrington explained that the claims were higher than usual due to the ballfield concrete and exterior improvements. Also, since this meeting was pushed a week later than usual, it added those invoices that came in. Clark-Jessen made a motion to approve the Claims Payable, seconded by Boeve. All ayes, motion carried.
PUBLIC TIME
Ryan Sittig came forward on behalf of the Dell Rapids Ambulance Service. Sittig reviewed the ambulance service’s mission and its value to Baltic. He noted each year the City contributes $10,000 to the Dell Rapids Ambulance Service, funding that is vital to its operations. Sittig requested the City include the same $10,000 donation in the 2026 budget. Boeve made a motion to approve another $10,000 donation for the 2026 budget, Clark-Jessen seconded. Motion carried.
Christian Swenson asked if the City has considered encouraging some of the old commercial property owners to address deteriorating structures for future development. McGreevy responded that discussions have taken place and efforts are underway.
Ruth Breen asked how the City is addressing the frisbee golf issue near her daughter’s home. McGreevy stated they are considering relocating the hole and will revisit the matter once a new Maintenance Supervisor is in place.
PUBLIC HEARING – 528 Lovely Avenue
Due to procedural defects, the Public Hearing and recommendations by the P&Z was postponed. McGreevy offered discussion on this issue though voting will not take place.
McGreevy presented the Comprehensive Plan (2003–2025) and reminded the Council that the original vision was for commercial development along Lovely Avenue, which he intends to continue. Attorney Pochop advised the Council to clearly state their positions and anticipated votes to promote transparency and prevent unnecessary delays. Deborah McIsaac, representing Baltic Square, asked the Council how many constituents they have spoken to regarding the project and how Baltic Square believes the project aligns with the City’s comprehensive plan. Citizens spoke both in support of and in opposition to the project. Some members of the Council discussed concerns about the proposal and noted that it does not align with the plans for Lovely Avenue, while another member felt this would be beneficial. Discussions on water and sewer capabilities and concerns were had.
OLD BUSINESS
Panther Graphics – Baltic Wear
Finance Officer Harrington revisited the proposal to order City of Baltic clothing for staff and resale. She reported a quote from Panther Graphics of approximately $1,500 and noted that any items not claimed by staff, Council, or P&Z members would be sold to citizens in the community. Clark-Jessen made a motion to approve the quote and order the items, Boeve seconded, all ayes, motion carried.
4th Street Parking
McGreevy reminded the Council and audience that there will be no parking on the west side of 4th Street. Evan and Dale put those signs up and will be enforced by our ordinance stating any no parking signs put up by the City will be enforced. A citizen also reminded the Council that signs were to go up at Baltic Heights regarding overnight parking. Lacey Harrington will order “No Parking” signs for 10 p.m. to 6 a.m.
NEW BUSINESS
Council Positions & Voting
McGreevy proposed moving into the Mayor role and appointing Eric Comes as Ward 2 Alderman to restore a full Council. Clark-Jessen noted he had not seen prior discussion and suggested tabling, but the motion to table failed. McGreevy recommended Eric Comes be appointed Ward 2 Alderman, Oien made a motion to appoint Eric Comes as Ward 2 Alderman, seconded by Boeve, and carried with a 3–1 vote (Clark-Jessen opposed). Attorney Mae Pochop swore in Eric Comes as Ward 2 Alderman.
Office Assistant
Lacey Harrington advised the Council Trista Bohlen will return to the City of Baltic as the Office Assistant effective 8/19/2025.
Baltic Bulldog Chain Link Cups
Edward Clark-Jessen requested Council approval for the Baltic School District to decorate Baltic Heights ball field fences with “Baltic Bulldogs” cups, noting the durability, and benefits. This will be at no cost to the City of Baltic.
House Bill 1130 – Election Law Passed
Harrington informed the Council about HB 1130, which takes effect July 1, 2025. The bill requires municipalities and school districts to hold elections in even-numbered years in conjunction with the Primary or General election. City Attorney Mae Pochop will review how this affects Baltic’s upcoming election, with further discussion to follow.
ENGINEERING UPDATE
Oak & Ash Project – Hamann walked through the items the contractor is finishing up and closing this project out next month.
Main Lift Station – Hamann gave updates on project plans. Hamann requested approval of Payment Application #5 for $41,918.75.
Pay Application #5 Boeve made a motion to approve Pay Application #5 for $41,918.75 for the Main Lift Station, Clark-Jessen seconded, all ayes, motion carried.
Transportation Alternatives Grant – Hamann gave updates on project plans.
5th Street Improvements – Paving was completed, and Black Top did return and finish the remaining 30 feet that hadn’t been done. Hamann requested approval of Payment Application #1 for $139,241.47 and Change Order #1 for $495.00.

PUBLIC WORKS UPDATE
Maintenance Assistant Evan Brown discussed continued issues at the City of Baltic Rubble Site. Brown recommended putting cattle gates up to keep people out and schedule times to have this open and staffed. Brown also requested putting signs in the grassy area between Adam & Kyle Avenue that state no motorized vehicles. People are driving in there and tearing up the grass.
FINANCE OFFICE UPDATE
Finance Officer Harrington advised the Council that a date needs to be set for the budget preparation meeting. Harrington will send a survey of date options out and the date will be set at a later time depending on those results.
LEGAL/COUNCIL/MAYOR UPDATE
City Attorney Mae Pochop requested the Council start discussing when the City of Baltic wants to hold the next election with the new changes in legislation. The options are June or November of 2026. The majority expressed interest in having the election in November 2026 since there would be a higher voter turnout for that election.
With no further business to discuss, Oien made a motion to adjourn at 8:28 pm. Seconded by Boeve, all ayes, motion carried.

Heim also stated that the request does not comply with the City of Baltic Comprehensive Plan, which recommends that commercial development continue along Lovely Avenue.

WHEREAS, SDCL 1-27-18 authorizes counties to promote and implement the principles of efficient records management for local records; and
WHEREAS, SDCL 1-27-18 further authorizes counties to, as far as practical, follow the program established for the management of state records; and
WHEREAS, Minnehaha County is desirous of implementing a comprehensive records management program; now
THEREFORE, BE IT RESOLVED BY THE MINNEHAHA COUNTY COMMISSION THAT:

Alysia Boysen, Director of Siouxland Libraries, presented the Siouxland Libraries 2026 budget of $11,832,310. The County’s portion for 2026 is $1,620,000. The City’s portion for 2026 is $10,212,310. MOTION by Kippley, seconded by Bleyenberg, to Approve Joint Budget Hearing for Siouxland Libraries.
MOTION by Bleyenberg, seconded by Kippley, to Concur with the City’s Action to Amend the 2026 General Fund Siouxland Libraries Department Operating Budget by Increasing the Budget by $270,000 to Dedicate to Staffing and Facility Operations, to Sustain Current Hours of Operation. Funding to come from City General Fund Reserves. By roll call vote: 5 ayes.

Aimee Chase, Metro Communications Manager, presented the Metro Communications 2026 budget of $7,382,329. The proposed budget includes a 4% contribution increase from both the City of Sioux Falls and Minnehaha County. MOTION by Kippley, seconded by Beninga, to Approve the 2026 Metro Communications Budget as Presented. By roll call vote: 5 ayes. The City concurred.

Disadvantaged Business Enterprise. The Owner’s award of this contract is conditioned upon Bidder or Offeror satisfying the good faith effort requirements of 49 CFR § 26.53.
As a condition of responsibility, every Bidder or Offeror must submit the following information on the forms provided herein within five days after bid opening.
1. The names and addresses of Disadvantaged Business Enterprise (DBE) firms that will participate in the contract;
2. A description of the work that each DBE firm will perform;
3. The dollar amount of the participation of each DBE firm listed under (1);
4. Written statement from Bidder or Offeror that attests their commitment to use the DBE firm(s) listed under (1) to meet the Owner’s project goal;
5. Written confirmation from each listed DBE firm that it is participating in the contract in the kind and amount of work provided in the Construction Manager’s commitment; and
6. If Bidder or Offeror cannot meet the advertised project DBE goal, evidence of good faith efforts undertaken by the Bidder or Offeror as described in appendix A to 49 CFR part 26. The documentation of good faith efforts must include copies of each DBE and non-DBE subcontractor quote submitted to the bidder when a non-DBE subcontractor was selected over a DBE for work on the contract.
Federal Fair Labor Standards Act. All contracts and subcontracts that result from this solicitation incorporate by reference the provisions of 29 CFR part 201, et seq, the Federal Fair Labor Standards Act (FLSA), with the same force and effect as if given in full text. The FLSA sets minimum wage, overtime pay, recordkeeping, and child labor standards for full and part-time workers.
The Contractor has full responsibility to monitor compliance to the referenced statute or regulation. The Contractor must address any claims or disputes that arise from this requirement directly with the U.S. Department of Labor – Wage and Hour Division.
Trade Restriction Certification. By submission of an offer, the Offeror certifies that with respect to this solicitation and any resultant contract, the Offeror -
1. is not owned or controlled by one or more citizens of a foreign country included in the list of countries that discriminate against U.S. firms as published by the Office of the United States Trade Representative (U.S.T.R.);
2. has not knowingly entered into any contract or subcontract for this project with a person that is a citizen or national of a foreign country included on the list of countries that discriminate against U.S. firms as published by the USTR; and
3. has not entered into any subcontract for any product to be used on the Federal project that is produced in a foreign country included on the list of countries that discriminate against U.S. firms published by the USTR.
This certification concerns a matter within the jurisdiction of an agency of the United States of America and the making of a false, fictitious, or fraudulent certification may render the maker subject to prosecution under Title 18 USC § 1001.
The Offeror/Contractor must provide immediate written notice to the Owner if the Offeror/Contractor learns that its certification or that of a subcontractor was erroneous when submitted or has become erroneous by reason of changed circumstances. The Contractor must require subcontractors provide immediate written notice to the Contractor if at any time it learns that its certification was erroneous by reason of changed circumstances.
Unless the restrictions of this clause are waived by the Secretary of Transportation in accordance with 49 CFR § 30.17, no contract shall be awarded to an Offeror or subcontractor:
4. who is owned or controlled by one or more citizens or nationals of a foreign country included on the list of countries that discriminate against U.S. firms published by the U.S.T.R. or
5. whose subcontractors are owned or controlled by one or more citizens or nationals of a foreign country on such U.S.T.R. list; or
6. who incorporates in the public works project any product of a foreign country on such U.S.T.R. list.
Nothing contained in the foregoing shall be construed to require establishment of a system of records in order to render, in good faith, the certification required by this provision. The knowledge and information of a contractor is not required to exceed that which is normally possessed by a prudent person in the ordinary course of business dealings.
The Offeror agrees that, if awarded a contract resulting from this solicitation, it will incorporate this provision for certification without modification in all lower tier subcontracts. The Contractor may rely on the certification of a prospective subcontractor that it is not a firm from a foreign country included on the list of countries that discriminate against U.S. firms as published by USTR, unless the Offeror has knowledge that the certification is erroneous.
This certification is a material representation of fact upon which reliance was placed when making an award. If it is later determined that the Contractor or subcontractor knowingly rendered an erroneous certification, the Federal Aviation Administration (FAA) may direct through the Owner cancellation of the contract or subcontract for default at no cost to the Owner or the FAA.
Civil Rights - Title VI Assurances. The Sioux Falls Regional Airport Authority, in accordance with the provisions of Title VI of the Civil Rights Act of 1964 (78 Stat. 252, 42 USC. §§ 2000d to 2000d-4) and the Regulations, hereby notifies all bidders or offerors that it will affirmatively ensure that for any contract entered into pursuant to this advertisement, business enterprises will be afforded full and fair opportunity to submit bids in response to this invitation and no business will be discriminated against on the grounds of race, color, or national origin (including limited English proficiency), creed, sex (including sexual orientation and gender identity), age, or disability in consideration for an award.
Notice of Requirement for Affirmative Action to Ensure Equal Employment Opportunity
1. The Offeror’s or Bidder’s attention is called to the “Equal Opportunity Clause” and the “Standard Federal Equal Employment Opportunity Construction Contract Specifications” set forth herein.
2. The goals and timetables for minority and female participation, expressed in percentage terms for the contractor’s aggregate workforce in each trade on all construction work in the covered area, are as follows:

Angela Diane Henderson, Plaintiff and hereinafter referred to as “Wife,” being first duly sworn on oath, and for her Complaint against Joseph Lawrence Henderson, Defendant and hereinafter referred to as “Husband,” deposes and states:
1. Wife is a female person over the age of eighteen and Husband is a male person over the age of eighteen years.
2. Wife is a bona fide resident of Minnehaha County, South Dakota and intends to maintain such residence during the pendency of this action. Husband is a bona fide resident of Lincoln County, South Dakota. Wife is not aware of Husband’s intentions as to residency.
3, Husband and Wife were married on the 1st day of September, 2012, in St. Paul, Minnesota; and now are and have ever since been husband and wife.
4. Wife is entitled to a Decree of Divorce from Husband on the grounds of extreme cruelty, under SDCL 25-4-2(2) or in the altemative, irreconcilable differences, under SDCL 25-4- 2(7).
5. Two children have been born as issue of the marriage, namely, Clara Morowa Violette Henderson, born on the 6th day of January of 2018, and August Jay Dean Henderson, born of the 15th day of January, 2016.
6. Wife states that she is not now pregnant.
7. Wife is a fit and proper person to have primary physical custody and sole legal custody of the minor children. There is a protection order that is currently in place against Husband with the minor children as protected parties (See 49TP024-1239).
8. In compliance with the Unifonn Child Custody Jurisdiction and Enforcement Act, Wife states:
(A) The minor children of the parties currently reside with Wife in Minnehaha County. During their life, the minor children of the parties have resided in Sioux Falls, South Dakota.
(B) Wife intends to maintain her residence in Minnehaha County, South Dakota for the foreseeable future. Wife is unaware of Husband’s future intentions of residency.
(C) No other action concerning the custody of the children is pending in this or any other state other than this action between the parties hereto.
(D) No other party has claimed a right to the custody of the children, and no other person not a party to this proceeding has claimed any right to parenting time privileges with said children at the time of the signing of this Complaint.
9. The parties have acquired certain property and debts during the course of their marriage. Wife asks the Court to make an equitable division of the property and debts of the marriage.
10. Neither party to this action is a member of any branch of the Armed Services of the United States.
11. Husband is an able-bodied person capable of earning an income of an amount sufficient to pay a suitable sum of monthly child support to Wife for the care and support of the minor children of the parties.
12. That Husband is an able-bodied person capable of earning an income of an amount sufficient to pay a suitable sum of monthly spousal support to Wife.
WHEREFORE, Wife prays for Judgment as follows:
A. That Wife be granted a Decree of Divorce on the grounds of extreme cruelty, and that the parties be restored to status of single parties;
B. That Wife be given primary physical custody and sole legal custody of the minor children born as issue of the marriage. There is a protection order that is currently in place against Husband with the minor children as protected parties (See 49TP024-1239);
C. That Husband be required to pay a suitable sum of monthly child support to Wife;
D. That Husband be required to pay a suitable sum of monthly spousal support to Wife;
E. That the Court make an equitable division and allocation of the property and debts of the parties;
F. That Husband be required to pay for Wife’s attorney fees incurred in pursuing this action; and
G. That the Court grant further relief as the Court may deem just and equitable.

CUSTODY ORDER
Pursuant to SDCL 25-4A-11 et. seq., upon service of this Summons the attached visitation guidelines become an Order of this Court. Any minor children of this marriage shall remain in the custody of the parent who has been the primary care giver for the minor children for the majority of time in the twelve months preceding the filing of this Summons and Complaint unless the parties otherwise agree. The guidelines are subject to any provisions established by a South Dakota Court in a temporary or permanent domestic protection order, an order arising out of an abuse or neglect proceeding, as a condition of bond arising out of a criminal case, or an order in any other proceeding affecting child custody or support.
The attached guidelines shall apply and continue in effect unless the parties agree or the Court otherwise orders. The imposition of these standard guidelines creates no presumption as to who may be awarded custody at any hearing. An agreement by the parties for visitation other than the standard guidelines must be in writing, signed by both parties, and filed with the Court.
If either party objects to this initial order, the Court shall order a hearing which shall be held not later than 30 days after the date of the objection. The Court shall then issue its temporary custody and visitation order after considering the best interest of the children consistent with the provisions of SDCL 25-4-45.
