Company blames 'third party' in chemical drift lawsuit over damaged trees

South Dakota woman sued Wilbur-Ellis after her maples, spruce trees got hit by herbicides

An international company that distributes agricultural chemicals is denying allegations by a South Dakota woman that its products damaged her trees.

Wilbur-Ellis filed an answer to the lawsuit that Dena Lacey lodged against the company in May.

Lacey accused a Wilbur-Ellis employee or agent of applying chemicals on a field adjacent to her McCook County property. The May 28, 2024 application occurred under “adverse conditions,” according to the lawsuit, which included high winds and gusts – an allegation that Wilbur-Ellis denied.
