Attorney General Jackley demands state senator return hundreds of thousands in Covid money

Attorney General Marty Jackley is demanding that state Sen. Jessica Castleberry repay more than $600,000 that her businesses received in COVID-19 relief money.

In a letter to Castleberry, a Republican from Rapid City, Jackley said that the receipt of $603,000 in Covid money by Little Nest Preschool violated a South Dakota Supreme Court advisory order which said businesses owned by lawmakers were not eligible to receive Covid money.

“The state of South Dakota respectfully requests that you repay all of such payments, taken in violation of the Constitution and the advisory opinion,” the letter said.

“Please understand,” Jackley added, “the Constitution does not permit us to negotiate the amount; all amounts paid in violation of the Constitution must be returned.”
