Lawsuit filed after sewer district rejects man's attempt to install septic system

A Sully County property owner has filed suit against a sanitary sewer district, alleging the district is making unreasonable demands that he pay to hook up to the system.

Victor Utech and his Codgers Castaway Development sued the Spring Creek Cow Creek Sanitary District in federal court. The district comprises about three square miles of territory in Sully and Hughes counties.

Besides serving 300 residential and commercial customers with both sanitary sewer and drinking water, it also serves campgrounds in the area near Lake Oahe. Much of the district’s territory includes undeveloped agricultural lands.
