A federal judge Wednesday said she will not stop the South Dakota Attorney General’s Office from enforcing the state’s deceptive advertising laws against a nonprofit that advertised abortion-inducing drugs in the state.

Judge Katherine Polk Failla of the Southern District of New York also ordered Mayday Health and the state to submit written arguments to show cause for why she shouldn’t dismiss Mayday’s lawsuit, citing her lack of jurisdiction in the issue. She gave the parties until March 2.
